It’s the latest antitrust lawsuit against the biggest players in the tech industry.

The US Department of Justice and more than a dozen states have filed a lawsuit against Apple in federal court, accusing it of violating antitrust laws by making its hardware and software products largely inaccessible to competitors. Apple’s “walled garden” approach to business, as it’s so often called, makes it difficult for rivals to compete and for customers to switch to other companies’ products. The lawsuit comes on the heels of the European Commission slapping Apple with a €1.8 billion ($1.95 billion) fine. Apple, the commission concluded, prevented music streaming developers from “informing iOS users about alternative and cheaper music subscription services available” outside the App Store.

“Apple undermines apps, products, and services that would otherwise make users less reliant on the iPhone,” Attorney General Merrick Garland wrote in a press release published by CNN. “Apple exercises its monopoly power to extract more money from consumers, developers, content creators, artists, publishers, small businesses, and merchants, among others.”

He also briefly mentioned that phone notifications, or the interface alerts on a phone’s front screen, were used to spy on users. Wyden claimed that phones running on Android and iOS would have records of what notifications a user might receive, offering insight into users’ everyday lives, and that government officials have requested this data.

Push notification practices place Apple and Google “in a unique position to facilitate government surveillance of how users are using particular apps,” Wyden wrote. He urged the DOJ to “repeal or modify any policies” that hindered discussion of push notification spying.

LONDON/WASHINGTON (Reuters) – Thousands of smartphone applications in Apple and Google’s online stores contain computer code developed by a technology company, Pushwoosh, that presents itself as based in the United States but is actually Russian, Reuters has found.

The Centers for Disease Control and Prevention (CDC) said it had been deceived into believing Pushwoosh was based in the U.S. capital. After learning about its Russian roots from Reuters, it removed Pushwoosh software from seven public-facing apps, citing security concerns.

The U.S. Army said it had removed an app containing Pushwoosh code in March because of the same concerns. That app was used by soldiers at one of the country’s main combat training bases.

Sen. Hawley called it ‘the most important antitrust case in a generation’

Lawmakers in the House and Senate on Tuesday welcomed the Justice Department’s (DOJ’s) move to file an antitrust lawsuit against Google that claims the tech behemoth used its power to preserve its monopoly via its search engine.

“Today’s lawsuit is the most important antitrust case in a generation,” Sen. Josh Hawley, R-Mo., said in a statement. “Google and its fellow Big Tech monopolists exercise unprecedented power over the lives of ordinary Americans, controlling everything from the news we read to the security of our most personal information. And Google in particular has gathered and maintained that power through illegal means.”

STOCKS RISE ON STIMULUS HOPES, GOOGLE SHRUGS OFF DOJ ANTITRUST ACTION

The DOJ suit alleges that Google has used its dominance in online search and advertising to stifle competition and boost profits. The suit could be an opening shot in a battle against a number of Big Tech companies in the coming months.

A Google spokesperson told Fox News: “Today’s lawsuit by the Department of Justice is deeply flawed. People use Google because they choose to — not because they’re forced to or because they can’t find alternatives. We will have a fuller statement this morning.”

According to the lawsuit, “For years, Google has entered into exclusionary agreements, including tying arrangements, and engaged in anticompetitive conduct to lock up distribution channels and block rivals.”

“American consumers are forced to accept Google’s policies, privacy practices, and use of personal data; and new companies with innovative business models cannot emerge from Google’s long shadow. For the sake of American consumers, advertisers, and all companies now reliant on the internet economy, the time has come to stop Google’s anticompetitive conduct and restore competition,” it says.

The DOJ claims the action was brought to stop Google from “unlawfully maintaining monopolies in the markets for general search services, search advertising, and general search text advertising in the United States through anticompetitive and exclusionary practices, and to remedy the effects of this conduct.”

“Largely as a result of Google’s exclusionary agreements and anticompetitive conduct, Google in recent years has accounted for nearly 90 percent of all general-search-engine queries in the United States, and almost 95 percent of queries on mobile devices,” the lawsuit says.

JUSTICE DEPARTMENT FILES LONG-AWAITED ANTITRUST SUIT AGAINST GOOGLE

The lawsuit has been in the works for over a year, and Big Tech executives from Google, Apple, Facebook, and Twitter have been anticipating an announcement — designing their testimonies in Congress to ward off a potential federal suit.

House Antitrust Subcommittee Chairman David N. Cicilline, D-R.I., described the lawsuit as “long overdue” and brought attention to prior investigations by the committee.

“The Subcommittee’s investigation uncovered extensive evidence showing that Google maintained and extended its monopoly to harm competition,” he said in a statement. “It is critical that the Justice Department’s lawsuit focuses on Google’s monopolization of search and search advertising, while also targeting the anti-competitive business practices Google is using to leverage this monopoly into other areas, such as maps, browsers, video, and voice assistants.”

The lawsuit alleges that Google used billions of dollars from advertisers to payphone manufacturers to ensure Google is the default search engine on browsers.

“For a general search engine, by far the most effective means of distribution is to be the preset default general search engine for mobile and computer search access points,” the lawsuit says. “Even where users can change the default, they rarely do. This leaves the preset default search engine with de facto exclusivity.”

The Trump administration has long had Google in its sights. A top economic adviser to President Trump said two years ago that the White House was considering whether Google searches should be subject to government regulation.

Trump and other Republicans have accused Big Tech companies of having an anti-conservative bias — claims they have denied.

In a press conference, Deputy Attorney General Jeffrey Rosen said that the case had nothing to do with online bias, and was only about competitive conditions in the marketplace.

Sept. 13 (UPI) — House lawmakers requested internal documents from Google, Facebook, Amazon, and Apple as part of an antitrust investigation examining competition in digital markets.

The House Judiciary antitrust subcommittee sent letters to the four tech companies seeking communications and documents related to their market dominance.

“Today’s document requests are an important milestone in this investigation as we work to obtain the information that our members need to make this determination,” Rep. David Cicilline, D-R.I., said in a statement. “We expect stakeholders to use this opportunity to provide information to the committee to ensure that the internet is an engine for an opportunity for everyone, not just a select few gatekeepers.”

“It is increasingly difficult to use the Internet without relying on these services,” Nadler said in the statement. “The documents requested will provide the committee with a better understanding of the degree to which these intermediaries enjoy market power, how they are using that market power, whether they are using their market power in ways that have harmed consumers and competition, and how Congress should respond.”

Apple deleted all episodes for five of InfoWars’ six podcasts, including the popular “Alex Jones Show” podcast, which was hosted by Jones, a prominent conspiracy theorist.

Facebook made a similar move by taking down four InfoWars pages after originally removing only certain videos it said violated its hate speech and bullying policies. Jones was previously suspended from the social media platform for 30 days.

YouTube also removed Jones’ channel from the platform.

“They’re invading the First Amendment,” Jones responded.
