<p class="text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD" data-testid="paragraph-1">Lawyers for the Biden administration told the U.S. Supreme Court in their filing that Texas&#8217; &#8220;activities have changed the situation along the relevant stretch of the Rio Grande.&#8221; They added that the additional barriers in and around Eagle Pass, Texas &#8220;further restricts Border Patrol&#8217;s ability to reach the river in particular areas.&#8221;</p>
<p data-testid="paragraph-1">The filing comes after the administration earlier this month asked the justices to temporarily allow Border Patrol agents to cut or remove controversial razor-wire fencing that Texas officials placed along part of the Republican-governed state&#8217;s border with Mexico to deter illegal border crossings.</p>

<p>The border crisis took no time off this Memorial Day weekend as thousands of migrants continued to pour over the southern border.</p>
<p>More than 4,000 migrants illegally crossed the border via the Rio Grande Valley over the course of the long weekend, Fox News has learned.</p>
<p>&#8220;There’s no effort to actually secure the border and to figure out who and what&#8217;s coming in when you create a chaotic situation like this, and they have created this through their policies,&#8221; Scott said.</p>
<p><a href="https://www.foxnews.com/politics/border-patrol-chief-agents-nab-multiple-sex-offenders-drug-hauls">BORDER PATROL CHIEF ‘EXTREMELY PROUD’ AS AGENTS NAB MULTIPLE SEX OFFENDERS, DRUG HAULS OVER THREE DAYS</a></p>
<p>According to U.S. Customs and Border Protection, Border Patrol has encountered 1,219,920 undocumented migrants so far in 2022, and that number appears far from slowing amid the administration’s efforts to end Title 42, a health order that allows the U.S. to turn away undocumented migrants seeking asylum.</p>
<p>The Department of Justice announced it will appeal a decision handed down last week by a federal judge that blocked the administration from ending Title 42, however the DOJ has not officially filed the appeal.</p>
<p>Once Title 42 expires, the Department of Homeland Security predicts up to 18,000 migrants could cross the border daily.</p>
<p>Border Patrol Chief Raul Ortiz announced Friday that agents had nabbed 10 sex offenders, a slew of deadly drugs, and other illegal immigrants wanted for serious crimes in three days.</p>

<p>It may not be news on the mainstream outlets, but we&#8217;re in the middle of an insurrection to overthrow everything to do with the United States.  Months after the fact, “protesters” are still battling police in the streets at all hours of the night and early morning.  They&#8217;ve spray-painted buildings, including federal offices and courthouses.  The coalition of <em>antifa</em>, black lives matter and Muslim brotherhood have banded together to battle police throwing every available projectile at them.  President Trump has sent officers from the Border Patrol and Homeland Security to protect federal property, and you undoubtedly know the response, not only from the protest groups, but from the “progressive” Mayors of Portland, Chicago and other big cities.</p>
<p>“Clean up the graffiti and go home!”  For at least a week most media outlets have come unglued, claiming that Trump has unleashed “federal troops” to “disappear peaceful protesters in unmarked vehicles.”  They&#8217;ve said, “This is what we&#8217;d expect of a foreign dictator.”  It looks as though we can expect this narrative to play on.  The President has just said he intends to send federal police to a list of cities, including Albuquerque?</p>
<p>Apparently the carnage in Minneapolis and New York was so spectacular, the media failed to even inform us about what a hotbed Portland had become.  The insanity is ongoing in Portland to this day.  It&#8217;s the sixties all over again, with a whole generation having been brainwashed instead of educated. The radical bombers and rioters of the &#8217;60s are now esteemed professors, and they&#8217;ve turned the nation&#8217;s youth against their own parents and against the United States.</p>
<p>There&#8217;s no way I can&#8217;t tell you of the work Glenn Beck has done, exposing the connections between the radical professors, the “Arab Spring” protests that roiled the Middle East, the invasion of Europe by “poor refugees” and now the full-blown attempt to destroy the American culture and economy.  He&#8217;s got the goods.</p>
<p>Some of us have been highly suspicious of the media reporting about the Chinese virus.  Yes, we do know of a handful of people who are said to have tested positive.  But none of them died, and for some it was a matter of something like the common cold.  For others we know it was like a bad flu, but they survived it and are doing fine.  Nevertheless, every news report claims a new spike in cases, and proceeds to lecture that you must be afraid.</p>
<p>News anchors across the board read the “wire,” claiming that cases are “exploding” in state after state, county after county, city after city.  You must proceed with fear, assuming you proceed at all.   They express total exasperation at President Trump for not having issued a national mask order.  Meanwhile lawsuits are flying over mask “mandates.”  All the mandates we care about are the ones God-ordained.  Isn&#8217;t that the whole idea behind the American philosophy?  Laws are to maintain a peaceful, orderly society according to God&#8217;s Laws for mankind.  Beyond that, we don&#8217;t think too much of little officials who&#8217;ve had a taste of power.</p>
<p>Here in Texas, our governor saw fit to order a mask mandate.  He says we can all go back to living if we&#8217;ll just wear our masks, wash our hands, stay at least six feet apart and stop touching our faces.  You&#8217;d be amazed at how few pay the least bit of attention.  But businesses don&#8217;t have that luxury.  If they&#8217;re a restaurant or bar, they can have their business license or liquor license revoked if they don&#8217;t follow protocol, regardless of the soundness of whatever logic the “authorities” are pushing this week.  Credit goes to Victor Davis Hansen for coming up with this gem.  “They&#8217;re trying to save our lives by preventing us from living.”</p>
<p>Meanwhile, the media&#8217;s beloved protesters obviously don&#8217;t care a whit about “keeping everyone safe.”  Portland, Oregon has nightly battles between protesters and police.  These poor cops are standing around dodging rocks, bricks and frozen water bottles.  Meanwhile the President sent in some Border Patrol, U. S. Marshals, and DHS officers to protect the federal courthouse and office buildings.  And the media goes nuts.</p>
<p>Who knew there was trouble in Albuquerque, of all places?  It&#8217;s going to get a compliment of federal police too.  Turns out they&#8217;ve had violent confrontations in the streets resulting in shootings.  All this is over a statue of a conquistador who founded the settlement, but is accused having massacred Indians.  All that happened some 400 years ago, long before the founding of the United States.  Do you ever get the idea that radicals are just looking for an excuse to create anarchy?</p>
<p>It&#8217;s “marshal law” say all the networks.  They&#8217;re “stormtroopers.”  It&#8217;s the gestapo!  Anchors and “experts” on all the cable channels claim that this is merely a dry run for when Trump refuses to leave the White House after losing the upcoming election.  They wedge that in between calling the President a racist, xenophobe, narcissist, dictator, claiming he values his political fortunes more than he cares about the people of the United States.  Just guessing, but it&#8217;s doubtful many would have given up the luxury and freedom of his billionaire lifestyle to become the target of lowlife communists, the darlings of network anchors.</p>
<p>The Church of God has a history of preaching that the end of the age is at hand.  It made the mistake of predicting that the church would flee to a place of safety, even naming that place, as the tribulation of Matthew 24 and the book of Revelation began destroying western culture.  That was fifty and more years ago.  Since then, some of these guys who led away splinter groups have called themselves prophets and apostles and claim they are administering the “government of God” among their flocks and will lead them to a place of safety.  That is, after their people have given everything they have to the “church.”</p>
<p>If somebody knows what they&#8217;re saying or doing now, please keep it to yourself.  We don&#8217;t even want to know.  It&#8217;s a huge embarrassment that they took some of the most bizarre claims of Herbert W. Armstrong very late in his life, when he was suffering severe health problems and under the smothering influence of his “advisor,” and applied those claims to themselves.  Suddenly they are apostles and prophets with God&#8217;s infallibility, and people just wait for their instructions.  If you&#8217;ve ever been under such dictatorial authority, our hearts go out to you.</p>
<p>Ours is a work of watching and warning, not issuing and enforcing “orders.”  Things are getting mighty dicey of late.  We&#8217;ve got a communist insurrection underway that is wealthy and has the tacit approval of most mainstream corporations and media.  Sports used to be a way of escaping the nonsense.  Not any more.  The franchises are all going to rub our faces in their racist nonsense.  Professional baseball, basketball and football have gone out of their way to let us know they side with the mob.  Most TV networks are not only on board, but airing ads about how they stand for diversity, inclusion, equality and justice.  In fact, they&#8217;re hoping they don&#8217;t get burned to the ground.</p>
<p>When you look at the bravery and the dignity with which our founders conducted themselves in the business of winning our freedom, this stuff looks like tiddlywinks.  But only in terms of its actual importance.  Some of us believe the racists are the people trying to rile everybody up about racism.  The rest of us are hoping the anarchists and the violent masked masses find something productive to do with their lives.</p>
<p>The United States has been a great blessing to all mankind.  We&#8217;ve got real concerns, and no time to be drawn aside by a bunch of thugs yearning to loot expensive retailers.  We want the police to do their jobs and return peace and order to cities and public places.  We&#8217;re not about to take a knee, or join some movement of appeasement.  If they&#8217;re bent out of shape about some historical injustice, they can write a letter.  But attacking police has got to stop.  Rioting, burning, looting is not protest.  The protests are NOT peaceful.  They are cover for a movement that seeks to destroy Western culture.</p>
<p>In my neighborhood, two houses have lawn signs that say God is in control.  Certainly God has intervened at critical times in history, and you&#8217;d have to be blind to ignore the miracles He wrought, several in the war that won our independence.  But the idea that He&#8217;s “controlling” the lies, the deceptions and the violence we see playing out around us seems a stretch.  My Dad believed that God allowed humanity to do what it would, intervening only when He saw fit.  Will He see fit to intervene and save the Western world?  Does the Western world deserve His intervention and continued blessings?</p>
<p>God is in control whenever He wants to be.  Otherwise, he&#8217;s allowing events to unfold here on Earth.  He hears the prayers of the righteous, but how many are there?  It seems that there are many upright people trying to do what&#8217;s right, but have been deceived by their own families and churches about God&#8217;s Sabbaths and commanded observances that commemorate historical events of all our forefathers.  There are things they don&#8217;t understand and cannot accept, but they are living otherwise honorable lives.</p>
<p>Evil has descended upon the United States, Canada, Britain, Australia, and Europe.  All have been consumed by the deception we call fake news.  Every one of those nations has already fallen victim to an ideology of evil, contrary to the Bible and contrary to the founding principles that allowed for the peace and prosperity foretold and promised to Abraham by God.  He made good on His promises, but our societies have long since abandoned our responsibilities that were part of the covenant.  In essence, we&#8217;ve nationally reneged on respecting His Word and obeying His Laws.</p>
<p>Society has demanded that we acquiesce to some of the most heinous sins ever invented.  They are celebrated with parades and debauchery, you must applaud lest “society” destroy your life.  Our nation needs the prayers of people God respects.  We&#8217;re in the middle of a big deal, and it&#8217;s starting to look as if there&#8217;s no going back.  Not only with the communists that want to destroy freedom and capitalism, but with communist China. If we want God to intervene and save Western civilization one more time, it will take <strong>repentance</strong> for having broken His Laws.  No, there is not yet a ten-nation beast power.  Jerusalem is not surrounded with armies.  We can still buy and sell, sort of.  The abomination of desolation has not been set up, and there is yet no temple.  But Western civilization is in grave trouble.  We suspect that the author of evil is directing the deception and the destruction, and we know where the only hope lies.</p>

<p>&#8216;I can’t explain it to the American people through Congress since it’s hard to do in a five- or six-minute [television] hit,&#8217; he said.</p>
<p>Former Immigration and Customs Enforcement (ICE) chief Tom Homan is out with a book, which he said lays out the immigration debate before the American people and “sets the record straight” about his own positions on border security.</p>
<p>Homan <a href="https://www.amazon.com/Defend-Border-Save-Lives-Humanitarian-ebook/dp/B07V1LR763" target="_blank" rel="noopener noreferrer">just released</a> “Defend the Border and Save Lives: Solving Our Most Important Humanitarian and Security Crisis,” which dives into the always-controversial topic of immigration. Homan, who spent a career in law enforcement and, most recently, as the acting director of ICE, spoke with the Daily Caller News Foundation about what’s inside the book and what drove him to write it.</p>
<p>“I’m a cop. I never thought I’d write a book, but I wrote it pretty much out of frustration,” Homan told the DCNF.</p>
<p>The former ICE chief said that the complex issues taking place at the border can’t be explained in a short segment on television, nor can they be explained on the Hill, where he said the discussion on immigration enforcement quickly turns into a <a href="https://dailycaller.com/2019/09/26/thomas-homan-pramila-jayapal/" target="_blank" rel="noopener noreferrer">shouting match</a> with lawmakers.</p>
<p>“So since I can’t explain it to the American people through Congress since it’s hard to do in a five- or six-minute [television] hit, I said, ‘I’ll write a book and explain to the American people the underbelly of illegal immigration,&#8217;” Homan said.</p>
<p>The main point that Homan hopes readers take away from reading his book: that illegal immigration is not a victimless crime.</p>
<p>“I wanted to identify to the American people that illegal immigration is not a victimless crime. Here’s why you should care. Here’s what’s wrong, and here’s how we fix it,” the longtime immigration officer said. “It’s not hard to fix.”</p>
<p>Homan noted that, even for illegal aliens who enter the country and do not commit any violent crimes, many of them have to pay a cartel or smuggling organization to transport them to the U.S. border — essentially bankrolling violent organizations.</p>
<p>He added that 31% of women are raped on their journey to the U.S.-Mexico border and that Border Patrol agents rescued more than 4,000 individuals in 2019 who would have <a href="https://dailycaller.com/2019/05/17/border-patrol-migrant-rescues/" target="_blank" rel="noopener noreferrer">otherwise perished</a> in the desert or drowned in the Rio Grande. Allowing illegal immigration to continue will only fuel such dangerous conditions.</p>
<p>Homan certainly speaks from a perch of deep experience in law enforcement.</p>
<p>He served as a police officer in New York before joining what was then called the Immigration and Naturalization Service — the agency was changed in the wake of the 9/11 terrorist attacks. He also served as a Border Patrol agent and was later appointed by former President Barack Obama to be executive associate director of Immigration and Customs Enforcement in 2013.</p>
<p>He then served as the acting director of ICE from January 2017 to June 2018, the first ICE chief under the Trump administration, before retiring from government.</p>
<p>The former ICE director, who works as a <a href="https://dailycaller.com/2019/09/16/thomas-homan-anti-ice-protesters/" target="_blank" rel="noopener noreferrer">contributor</a> for Fox News and frequents congressional hearings, said not everyone is going to enjoy his book.</p>
<p>“When you read this book, Nancy Pelosi is not going to like it, AOC is not going to like it. The people on the far left of the game are not going to like it,” he said.</p>
<p>Homan added: “I explain what [Border Patrol and ICE does], and most importantly what they don’t do. They never arrested anybody in church, they never arrested in the hospital. But the left wants to think that. It’s my intent to put the false narrative to bed.”</p>
<p>Going beyond the immigration debate in Washington, D.C., Homan noted the personal excerpts in the book and how it details what he’s witnessed in his more than 30 years in law enforcement.</p>
<p>“If they’ve seen what I’ve seen for 34 years, they’d understand why I’m emotional about this issue and they would understand why I take the position that I do,” he said. “They don’t understand what’s going on behind the scenes.”</p>
<p>“A lot of people say I’m a racist. I’m here to set the record straight,” he said. “My book talks about who Tom Homan is and how Tom Homan became the guy they see out there.”</p>

<p>Immigration and Customs Enforcement (ICE) officials have been tasked since January with fingerprinting teens in child migrant shelters who entered the country without their parents, <a class="gtm-content-click" href="https://www.buzzfeednews.com/article/hamedaleaziz/ice-immigration-customs-fingerprinting-refugees-teens" target="_blank" rel="noopener noreferrer" data-vars-link-text="BuzzFeed News reported" data-vars-click-url="https://www.buzzfeednews.com/article/hamedaleaziz/ice-immigration-customs-fingerprinting-refugees-teens" data-vars-content-id="e2544f97-0ce4-499b-a292-a52f486bc328" data-vars-headline="ICE is fingerprinting teen migrants" data-vars-event-category="story" data-vars-sub-category="story" data-vars-item="in_content_link">BuzzFeed News reported</a> and Axios confirmed.</p>
<p><strong>Why it matters: </strong>ICE says the data collection is for the children&#8217;s protection, but it also comes as immigration agencies have ramped up their collection of migrant biometric data.</p>
<p><strong>More than 7,800 child migrants</strong> released from shelters overseen by the Department of Health and Human Services (HHS) to family members or other &#8220;sponsors&#8221; have not shown up for immigration court hearings and have &#8220;disappeared,&#8221; a senior ICE official told Axios in a statement.</p>
<ul>
<li>The agency&#8217;s move is intended, at least in part, &#8220;to mitigate and prevent the risk of their victimization by human traffickers and smugglers, and to reduce misidentification,&#8221; according to the senior official. Immigrant registration and fingerprinting are also <a class="gtm-content-click" href="https://www.law.cornell.edu/uscode/text/8/1302" target="_blank" rel="noopener noreferrer" data-vars-link-text="required by law" data-vars-click-url="https://www.law.cornell.edu/uscode/text/8/1302" data-vars-content-id="e2544f97-0ce4-499b-a292-a52f486bc328" data-vars-headline="ICE is fingerprinting teen migrants" data-vars-event-category="story" data-vars-sub-category="story" data-vars-item="in_content_link">required by law</a>.</li>
</ul>
<p><strong>The big picture: </strong>Over the last year, the Trump administration has taken multiple steps to ramp up the amount of biometric data they collect on migrants — enabling them to more carefully track and, when necessary, quickly deport unauthorized immigrants.</p>
<ul>
<li>In April 2019, Border Patrol began collecting biometric data, including fingerprints, from more migrant children under 14 years old who crossed the border with their parents, <a class="gtm-content-click" href="https://apnews.com/8aec21ef9cc34638a9e54a19466dc867" target="_blank" rel="noopener noreferrer" data-vars-link-text="AP reported" data-vars-click-url="https://apnews.com/8aec21ef9cc34638a9e54a19466dc867" data-vars-content-id="e2544f97-0ce4-499b-a292-a52f486bc328" data-vars-headline="ICE is fingerprinting teen migrants" data-vars-event-category="story" data-vars-sub-category="story" data-vars-item="in_content_link">AP reported</a>.</li>
<li>Last month, Customs and Border Protection began a pilot program to collect DNA from some migrants in its custody, <a class="gtm-content-click" href="https://www.cnn.com/2020/01/06/politics/dna-samples-migrants-trump-administration/index.html" target="_blank" rel="noopener noreferrer" data-vars-link-text="CNN reported" data-vars-click-url="https://www.cnn.com/2020/01/06/politics/dna-samples-migrants-trump-administration/index.html" data-vars-content-id="e2544f97-0ce4-499b-a292-a52f486bc328" data-vars-headline="ICE is fingerprinting teen migrants" data-vars-event-category="story" data-vars-sub-category="story" data-vars-item="in_content_link">CNN reported</a>. Immigrants in any federal immigration agency&#8217;s custody could ultimately be subject <a class="gtm-content-click" href="https://www.axios.com/trump-dna-samples-immigrants-dhs-custody-doj-036fb8bb-2204-4f29-9dd3-5ed3ef0a1ab3.html" target="_self" data-vars-link-text="to having their DNA collected" data-vars-click-url="https://www.axios.com/trump-dna-samples-immigrants-dhs-custody-doj-036fb8bb-2204-4f29-9dd3-5ed3ef0a1ab3.html" data-vars-content-id="e2544f97-0ce4-499b-a292-a52f486bc328" data-vars-headline="ICE is fingerprinting teen migrants" data-vars-event-category="story" data-vars-sub-category="story" data-vars-item="in_content_link" rel="noopener noreferrer">to having their DNA collected</a> and stored in the FBI&#8217;s criminal database.</li>
</ul>
<p><strong>Between the lines: </strong>The trend points to immigration enforcement officials&#8217; frustration at how little information HHS collects — or verifies — before releasing a migrant child to a sponsor.</p>
<ul>
<li>&#8220;HHS is basically rushing to get kids out of custody,&#8221; a White House official told Axios. &#8220;When a child goes missing, we have nothing on the child.&#8221;</li>
<li>The senior ICE official called HHS&#8217; current information collection practices &#8220;dangerous and irresponsible,&#8221; accusing the department of &#8220;willfully&#8221; relying on suspect documents &#8220;for the sole purpose of increasing the speed of placement and ignoring the obvious risks to child welfare and safety.&#8221;</li>
</ul>
<p><strong>The other side: </strong>HHS told Axios in a statement that it has extensive vetting processes that do not allow migrant minors to be released to &#8220;known fugitives&#8221; and that they provide ICE with the address and name of each released child&#8217;s new caretaker.</p>
<ul>
<li>&#8220;These are vulnerable children in difficult circumstances, and HHS treats its responsibility for each child with the utmost care,&#8221; it added.</li>

										<content:encoded><![CDATA[<p>The Trump administration this week added a new location to a Department of Homeland Security program that turns away asylum seekers who arrive at official crossing points at the U.S.-Mexico border.</p>
<p>The Migrant Protection Protocols (MPP) was implemented Monday in a new location — Eagle Pass, Texas — where Central American families, as well as Congolese, Angolans, and Haitians, have constituted the largest groups of asylum seekers arriving over the past six months.</p>
<p>It is the sixth crossing point, or port of entry, on the southern border where DHS has opted to turn away people since implementing its “Remain in Mexico” policy in January. Other border crossings already returning migrants to Mexico are San Diego, California; Calexico, California; El Paso, Texas; Laredo, Texas; and Brownsville, Texas.</p>
<p>“The President is using every tool available to address the humanitarian crisis at the border to include domestic policy changes and fostering collaboration with our neighbors in the region. The Migrant Protection Protocols has been a key component to the success we have had addressing the crisis,” acting DHS Secretary Kevin McAleenan said in a <a href="https://www.dhs.gov/news/2019/10/28/dhs-expands-mpp-operations-eagle-pass" target="_blank" rel="noopener noreferrer">statement</a>. “I am grateful to the government of Mexico for their partnership, including accepting MPP returns at Eagle Pass.”</p>
<p>Under the program, citizens of countries other than Mexico who have passed through Mexico but not sought asylum there are not allowed into the U.S. to claim asylum but must wait in Mexico until a federal immigration judge can hear the case.</p>

<p>As of earlier this month, approximately 50,000 people had been blocked from entering the United States at legal points, Reuters <a href="https://www.reuters.com/article/us-usa-immigration-babies-exclusive/exclusive-u-s-migrant-policy-sends-thousands-of-children-including-babies-back-to-mexico-idUSKBN1WQ1H1" target="_blank" rel="noopener noreferrer">reported</a>. U.S. Customs and Border Protection officials have referred illegal crossers to apply at these ports of entry instead of the often unfenced land between them. DHS has described its Remain in Mexico policy as a response to the surge of asylum seekers coming to the southern border over the past 12 months.</p>
<p>The number of people illegally crossing declined drastically over the summer, while the rate of asylum seekers presenting at border crossings remains consistent at around 10,000 to 12,000 monthly. In addition to the returns, CBP officers working at crossing points are hearing limited numbers of asylum claims per day, meaning migrants seeking to make asylum claims may have to wait days or weeks to make the initial credible fear of return claim.</p>
<p>Human Rights First, an organization tracking migrant-related issues, <a href="https://www.humanrightsfirst.org/sites/default/files/hrfordersfromabove.pdf" target="_blank" rel="noopener noreferrer">reported</a> earlier this month more than 340 public reports in Mexico of crimes committed against asylum seekers who were returned from the U.S.-Mexico border.</p>
<p>“The Trump Administration is delivering men, women, and children seeking refuge from Cuba, El Salvador, Honduras, Nicaragua, Venezuela, and other countries to some of the most dangerous areas of Mexico,” the group said in the report. “Instead of briefly passing through these dangerous regions to reach the U.S. border to request refugee protection, tens of thousands of asylum seekers are now stranded in peril for months.&#8221;</p>

										<content:encoded><![CDATA[<p class="speakable">The Trump administration on Monday issued a long-awaited rule strengthening the ability of federal officials to deny <a href="http://www.foxnews.com/category/us/immigration" target="_blank" rel="noopener noreferrer">green cards</a> to immigrants deemed likely to rely on government aid.</p>
<p class="speakable">Officials described the so-called &#8220;public charge&#8221; rule as a way to ensure those granted permanent residency are self-sufficient &#8212; and protect taxpayers in the process.</p>
<p>“The principle driving it is an old American value, and that’s self-sufficiency,” U.S. Citizenship and Immigration Services (USCIS) Acting Director Ken Cuccinelli told Fox News in an interview. “It’s a core principle &#8212; the American Dream itself &#8212; and it’s one of the things that distinguishes us, and it&#8217;s central to the legal history in the U.S. back into the 1800s.”</p>
<p>“It will also have the long-term benefit of protecting taxpayers by ensuring people who are immigrating to this country don’t become public burdens, that they can stand on their own two feet, as immigrants in years past have done,” he said. “It’s not only a recipe for their success but for America’s success growing out of our immigration system.”</p>
<p>The updated rule will better define, and expand, the factors that can be considered to deny an applicant on these grounds.</p>
<p>While the “public charge” inadmissibility standard has long been part of U.S. immigration law, the term has not been formally defined in the statute. The new rule, which will go into effect in October, will define “public charge” as an immigrant who receives one or more designated public benefits for more than 12 months within a 36-month period.</p>
<p>Those benefits include Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), as well as most forms of Medicaid and the Supplemental Nutrition Assistance Program (SNAP) &#8212; commonly known as food stamps. The rule expands the number of benefits that can be considered from interim guidance issued in 1999.</p>
<p>Those factors will be considered along with standard considerations such as age, health, financial assets, and education. While Cuccinelli&#8217;s USCIS is the lead agency, similar filters will be used at the State Department (for those applying for visas from abroad) and Border Patrol.</p>

<p>Cuccinelli told Fox News that the rule is not so much about limiting successful applications (noting that President Trump has sworn in more new citizens on an annual basis than former President Barack Obama) as it is about providing clarity to both USCIS staff in charge of enforcing the law, and also to immigrants about what benefits will factor in to a public charge determination.</p>
<p>“There’s no reason for anyone to be confused. It’s easy to answer the question: ‘Is X covered or isn’t it covered.’ That is a quick and easy answer to get via the USCIS website,” he said.</p>
<p>The rule updates guidance from 1999 issued by what was then the Immigration and Naturalization Service (INS), which stated that reliance on benefits such as SNAP and Medicaid would not be considered as part of a public charge evaluation.</p>

<p>“The difficulty we have had for the last 20 years under the 1999 guidance is that it was in anticipation of a rule that was never entered and it was fairly minimalist guidance and it has not been particularly useful in the work we do at USCIS,” he said, calling the new rule a “better and more thorough attempt.”</p>
<p>The rule is likely to cause significant backlash from Democrats and immigration rights groups, who have warned that it may spook migrants away from claiming the benefits they need, fearing it will lead to them being deemed inadmissible when requesting a green card.</p>
<p>There are already signs that the rule could significantly reshape who is being granted permanent residency. <a href="https://www.politico.com/story/2019/08/06/visa-denials-poor-mexicans-trump-1637094">Politico</a> reported last week that the State Department has been cracking down on potential public charges &#8212; with rejections on public charge grounds surging to 12,179 in fiscal 2019 from 1,033 in fiscal 2016.</p>
<p>It also demonstrates the extent to which the Trump administration is moving its immigration policies beyond simply tackling illegal immigration, instead of questioning the status quo of the legal immigration system as it has held since the 1965 Immigration and Nationality Act.</p>

<p>Cuccinelli, who was named acting director of the agency in June, said that the rule “is entirely in line with the president keeping his promises to make the immigration system work better for America.”</p>

<p>Winning asylum in the United States is far from a sure thing in ordinary times, but that’s especially true for Central American migrants today due to a surge in migration, recent policy changes and overloaded border-security agencies and immigration courts.</p>
<p>A <a class="content-link external" href="https://trac.syr.edu/immigration/reports/539/" target="_blank" rel="noopener noreferrer">Syracuse University report</a> based on 2018 asylum applications and immigration-court results shows that asylum-seekers from El Salvador, Honduras and Guatemala were granted asylum less often than the 35% acceptance rate for migrants overall.</p>
<p>For Salvadorans, the acceptance rate was 23.5%; for Hondurans, it was 21.2%; and for Guatemalans, it was 18.8%.</p>
<p>At the same time that it’s gotten harder to win asylum, more and more migrants have been seeking protection in the United States without legal assistance.</p>
<p>Migrants who are represented by an attorney are far more likely to win their cases than those who are not; 90% of asylum-seekers without an attorney were denied in 2017. Roughly half of those with attorneys were denied, researchers at Syracuse found.</p>
<p>The migrant population itself has also dramatically changed.</p>
<p>The U.S. Department of Homeland Security released a <a class="content-link external" href="https://www.dhs.gov/sites/default/files/publications/19_0416_hsac-emergency-interim-report.pdf" target="_blank" rel="noopener noreferrer">border-crisis report</a> in April raising the alarm about “the large-scale influx of (migrant families with children),” which the agency described as a new phenomenon compared to previous immigration waves.</p>
<p>Apprehensions of families with children represented just 1 percent of migrants in March 2017, the report says; today they make up nearly 60% of the total.</p>
<p>Some of those children, it says, are used as pawns by both criminal smuggling organizations and adult migrants to increase the odds of gaining entry into the United States.</p>
<p>More than 53,000 migrants with children in tow were apprehended by the Border Patrol in March of this year alone. DHS says that if numbers like this hold, apprehensions of families for this fiscal year could top half a million, a 600% increase over the previous fiscal year.</p>
<p>This new wave of migration from Central America has worsened to the point the Border Patrol isn’t fully able to function, the DHS report says. It has “overwhelmed the entire government and brought our border security and immigration management systems to the point of collapse.”</p>
<p>Among other proposals, DHS says it wants Congress to allocate funds for hiring more immigration judges and for setting up three or four regional processing centers along the border to accommodate the increased influx. It’s asking for new legislation to speed up the asylum process, so that hearings and final decisions happen in 20 or 30 days, compared to the current wait times of up to two years.</p>
<p>Complicating matters further is the Trump administration’s shifting guidance on border security and immigration.</p>
<p>By law, the U.S. cannot turn away immigrants seeking asylum, though it can deny claims if they don’t meet eligibility requirements. But in January, the administration started requiring asylum-seekers at the southern border to go back and wait in Mexico until their scheduled hearings.</p>
<p>A federal judge in April ordered the Trump administration to halt the so-called “Remain in Mexico” policy, then ran up against court challenges soon after, but the next month the 9th U.S. Circuit Court of Appeals allowed the program to continue while the legal challenge proceeds.</p>
<p>Then, in July, the Trump administration made the most dramatic shift yet, putting in new rules that say that migrants who pass through another country on their way to the U.S. will be ineligible for asylum. That would make it all but impossible for the thousands of migrants who pass through Mexico from Central America, Haiti, and other countries to win asylum. The rule, which is also being challenged in court, also applies to children who cross the border alone.</p>

<p>And what they reportedly aim to do in El Paso, Texas, is concerning, to say the least.</p>
<p>“Antifa is leading a ‘Border Resistance’ militancy training tour that will converge on a 10-day siege in El Paso, TX,” Quillette editor Andy Ngo tweeted Monday. “The promotional image shows border enforcement officers being killed &amp; government property fired bombed. Organizers asking for ‘white comrades’ to pay for others.”</p>

<p>One of the promotional images does indeed show a Border Patrol vehicle being set on fire, as well as a Molotov cocktail flying through the air.</p>
<p>Several people are wielding bows and arrows, and at least one Immigration and Customs Enforcement officer is on the ground after being hit with arrows.</p>
<p>The subtext is all too clear, particularly from a movement that has been linked to violence many times in the past. Ngo himself was brutally assaulted by Antifa protesters last month in Portland, Oregon, and a self-proclaimed Antifa activist showed up to a detention center in Washington state earlier in July with a rifle and improvised explosive devices.</p>
<p>After that activist was killed by police, Antifa&#8217;s Seattle faction posted a <a href="https://www.westernjournal.com/ct/antifa-urges-others-take-direct-action-martyr-taken-police-failed-firebomb-plan/" target="_blank" rel="noopener noreferrer">call to action</a> for others to follow in his footsteps, labeling its “comrade” a “martyr” and urging a call for “direct action.”</p>
<p>The Antifa event in El Paso, which will last Sept. 1-10, is officially called a “Border Resistance Convergence,” according to the event’s <a href="http://borderresistance.com/" target="_blank" rel="noopener noreferrer">website</a>.</p>
<p>“Local and national organizers are working together to build 10 days of training and direct actions for the Border Resistance Convergence in El Paso, TX — September 1-10th,” the site says.</p>
<p>“We are calling on affinity groups everywhere to come together and help us address the US-funded genocide and local concentration camps.”</p>
<p>Now, it’s not clear what those “training and direct actions” will entail. But considering Antifa&#8217;s history of violence, as well as the promotional image is seen in Ngo’s tweet, it can’t be anything good.</p>
<p>And true to form, Antifa is asking it’s white members to fund this event.</p>

<p>“There are two locations that can house around 20 people each for the time span of the convergence. There are also local organizers who will be opening their houses. These spaces will be used to host QTPOC folks that are traveling to El Paso,” the website says.</p>
<p>“We are very much relying on white comrades to donate money and throw down on renting temporary spaces for our more vulnerable friends as camping can affect us all in different ways.”</p>
<p>The above lines would be laughable if Antifa hadn’t proven time and again that it’s a dangerous and violent organization.</p>
<p>Remind me again why people like CNN’s Chris Cuomo are <a href="https://dailycaller.com/2019/04/30/cnns-chris-cuomo-antifa-good-cause/" target="_blank" rel="noopener noreferrer">defending</a> Antifa?</p>
