										<content:encoded><![CDATA[<p><span class="dateline"><strong>WASHINGTON</strong> &#8211; </span>The White House believes the United States is enduring a &#8220;gun violence public health epidemic,&#8221; so President Joe Biden is taking executive action to address it.</p>
<p>Biden spoke from the Rose Garden Thursday morning, announcing new gun control measures that target ghost guns, red flag laws, pistol-stabilizing braces, and other issues.</p>
<p>He said he wants Congress to do more than offer &#8220;thoughts and prayers&#8221; to the victims of gun violence.</p>
<p>&#8220;They’ve offered plenty of thoughts and prayers, members of Congress,&#8221; Biden said, &#8220;But they’ve passed not a single new federal law to reduce gun violence. Enough prayers, time for some action.&#8221;</p>
<p>Because substantial changes to gun laws have always met fierce Republican resistance in Congress, Biden said he asked Attorney General Merrick Garland to prioritize gun violence and help him with concrete actions the president could take without Congress.</p>

<p>Biden first spoke of regulating ghost guns, which are homemade firearms that often lack serial numbers authorities would use to trace them. They’ve increasingly turned up at crime scenes, and federal agents have found them in undercover purchases from gang members and other criminals.</p>
<p>There’s no federal requirement for ghost gun buyers to undergo a background check, but Biden’s actions would change that.</p>
<p>Biden said he’ll also tighten regulations on pistol-stabilizing braces. The president said the brace makes the pistol more lethal and &#8220;a hell of a lot more accurate.&#8221; He wants to designate pistols with the brace as short-barreled rifles, which would require owners to have a federal license.</p>
<p>The braces came under scrutiny last month after a gunman allegedly used a braced pistol to kill 10 people at a grocery store in Boulder, Colorado.</p>

<p>That shooting, along with shootings at three Atlanta-area spas that left eight dead plunged the U.S. back into a gun debate that has dominated American politics for years.</p>
<p>Part of Biden’s action asks Congress to pass an appropriate national red flag law that would allow family members or law enforcement to petition for a court order temporarily barring people in crisis from accessing firearms if they present a danger to themselves or others.</p>
<p>And he hopes Congress will incentivize states to pass similar laws. Biden praised the House for passing bills that would close loopholes in America’s gun legislation.</p>
<p>The gun show loophole allows buyers to purchase a gun from a gun show, where background checks aren’t required. The Charleston loophole allows guns to be purchased if the FBI hasn’t completed a background check within three business days. And the boyfriend loophole allows physically abusive ex-boyfriends and stalkers with previous convictions to maintain access to firearms.</p>
<p>Democrats control both chambers of Congress, but the slim Senate advantage likely wouldn’t be enough to pass the bills that would end the loopholes.</p>
<p>Republicans are expected to oppose many, if not all, of Biden’s measures. The party has positioned itself as defender of the Second Amendment and tried to paint the opposition as gun confiscators. Before he went into his plans, Biden dismissed the notion that his measures were a threat to the Second Amendment — calling it a &#8220;phony argument.&#8221;</p>
<p>While enhanced background checks are generally popular with the American public — even with some conservatives — Congress has so far not been able to find compromise on gun control as a whole, thus the president’s reliance on executive action.</p>
<p>&#8220;Universal background checks are supported by the vast majority of American people — and I might add the majority of responsible gun owners,&#8221; Biden said. &#8220;Let me be clear: This is not a partisan issue among the American people. This is a view by the American people as an American issue. And I’m willing to work with anyone to get these done.&#8221;</p>
<p>But of all the ideas Biden presented, the removal of gun manufacturers’ immunity to lawsuits sits closes to his heart, he said.</p>
<p>&#8220;If I get one thing on my list, the Lord came down and said ‘Joe, you get one of these,’ give me that one,&#8221; Biden said. &#8220;Because I tell you what: There would be a come to the Lord moment these folks would have real quickly.&#8221;</p>

<p>Thursday’s news conference also served as an introduction of David Chipman, Biden’s nominee to direct the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Chipman is a former federal agent and adviser to the gun-control group Giffords. He spent 25 years with ATF where he worked to stop a trafficking ring that sent illegal guns from Virginia to New York.</p>
<p>Gun-control advocates have long stressed how crucial the director of the ATF is in enforcing gun laws. John Feinblatt, president of Everytown for Gun Safety, lauded Chipman as an &#8220;invaluable point person&#8221; in the fight against illegal gun trafficking.</p>
<p>Feinblatt also applauded Biden for his upcoming gun control measures.</p>
<p>&#8220;Each of these executive actions will start to address the epidemic of gun violence that has raged throughout the pandemic, and begin to make good on President Biden’s promise to be the strongest gun safety president in history,&#8221; Feinblatt said.</p>

<p class="speakable">At least 217 people have been charged with a federal crime, and more than 1,000 arrests have been made in major metropolitan cities since the <a href="https://www.foxnews.com/category/politics/justice-department" target="_blank" rel="noopener noreferrer">Department of Justice</a> launched <a href="https://www.foxnews.com/politics/trump-operation-legend-expand" target="_blank" rel="noopener noreferrer">Operation Legend</a> in July, U.S. Attorney General <a href="https://www.foxnews.com/category/person/william-barr" target="_blank" rel="noopener noreferrer">William Barr</a> announced on Wednesday.</p>
<p class="speakable">Nearly 400 firearms have been seized by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.</p>
<p>Barr launched Operation Legend on July 8 as “a sustained, systematic and coordinated law enforcement initiative in which federal law enforcement agencies work in conjunction with state and local law enforcement officials to fight violent crime,” the DOJ said in <a href="https://www.justice.gov/opa/pr/attorney-general-william-p-barr-announces-updates-operation-legend-press-conference-kansas" target="_blank" rel="noopener noreferrer">a release</a>.</p>
<p><strong><a href="https://www.foxnews.com/us/murder-charge-legend-taliferro-operation-legend" target="_blank" rel="noopener noreferrer">MURDER CHARGE ANNOUNCED IN KILLING OF LEGEND TALIFERRO, 4, WHOSE DEATH SPARKED OPERATION LEGEND</a></strong></p>
<p>It was named in honor of 4-year-old LeGend Taliferro, who was shot and killed while he slept in the early morning of June 29 in Kansas City, Mo. Last week, a Jackson County prosecutor <a href="https://www.foxnews.com/us/murder-charge-legend-taliferro-operation-legend" target="_blank" rel="noopener noreferrer">announced second-degree murder charges against his suspected killer</a>, 22-year-old Ryson Ellis, who was being held in Tulsa County Jail.</p>

<p>“LeGend is a symbol of the many hundreds of innocent lives that have been taken in the recent upsurge of crime in many of our urban areas,” Barr said at a press conference in Kansas City. “His life mattered and the lives of all of those victims matter. His name should be remembered and his senseless death, like those of all the other innocent victims in this recent surge, should be unacceptable to all Americans.”</p>
<p>Barr said the federal government has dispatched to nine U.S. cities more than 1,000 additional agents from the FBI, ATF, Drug Enforcement Administration, and U.S. Marshals Service to work shoulder to shoulder with state and local partners on homicide and assault squads to crack cases.</p>
<p>The government has also allocated $78.5 million in grants to support additional police positions, hire more prosecutors, and improve technology to solve firearms crimes.</p>
<p>“We saw one result of those efforts last week when Kansas City Police arrested the suspected murderer of LeGend,&#8221; Barr said. &#8220;This arrest will not bring LeGend back but it will make his case an example of how we can come together to take violent criminals off the street and to make our communities safer.&#8221;</p>
<p>The spike in violent crime, according to Barr, may have a lot of reasons, including the “pent up aggression prompted by state and local quarantine orders,” the premature release of dangerous criminals by the courts and prosecutors, and the efforts “to demonize police and defund their work.”</p>
<p>“Operation Legend is the heart of the federal government’s response to this upturn in violent crime. Its mission is to save lives, solve crimes and take violent offenders off the streets before they can claim more victims,” Barr said. “Rather than demonizing and defunding our police, we are supporting and strengthening our law enforcement partners at the state and local level.</p>
<p>First launched in Kansas City, Operation Legend expanded to Chicago and Albuquerque on July 22, to Cleveland, Detroit, and Milwaukee on July 29, to St. Louis and Memphis on Aug. 6, and to Indianapolis on Aug. 14.</p>
<p>The latest figures on charges and arrests do not include Indianapolis, whose operation was first announced last Friday. The arrests of more than 1,000 people include those charged in state and local courts.</p>
<p>In Kansas City, a total of 43 defendants have been charged with federal crimes. Sixty-one have been charged with federal charges in Chicago, 16 in Albuquerque, 32 in Cleveland, 22 in Detroit, 11 in Milwaukee, 25 in St. Louis, and 7 in Memphis, Tenn.</p>

<p>The charges include illegal possession of a firearm, possession with intent to distribute controlled substances or narcotics, drug trafficking, theft, carjacking, bank robbery, illegal re-entry of an alien in connection with a widespread drug conspiracy, and making false statements to licensed firearm dealers.</p>

<p class="speakable">The <a href="https://www.foxnews.com/category/us/personal-freedoms/second-amendment" target="_blank" rel="noopener noreferrer">National Rifle Association</a> is fighting back against a lawsuit filed Thursday by <a href="https://www.foxnews.com/category/us/us-regions/northeast/new-york">New York</a>’s attorney general by submitting its own civil suit against the state official, accusing her of defamation and violating its rights to free speech.</p>
<p class="speakable">The NRA’s lawsuit was filed in the federal court of New York and alleges Attorney General Letitia James “made the political prosecution of the NRA a central campaign theme” when she was running for the AG’s office in 2018 and has not treated the association fairly since.</p>
<p>“Despite hopes that playing by the rules would procure a just outcome, the NRA has not been treated fairly by James’s office,” the 19-page suit states. “The New York Democratic Party political machine seeks to harass, defund, and dismantle the NRA because of what it believes and what it says.”</p>
<p>The defamation allegations stem from James&#8217; public descriptions of the NRA as a &#8220;criminal enterprise&#8221; and &#8220;a terrorist organization.&#8221;</p>
<p>“James boasted that she would strike foul blows against the NRA and pound the NRA into submission. She vowed that she would use the NYAG’s investigative and enforcement powers for the precise purpose of stanching political speech (‘deadly propaganda),” the lawsuit states. “She has begun to deliver on her campaign promises to retaliate against the NRA for constitutionally protected speech on issues that James opposes. As NYAG, James has regrettably succumbed to ‘individual passions, and individual malevolence.’”</p>

<p>James sued the NRA, which is headquartered in Fairfax, Va., in an effort to dissolve the gun-rights group “for years of self-dealing and illegal conduct,” she <a href="https://ag.ny.gov/press-release/2020/attorney-general-james-files-lawsuit-dissolve-nra">announced</a> Thursday.</p>
<p>The lawsuit, filed Thursday in the Supreme Court of the State of New York, alleges that the NRA “diverted millions of dollars away from its charitable mission for personal use by senior leadership.” She further slammed the association for what she called “years of self-dealing and illegal conduct that violate New York’s charities laws and undermine its own mission.”</p>

<p>James&#8217; office teased what it said would be a “major announcement” in an email sent out Tuesday night.</p>

<p>James said the actions of the accused quartet “contributed to the loss of more than $64 million in just three years for the NRA.”</p>
<p>While the lawsuit accuses all four men of wrongdoing and seeks fines and remuneration, none of them have been charged with a crime.</p>
<p>In turn, NRA President Carolyn Meadows responded by calling the lawsuit a “baseless, premeditated attack” on the group and the Second Amendment.</p>
<p>“You could have set your watch by it: the investigation was going to reach its crescendo as we move into the 2020 election cycle,” Meadows said. “It’s a transparent attempt to score political points and attack the leading voice in opposition to the leftist agenda.”</p>
<p>She further called the suit “a desperate move that is part of a rank political vendetta.”</p>
<p>“This has been a power grab by a political opportunist,” she said. “Our members won’t be intimidated or bullied in their defense of political and constitutional freedom … we not only will not shrink from this fight – we will confront it and prevail.” ​</p>

<p>Also on Thursday, Washington D.C. District Attorney Karl Racine announced his office was suing the NRA Foundation for “misusing charitable funds.” He has been investigating the NRA Foundation for more than a year.</p>
<p>“Donors gave money to fund firearms safety, firearms education and marksmanship training,” Racine alleged. “Instead, that money was diverted to support wasteful spending by the NRA and its executives.”</p>
<p>In a statement provided to Fox News, a spokesperson for the National Shooting Sports Foundation, a guns-trade group, said the association was &#8220;troubled&#8221; by James&#8217; decision, which he called &#8220;politically-driven.&#8221;</p>
<p>In the lawsuit, spokesperson Mark Oliva said, &#8220;James seeks to punish the over five million members of the National Rifle Association based on mere allegations of possible wrongdoing by a few individuals.&#8221;</p>
