										<content:encoded><![CDATA[<p>A federal judge declined on Wednesday to block Democratic New Mexico Gov. Michelle Lujan Grisham’s ban on firearms at parks and playgrounds.</p>
<p>U.S. District Judge for the District of New Mexico David Urias, a Biden appointee, declined to block Lujan Grisham’s emergency public health order banning firearms from being <a href="https://dailycaller.com/2023/09/15/new-mexico-gov-partially-reverses-gun-ban-narrows-scope-to-parks-and-playgrounds/">carried</a> in public parks and playgrounds from taking effect, <a href="https://storage.courtlistener.com/recap/gov.uscourts.nmd.492600/gov.uscourts.nmd.492600.27.0.pdf" target="_blank" rel="noopener noreferrer">according</a> to the court document. Urias temporarily <a href="https://dailycaller.com/2023/09/13/federal-judge-temporarily-blocks-new-mexico-governors-gun-ban/">blocked</a> Lujan Grisham’s initial 30-day <a href="https://dailycaller.com/2023/09/10/new-mexicans-most-american-thing-defy-second-amendment-ban-open-carry/">order</a> banning all firearms from being carried in Albuquerque and Bernalillo County on Sept. 13, prompting her to issue the amended order two days later restricting guns only in specified areas.</p>
<p>Urias found that gun owners and advocacy groups who challenged the amended order were unlikely to succeed on their Second Amendment challenge, writing that playgrounds and parks can be considered “sensitive places” where restrictions are permissible under Supreme Court precedent, according to the court document.</p>

Michelle Lujan Grisham on Friday <a class="link " href="https://www.governor.state.nm.us/2023/09/08/governor-announces-statewide-enforcement-plan-for-gun-violence-fentanyl-reduction-plan-includes-30-day-suspension-of-concealed-open-carry-in-albuquerque-and-bernalillo-county/" target="_blank" rel="nofollow noopener" data-ylk="slk:issued;elm:context_link;itc:0" data-rapid_p="10" data-v9y="1">issued</a> a &#8220;public health emergency order&#8221; that purportedly suspends the right to bear arms in Albuquerque and surrounding Bernalillo County. The order, which lasts for 30 days but can be renewed, applies to concealed or open carry of firearms on public property, with exceptions for police officers and security guards. Grisham said &#8220;citizens with permits to carry firearms are free to possess their weapons on private property (such as at a gun range or gun store), provided they transport the firearm in a locked box, use a trigger lock, or [use] some other mechanism that renders the gun incapable of being fired.&#8221;</p>
<p>The <a class="link " href="https://www.governor.state.nm.us/wp-content/uploads/2023/09/090823-PHO-guns-and-drug-abuse.pdf" target="_blank" rel="nofollow noopener" data-ylk="slk:order;elm:context_link;itc:0" data-rapid_p="11" data-v9y="1">order</a> covers &#8220;cities or counties averaging 1,000 or more violent crimes per 100,000 residents per year since 2021,&#8221; a criterion currently met only by Bernalillo County. Grisham, a Democrat, says the carry ban is a necessary response to &#8220;recent shooting deaths of a thirteen-year-old girl on July 28, a five-year-old girl on August 14, and an eleven-year-old boy on September 6, as well as two mass shootings this year.&#8221; At a <a class="link " href="https://www.youtube.com/watch?v=S9oLOubipXc" target="_blank" rel="nofollow noopener" data-ylk="slk:press conference;elm:context_link;itc:0" data-rapid_p="12" data-v9y="1">press conference</a> on Friday, she conceded that the order was apt to be challenged in court as a violation of the Second Amendment but added, &#8220;I welcome the debate and the fight about making New Mexicans safer.&#8221;</p>

										<content:encoded><![CDATA[<p class="Component-root-0-2-360 p Component-p-0-2-350">WASHINGTON (AP) — New York can for now continue to enforce <a class="paragraph-link" href="https://apnews.com/article/us-supreme-court-travel-manhattan-gun-politics-legislature-507daf2e3b85e72af606b4f44ef2ceab">a sweeping new law</a> that bans guns from “sensitive places” such as schools, playgrounds and Times Square, <a class="paragraph-link" href="https://apnews.com/hub/us-supreme-court">the Supreme Court</a> said Wednesday, allowing the law to be in force while a lawsuit over it plays out.</p>
<p class="Component-root-0-2-360 p Component-p-0-2-350">The justices turned away an emergency request by New York gun owners challenging the law. The gun owners wanted the high court to lift a federal appeals court order that had permitted the law to be in effect.</p>
<p class="Component-root-0-2-360 p Component-p-0-2-350">The appeals court hasn’t finished its review of the case, and justices are often reluctant to weigh in under those circumstances. The justices could still consider the case and the law more generally in the future.</p>
