<p class="article-category"><strong>ANALYSIS/OPINION:</strong></p>
<p>After pushing through a quick, partisan impeachment, House Speaker <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Nancy Pelosi</a> made a grievous strategic miscalculation.</p>
<p>The California Democrat decided not to forward the two articles of impeachment to the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a>, believing she could pressure the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> to require witnesses as part of the trial.</p>
<p>Let’s set aside the absurd demands for fairness that House Democrats are making. Their partisan House process was unprecedented and earned bipartisan opposition as the White House was denied due process and leaks and secret hearings were regularly utilized. Democratic requests for fairness now are laughable.</p>
<p>Beyond the fairness issue, there are several problems with Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a>’s approach now that the House has acted.</p>
<p>First, the Republican-led <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> doesn’t want to take up the impeachment and would be delighted if Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a> pocket-vetoed her own measure indefinitely. That floor time can be used to confirm 15-20 more federal judges with lifetime appointments.</p>
<p>Second, the House has no leverage in the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> as Majority Leader Mitch McConnell answers not to Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a> but to the 53 Republican senators who make up his conference. This is not like a conference committee where two bills must be reconciled. The <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> did not try to manipulate the House impeachment inquiry — attempting to do so would have been pointless.</p>
<p>Third, decisions on witnesses are not entirely up to him. He can negotiate a bipartisan agreement with <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> Minority Leader Chuck Schumer, but ultimately the trial process and agreements on witnesses are subject to a 51-vote threshold.</p>
<p>Fourth, Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a>’s position is entirely incoherent. She apparently believes impeachment was necessary and urgent because the president is such a threat to democracy and national security, but that impeachment can wait until the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a>’s trial procedures meet her approval. She can’t have it both ways.</p>
<p>Fifth, a demand for specific witnesses undermines the strength of her own case. Why did Democrats pass the two articles if the case she presented in the House requires these fresh witnesses? Democrats have repeatedly said they had a strong case, so why do they need more witnesses at trial? These witnesses could have been available to the House had they been willing to battle the executive privilege claim in the courts. But time was of the essence for House Democrats and they did not want to wait.</p>
<p>Sixth and finally, the calendar is a matter of concern for <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> Democrats. Even a short trial held in January would be profoundly inconvenient for the four sitting senators running for president, with the Iowa caucuses to be held Feb. 3. In a trial, senators are required to be sitting quietly at their desks for hours at a time for several weeks. Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a>’s pointless delay increases the odds that the trial will be held at the most inconvenient time possible.</p>
<p>Mr. McConnell is not rejecting witnesses without consideration. He is suggesting that the process used in the trial of President Bill Clinton be used here as well. Both sides present their case, and then a majority vote is held on witnesses.</p>
<p>Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a> may understand the House, but this unforced error has proven that she does not understand the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a>.</p>
<p>She faces two bad options in the new year. She can fold and gain no concessions from Mr. McConnell or she can effectively prevent the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a> from ever holding a trial. In the latter case, Mr. McConnell may well hold an acquittal vote in the <a href="https://www.washingtontimes.com/topics/senate/">Senate</a>, which would require 51 votes.</p>
<p>Mrs. <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a> has a weak hand and decided to bluff. Mr. McConnell then called the bluff. In early January, the cards will be turned over and the pot will be awarded.</p>
<p>This was all entirely foreseeable. How did the “brilliant tactician” <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Pelosi</a> so badly misjudge this situation?</p>

<p>Although four White House officials have blown off congressional subpoenas to testify before the House of Representatives’ impeachment inquiry, House Democrats reportedly aren’t sweating it.</p>
<p><a href="https://www.politico.com/news/2019/11/04/white-house-officials-testify-impeachment-065318" target="_blank" rel="noopener noreferrer"><em>Politico</em> reports</a> that House investigators believe they have already compiled enough damning evidence against the president to make a strong case for his impeachment and removal, and thus aren’t concerned about officials who are defying their subpoenas.</p>
<p>The one remaining witness whom Democrats would most like to see testify is White House attorney John Eisenberg, who allegedly ordered that the readout of President Donald Trump’s phone call with Ukrainian President Volodymyr Zelensky be placed into a top-secret server after Lt. Col. Alexander Vindman raised alarms about the president asking a foreign country to investigate his domestic political opponents.</p>
<p>House Democrats are planning to start holding public impeachment hearings as early as next week and have already lined up several potential star witnesses. In addition to Vindman, Democrats are expected to hold public testimony for ambassador Bill Taylor, former U.S. ambassador to Ukraine Marie Yovanovitch, National Security Council official Tim Morrison, and former National Security Council official Fiona Hill.</p>

										<content:encoded><![CDATA[<p>The White House, the Pentagon, and <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/donald-trump" data-nid="261287">President Trump</a></span>&#8216;s personal attorney <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/rudy-giuliani" data-nid="444404">Rudy Giuliani</a></span> on Tuesday all refused to comply with House Democrats’ impeachment inquiry subpoenas, escalating the fight between the administration and Democratic lawmakers.</p>
<p>Democrats set a Tuesday deadline for Defense Secretary <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/mark-esper" data-nid="454465">Mark Esper</a></span>, Giuliani and the White House Office of Management and Budget (OMB) to turn over documents related to Ukraine.</p>
<p>Three House committees also requested Vice President Pence hand over documents by Tuesday, though no subpoena had been issued.</p>
<p>The refusals from top administration officials were unsurprising after the White House counsel&#8217;s office sent a letter to top Democrats last week making clear that the administration would refuse to cooperate with the impeachment inquiry.</p>
<p>Matthew Morgan, counsel to the vice president, wrote in a letter to the three committee chairmen that Pence would not comply with their request, citing the lack of a vote establishing formal procedures for the impeachment inquiry and questioning the fairness of the process.</p>
<p>A letter from Giuliani&#8217;s lawyer to the House Intelligence Committee dismissed the subpoena, saying it is &#8220;overbroad, unduly burdensome, and seeks documents beyond the scope of legitimate inquiry.&#8221;</p>
<p>The Pentagon said in a letter to the three committee leaders that it has taken steps to identify and preserve potentially relevant documents, but that the subpoena “raises a number of legal and practical concerns&#8221; and the department would not comply “at this time.”</p>
<p>A senior administration official said that OMB and acting Director Russ Vought &#8220;are not participating in the sham impeachment process.&#8221;</p>
<p>House Democrats could move to hold those defying the subpoenas in contempt, though it is unlikely the Justice Department would prosecute them.</p>
<p>Democrats are <a href="https://thehill.com/homenews/house/465960-pelosi-no-house-vote-on-impeachment-inquiry" target="_blank" rel="noopener noreferrer">leading an impeachment inquiry</a> into whether Trump abused his office when he urged Ukraine to look into Democratic presidential candidate and former Vice President <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/joe-biden" data-nid="188332">Joe Biden</a></span> during a July 25 phone call with the Ukrainian president.</p>
<p>As part of the investigation, the Oversight and Reform, Intelligence and Foreign Affairs committees are seeking documents and communications among administration officials related to the call, as well as documents pertaining to the administration&#8217;s handling of military aid for Ukraine.</p>
<p>White House counsel Pat Cipollone <a href="https://thehill.com/homenews/administration/464911-white-house-tells-pelosi-committee-chairs-it-wont-cooperate-with" target="_blank" rel="noopener noreferrer">wrote in a letter</a> to Speaker <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/nancy-pelosi" data-nid="187954">Nancy Pelosi</a></span> (D-Calif.) last week that the administration would refuse to cooperate with requests for documents and communications, decrying the impeachment inquiry as an &#8220;invalid&#8221; effort to &#8220;overturn the results of the 2016 election.&#8221;</p>
<p>Cipollone argued in his letter that the House had yet to hold a vote on the impeachment inquiry and therefore the White House did not have to comply with their requests.</p>
<p>It&#8217;s unclear whether such a vote would change the White House&#8217;s stance. Trump has said he would cooperate if the established rules for the investigation were &#8220;fair.&#8221;</p>
<p>Democrats have also issued subpoenas to Energy Secretary <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/james-rick-perry" data-nid="345417">Rick Perry</a></span> and indicted Giuliani associates Lev Parnas and Igor Fruman as part of their investigation.</p>
<p>In recent days, a host of current and former administration officials have testified privately to the House committees leading the impeachment inquiry, alleging that Giuliani and others were conducting a shadow influence campaign in Ukraine that undermined official channels.</p>

House Speaker Nancy Pelosi announced a <a href="https://www.cbsnews.com/live-news/trump-impeachment-pelosi-launches-formal-impeachment-inquiry-of-president-donald-trump-wednesday/" target="_blank" rel="noopener noreferrer" data-invalid-url-rewritten-http="">formal impeachment inquiry</a> of Mr. Trump in September soon after he admitted he had asked the Ukrainian president to investigate former Vice President Joe Biden and his son. Pelosi said the president&#8217;s actions represent a betrayal of his oath of office, of national security and of the integrity of U.S. elections.</p>
<p>In late July, the House Judiciary Committee said in a court filing that it was <span class="link"><a href="https://www.cbsnews.com/news/house-judiciary-committee-is-considering-articles-of-impeachment-against-trump-court-filing-says/" data-invalid-url-rewritten-http="">actively considering articles of impeachment</a></span> related to the special counsel&#8217;s report, which pointed to ten times Mr. Trump might have obstructed justice during the Russia investigation. The committee has been fighting for access to material redacted from the <span class="link"><a href="https://www.cbsnews.com/news/mueller-report-released-read-and-download-redacted-report-by-special-counsel-released-by-justice-department/" data-invalid-url-rewritten-http="">special counsel&#8217;s report</a></span> in order to decide whether to move forward with the process.</p>
<p>Although initially, just a handful of Democrats had called for Mr. Trump&#8217;s impeachment, a growing number of lawmakers began to consider opening an impeachment inquiry against the president in light of <span class="link"><a href="https://www.cbsnews.com/live-news/mueller-testimony-hearing-watch-live-stream-special-counsel-report-hearing-congress-2019-07-24/" data-invalid-url-rewritten-http="">special counsel Robert Mueller&#8217;s report</a></span> on Russian interference in the <a href="https://cbsnews.com/election-2016/" target="_blank" rel="nofollow noopener noreferrer">2016 election</a>.</p>

<p>While that investigation found that the Trump campaign did not conspire with Russia to influence the election, neither did it exonerate the president of obstruction of justice. Mueller identified 11 instances of possible obstruction, but he made no determination on whether the president had obstructed justice, having concluded that doing so would not be in keeping with a legal opinion held by the Justice Department on the treatment of a sitting president.</p>
<p>Attorney General William Barr determined the president did not commit obstruction of justice.</p>

<p class="speakable">&#8220;There&#8217;s no requirement that we have a vote, and so at this time we will not be having a vote,&#8221; Pelosi said. &#8220;We&#8217;re not here to call bluffs &#8212; we&#8217;re here to find the truth, to uphold the Constitution of the United States. This is not a game for us. This is deadly serious.&#8221;</p>
<p>The move was seemingly a boon for moderate Democrats in swing districts, who have been reluctant to have a formal vote in favor of the proceedings as the 2020 elections approach &#8212; even as several of them have also sought to appease liberal constituents by vocally backing the ongoing inquiry.</p>
<p>A congressional aide familiar with House Democrats&#8217; discussions told Fox News that many House Democrats did not want to be seen as letting the White House dictate how the House conducted itself. Last week, the White House <a href="https://www.foxnews.com/politics/impeachment-inquiry-white-house-not-comply-pelosi" target="_blank" rel="noopener noreferrer">sent a fiery letter</a> to House Democrats announcing that it would not cooperate with their inquiry, for several reasons &#8212; including that, contrary to past precedent, no formal vote had been held on whether to begin impeachment proceedings.</p>
<p>Pelosi ripped those arguments: &#8220;They have no substance. They can&#8217;t defend the president, so they&#8217;re going to process,&#8221; she said.</p>
<p>In a head-turning moment, Pelosi told reporters, &#8220;All roads seem to lead to Putin with the president&#8221; &#8212; even though Democrats began their probe because of the president&#8217;s actions concerning Ukraine, not Russia.</p>
<p><a href="https://www.foxnews.com/politics/giuliani-says-he-wont-comply-with-congressional-subpoena" target="_blank" rel="noopener noreferrer"><strong>GIULIANI WON&#8217;T COMPLY WITH DEMS&#8217; SUBPOENA IN IMPEACHMENT INQUIRY</strong></a></p>
<p>Pelosi last month unilaterally held a <a href="https://www.foxnews.com/politics/pelosi-expected-to-announce-formal-impeachment-inquiry-against-trump-at-5-pm-et" target="_blank" rel="noopener noreferrer">news conference </a>announcing that impeachment proceedings were in progress. House rules do not require a vote to begin an impeachment inquiry, but it remains unclear whether the courts will agree that an impeachment inquiry has begun without such a vote. If courts do not find that a formal inquiry is in progress, they could curtail Democrats&#8217; evidence-gathering efforts.</p>
<p>However, the House speaker heralded a series of recent court victories by Democrats, including a key win in the D.C. Circuit Court of Appeals that reaffirmed congressional authority to subpoena several years of Trump&#8217;s financial records from his accounting firm, Mazars.</p>
<p>&#8220;The rulings that we won last week &#8212; three of them were against the president&#8217;s hateful public charge rule from taking effect,&#8221; Pelosi said, referring to the administration&#8217;s immigration policy. &#8220;A ruling against the president&#8217;s sham national emergency declaration to build his wasteful border wall. A ruling in the Mazars case led by [House Oversight Committee] Chairman [Elijah] Cummings. &#8230; so again, five victories on Friday, one today, in terms of Emoluments.&#8221;</p>
<p>Separately at the press conference on Tuesday, House Intelligence Committee Chairman Adam Schiff, D-Calif., accused the White House of &#8220;stonewalling&#8221; despite those rulings.</p>
<p>&#8220;Were it not for the fact that at least some witnesses have given us documents, we would not know there is a paper record of efforts to condition this meeting, and perhaps condition military support itself, on these political investigations Donald Trump wanted,&#8221; Schiff said, referring to Trump&#8217;s fateful July call with Ukraine&#8217;s leader. &#8220;Those documents would have been completely bottled up by the State Department. &#8230; The evidence of obstruction of Congress continues to mount.&#8221;</p>
<p>Schiff said the Office of Management and Budget has refused to provide evidence concerning whether the Trump administration withheld aid to Ukraine, contingent on the country conducting an investigation of Joe and Hunter Biden&#8217;s business dealings there.</p>
<p>&#8220;The Constitution is clear. &#8230; the House will have the sole power of impeachment,&#8221; Schiff said later, when asked why there would be no floor vote on an impeachment inquiry.</p>

<p>The White House has strongly suggested it will take the fight over the Democrats&#8217; subpoenas to the Supreme Court.</p>
<p>&#8220;In the history of our nation, the House of Representatives has never attempted to launch an impeachment inquiry against the president without a majority of the House taking political accountability for that decision by voting to authorize such a dramatic constitutional step,&#8221; the White House letter to Pelosi and other top Democratic leaders stated.</p>

<p>It continued: &#8220;Without waiting to see what was actually said on the call, a press conference was held announcing an &#8216;impeachment inquiry&#8217; based on falsehoods and misinformation about the call.&#8221;</p>
<p>Despite Pelosi&#8217;s claim that there was no “House precedent that the whole House vote before proceeding with an impeachment inquiry,” several previous impeachment inquiries have been launched only by a full vote of the House &#8212; including the impeachment proceedings concerning former Presidents Andrew Johnson, Richard Nixon and Bill Clinton.</p>
<p>White House officials told Fox News the vote opening the proceedings was a small ask, considering the implications of potentially overturning a national election.</p>
<p>Responding to the letter, Pelosi <a href="https://www.speaker.gov/newsroom/10819-0" target="_blank" rel="noopener noreferrer">accused Trump</a> of &#8220;trying to make lawlessness a virtue&#8221; and added, &#8220;The American people have already heard the President’s own words – ‘do us a favor, though.’&#8221; (That line, from a <a href="http://responding%20to%20the%20letter%2C%20pelosi%20accused%20trump%20of%20%22trying%20to%20make%20lawlessness%20a%20virtue%22%20and%20added%2C%20%22the%20american%20people%20have%20already%20heard%20the%20president%E2%80%99s%20own%20words%20%E2%80%93%20%E2%80%98do%20us%20a%20favor%2C%20though.%E2%80%99%22%20%28that%20line%2C%20from%20a%20transcript%20of%20trump%27s%20call%20with%20ukraine%27s%20leader%2C%20in%20reality%20referred%20to%20trump%27s%20request%20for%20ukraine%20to%20assist%20in%20an%20investigation%20into%20foreign%20election%20interference%2C%20and%20did%20not%20relate%20to%20biden.%29%20%20pelosi%20continued:%20%22This%20letter%20is%20manifestly%20wrong,%20and%20is%20simply%20another%20unlawful%20attempt%20to%20hide%20the%20facts%20of%20the%20Trump%20Administration%E2%80%99s%20brazen%20efforts%20to%20pressure%20foreign%20powers%20to%20intervene%20in%20the%202020%20elections.%20...%20The%20White%20House%20should%20be%20warned%20that%20continued%20efforts%20to%20hide%20the%20truth%20of%20the%20President%E2%80%99s%20abuse%20of%20power%20from%20the%20American%20people%20will%20be%20regarded%20as%20further%20evidence%20of%20obstruction.%20Mr.%20President,%20you%20are%20not%20above%20the%20law.%C2%A0%C2%A0You%20will%20be%20held%20accountable.%E2%80%9D/" target="_blank" rel="noopener noreferrer">transcript of Trump&#8217;s call with Ukraine&#8217;s leader</a>, in reality referred to Trump&#8217;s request for Ukraine to assist in an investigation into 2016 election interference, and <a href="https://www.foxnews.com/politics/trumps-ukraine-call-transcript-read-the-document" target="_blank" rel="noopener noreferrer">did not relate to Biden.)</a></p>
<p>Pelosi <a href="https://www.speaker.gov/newsroom/10819-0" target="_blank" rel="noopener noreferrer">continued</a>: &#8220;This letter is manifestly wrong, and is simply another unlawful attempt to hide the facts of the Trump Administration’s brazen efforts to pressure foreign powers to intervene in the 2020 elections. &#8230; The White House should be warned that continued efforts to hide the truth of the President’s abuse of power from the American people will be regarded as further evidence of obstruction. Mr. President, you are not above the law.  You will be held accountable.”</p>
<p>Just before Pelosi took the microphone on Tuesday, a spokesperson for House Minority Leader Kevin McCarthy&#8217;s office emphasized some of the White House&#8217;s other objections to Democrats&#8217; inquiry.</p>

<p>Separately, the letter asserted multiple alleged violations of the president&#8217;s due-process rights. It noted that under current impeachment inquiry proceedings, Democrats were not allowing presidential or State Department counsel to be present.</p>
<p>Among the GOP&#8217;s complaints are that Democrats&#8217; procedures did not provide for the &#8220;disclosure of all evidence favorable to the president and all evidence bearing on the credibility of witnesses called to testify in the inquiry,&#8221; according to the White House. And &#8220;the right to see all evidence, to present evidence, to call witnesses, to have counsel present at all hearings, to cross-examine all witnesses, to make objections relating to the examination of witnesses or the admissibility of testimony and evidence, and to respond to evidence and testimony&#8221; has also been obstructed.</p>
<p>The White House asserted that Democrats also have not permitted Republicans in the minority to issue subpoenas, contradicting the &#8220;standard, bipartisan practice in all recent resolutions authorizing presidential impeachment inquiries.&#8221;</p>

<p class="zn-body__paragraph speakable"><cite class="el-editorial-source">Washington (CNN) </cite>A federal judge on Wednesday rejected House Democrats&#8217; effort to put <a href="https://www.cnn.com/2019/07/26/politics/nadler-democrats-grand-jury/index.html" target="_blank" rel="noopener noreferrer">two key legal cases</a> the Judiciary Committee is pursuing in its impeachment investigation before the same judge.</p>
</div>
<div class="zn-body__paragraph speakable">The decision from DC District Court Chief Judge Beryl Howell is a procedural setback for the House Judiciary Committee in its effort to use the courts to obtain information while the panel considers whether to bring forward <a href="https://www.cnn.com/2019/05/23/politics/democrats-impeachment-whip-list/index.html" target="_blank" rel="noopener noreferrer">articles of impeachment against President Donald Trump</a>.</p>
</div>
<div class="zn-body__paragraph speakable">Howell sided with the Justice Department and former White House counsel Don McGahn in a Wednesday ruling that the Judiciary Committee&#8217;s lawsuit to enforce its subpoena of McGahn should not be connected to its petition to obtain former special counsel Robert Mueller&#8217;s grand jury materials.</p>
</div>
<div class="zn-body__paragraph">The House had argued that <a href="https://www.cnn.com/2019/07/26/politics/nadler-democrats-grand-jury/index.html" target="_blank" rel="noopener noreferrer">its grand jury petition</a> filed in July and <a href="https://www.cnn.com/2019/08/07/politics/don-mcgahn-lawsuit-impeachment/index.html" target="_blank" rel="noopener noreferrer">its McGahn lawsuit</a> are connected because they involved &#8220;common issues of fact&#8221; and were both part of the committee&#8217;s investigation to determine whether to impeach the President.</p>
<div class="zn-body__paragraph">But the Justice Department responded in a court filing on Tuesday that the cases should not be linked, accusing the House panel of &#8220;attempting to game the system by shopping for a judge they perceive as more favorable to their cause.&#8221;</p>

<div class="zn-body__paragraph">The bureaucratic skirmish over which judge would hear the lawsuit underscores the stakes of the case, which has the potential to set precedent for legislative branch subpoenas of executive branch officials and could have long-reaching implications.</p>
</div>
<div class="zn-body__paragraph">Howell wrote in an 11-page ruling that the committee&#8217;s view the two cases were related was &#8220;at first blush&#8230;understandable.&#8221;</p>
</div>
<div class="zn-body__paragraph">But Howell concluded, &#8220;Closer examination demonstrates that these connections between the two cases are too superficial,&#8221; noting that the committee is trying to compel McGahn to testify publicly while it would take steps to protect secret grand jury material from being released.</p>
</div>
<div class="zn-body__paragraph">Howell, who oversaw the grand jury proceedings in the Mueller investigation and is known for siding with public transparency, will hear House&#8217;s the grand jury case. But her decision Wednesday prompted the McGahn case to be randomly assigned to Judge Ketanji Brown Jackson, who was appointed by President Barack Obama.</p>

<div class="zn-body__paragraph">Jackson has ruled against the Trump administration in prior cases last year, including <a href="https://www.cnn.com/2018/06/02/politics/hhs-teen-pregnancy-program-dc-district-court/index.html" target="_blank" rel="noopener noreferrer">ruling against</a> the Department of Health and Human Services in June 2018 and <a href="https://www.cnn.com/2018/08/25/politics/donald-trump-executive-orders-unions/index.html" target="_blank" rel="noopener noreferrer">striking down executive orders</a> related to federal workers and unions last August.</p>
</div>
<div class="zn-body__paragraph">The Judiciary Committee has petitioned the court to obtain the Mueller grand jury material and force McGahn to comply with its subpoena as part of its investigation into the President, which Judiciary Chairman Jerry Nadler told CNN last week <a href="https://www.cnn.com/2019/08/08/politics/jerry-nadler-impeachment-inquiry/index.html" target="_blank" rel="noopener noreferrer">amounted to &#8220;formal impeachment proceedings,&#8221;</a> although the House has not voted to open an impeachment inquiry.</p>
</div>
<div class="zn-body__paragraph" style="text-align: left;">The committee issued a subpoena for McGahn to testify in May, but he did not appear, prompted the lawsuit that was filed earlier this month. McGahn is effectively the test case for numerous subpoenas the committee has issued or authorized to current and former Trump administration officials for testimony related to obstruction of justice and other matters.</p>

										<content:encoded><![CDATA[<p>A key House panel will hold a series of hearings beginning next week on the revelations laid out in the Mueller report, along with testimony from key legal experts, including a former prominent White House lawyer from the Richard Nixon era.</p>
<p>The announcement on Monday by the House Judiciary Committee, which holds the power to begin impeachment proceedings, came as Congress will return later that evening from a weeklong recess and House Democrats will resume its interparty debate on whether to move forward with opening an impeachment inquiry into President Donald Trump.</p>
<p>Witnesses will include the likes of former White House counsel John Dean, who worked for President Richard Nixon during the crux of the Watergate scandal that later led to impeachment proceedings, and other unnamed &#8220;former U.S. Attorneys and legal experts,&#8221; according to the Judiciary Committee.</p>
<p>&#8220;These hearings will allow us to examine the findings laid out in Mueller&#8217;s report so that we can work to protect the rule of law and protect future elections through consideration of legislative and other remedies,&#8221; Judiciary Chairman Jerrold Nadler, a New York Democrat, said in a statement.</p>

<p>The public events, the first of which will be June 10, will play a crucial role in Democrats&#8217; ability to convince the American people that the House should open an impeachment inquiry into the president, as a growing number of party members have called for since the Mueller report&#8217;s release. Several Judiciary Committee Democrats viewed Mueller&#8217;s public remarks last week, the first of their kind, as a call for Congress to proceed with substantial action, like impeachment.</p>
<p>&#8220;Russia attacked our elections to help President Trump win, Trump and his campaign welcomed this help and the President then tried to obstruct the investigation into the attack,&#8221; Nadler said. &#8220;Mueller confirmed these revelations and has now left Congress to pick up where he left off.&#8221;</p>
<p>House Speaker Nancy Pelosi, along with other Democratic leaders in the chamber, have continued to downplay impeachment talk. Speaking at a Commonwealth Club event shortly after Mueller reiterated his report could not exonerate Trump of any criminal wrongdoing, the California Democrat cautioned her party.</p>
<p>&#8220;You don&#8217;t bring an indictment, or you don&#8217;t bring an impeachment, unless you have all of the facts, the strongest possible case, so that the president is held accountable one way or another,&#8221; she said.</p>
<p>But patience could be running thing, as one member of leadership—on top of rank-and-file Democrats—warning has now suggested impeachment proceedings could be inevitable.</p>
<p>Majority Whip Jim Clyburn, a South Carolina Democrat, told CNN over the weekend he believed that at some point in the future, impeachment proceedings will be brought against the president.</p>

<p>The comments come amid reports that the White House is preparing to go to legislative war with several House committees as they continue their sprawling probes into the Trump administration.</p>
<p>White House officials are reportedly planning on exerting executive privilege after the House Judiciary Committee filed a subpoena for testimony and documents from former White House Counsel Don McGahn, who was known to have a contentious relationship with Trump and played a starring role in Mueller’s report.</p>
<p>The administration directed former security clearance official Carl Kline to ignore a subpoena from the House Committee on Oversight and Reform regarding its probe into the White House security clearance process. The direction prompted a threat from panel Chairman <span class="rollover-people" data-behavior="rolloverpeople"><a class="rollover-people-link" href="https://thehill.com/people/elijah-cummings-0" data-nid="354970">Elijah Cummings</a></span> (D-Md.) to <a href="https://thehill.com/homenews/administration/440220-oversight-chair-wants-to-hold-ex-white-house-official-in-contempt">hold Kline in contempt of Congress</a>.</p>
<p>The Treasury Department also missed a second deadline to hand over six years of the president’s tax returns.</p>
<p>The newest back and forth between the two ends of Pennsylvania Avenue has brought the White House’s relationship with Capitol Hill into arguably its most combative position to date.</p>
<p>Trump told The Post that he has not yet made a decision regarding exerting executive privilege over testaments from aides already called upon by Congress, though to officials familiar with internal plans said that White House lawyers intend to use the tool to bar congressional testimony.</p>
<p>“I don’t want people testifying to a party, because that is what they’re doing if they do this,” Trump said.</p>
<p>“I allowed my lawyers and all the people to go and testify to Mueller — and you know how I feel about that whole group of people that did the Mueller report,” Trump added. “I was so transparent; they testified for so many hours. They have all of that information that’s been given.”</p>
<p>However, Democrats appear emboldened in their investigative efforts in the aftermath of the Mueller report. While the party remains divided on impeachment, with its upper echelons expressing skepticism about the prospect, House Democrats are united in their resolve to find answers to lingering questions from the special counsel’s probe.</p>
<p>“As to the President’s conduct, we will scrupulously assert Congress’ constitutional duty to honor our oath of office to support and defend the Constitution and our democracy.  That includes honoring the Article I responsibility of the legislative branch to conduct oversight over the other branches of government, unified in our search for the truth and in upholding the security of our elections,” Speaker Pelosi (D-Calif.) wrote in a letter to her colleagues Monday.</p>
<p>While Mueller found insufficient evidence of coordination between the Trump campaign and Moscow to bring charges, he neither implicated nor exonerated the president regarding obstruction of justice, saying that while he found <a href="https://thehill.com/policy/national-security/439517-here-are-the-10-episodes-mueller-probed-for-potential-obstruction-by">10 “episodes”</a> of possibly obstructive behavior, Congress would ultimately decide whether or not to charge Trump in light of Justice Department guidelines that sitting presidents cannot be indicted.</p>

<p>House Democrats officially filed their lawsuit Friday afternoon challenging President <a href="https://www.washingtontimes.com/topics/donald-trump/">Trump</a>’s plans to shift money to build his border wall, demanding federal judges step in and referee between the two sides.</p>
<p>House Speaker <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Nancy Pelosi</a> had teased the move earlier this week, and the 45-page lawsuit filed in federal district court in Washington, D.C., follows up on her threat.</p>
<p>The case challenges two different transfers of money <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a> announced earlier this year: $2.5 billion from a Pentagon drug interdiction fund and $3.6 billion <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a> said he could move after declaring a national emergency, flexing powers under a 1976 law.</p>
<p>“The administration’s actions here demonstrate a shocking disregard for the Appropriations Clause, which protects <a href="https://www.washingtontimes.com/topics/congress/">Congress</a>’s ‘exclusive power over the federal purse,’” the House says in its lawsuit.</p>
<p><a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Mrs. Pelosi</a> and her colleagues said they had only approved $1.375 billion this year for “barrier construction” — they specifically avoided calling it a “wall” — and they said any additional money the president tries to spent is unconstitutional.</p>
<p>The House argues that <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a> undercut his own national emergency declaration when he said he could have built the wall over a longer period of time, “but I’d rather do it much faster.</p>
<p>The case does not appear to challenge another $601 million <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a> is transferring from the Treasury Forfeiture Fund for wall construction.</p>
<p>A number of environmental groups and Democrat-led states have already sued to try to stop the wall, in federal courtrooms from Washington, D.C., to Texas to California.</p>
<p>Each of those cases is still in its infancy, though plaintiffs have argued there is some urgency after the government already announced the first $1 billion transfer of money into the drug interdiction fund to be used for wall construction.</p>
<p>The premise of House Democrats’ lawsuit is similar to one filed by Republicans when they controlled the House and President Obama was in office. Mr. Obama spent money on an Obamacare program despite <a href="https://www.washingtontimes.com/topics/congress/">Congress</a> zeroing out that funding in its spending bills.</p>
<p>That case resulted in an early ruling in favor of the GOP, but the case was ultimately settled once <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a> took over from Mr. Obama.</p>
<p>The Trump administration says this case is different because <a href="https://www.washingtontimes.com/topics/congress/">Congress</a> explicitly gave the president expansive spending powers in the Emergencies Act. And the Emergencies Act already gives <a href="https://www.washingtontimes.com/topics/congress/">Congress</a> a way to rein in the president on its own, by passing a resolution disapproving of the emergency.</p>
<p><a href="https://www.washingtontimes.com/topics/congress/">Congress</a> attempted to use that power, but was unable to overcome <a href="https://www.washingtontimes.com/topics/donald-trump/">Mr. Trump</a>’s veto.</p>
<p>Legal analysts say the fact that <a href="https://www.washingtontimes.com/topics/congress/">Congress</a> tried but failed to use its own legislative tools could work against <a href="https://www.washingtontimes.com/topics/nancy-pelosi/">Mrs. Pelosi</a>’s legal case in the courts.</p>
