Roberts oversaw Trump’s first impeachment trial last year.

Vermont Democratic Sen. Patrick Leahy “is expected to preside” over the impeachment trial of former President Donald Trump, a Senate source told Fox News on Monday, signaling that Chief Justice John Roberts will not be forced to oversee the politically charged arguments now that Trump is out of office.

The source said Leahy, the president pro tempore of the Senate, would preside instead of the chief justice because senators usually fill that role when the impeached individual is not the current president of the United States. A separate government source confirmed that Roberts will not participate in the impeachment trial.

Leahy, D-Vt., confirmed that he will preside over the trial in a statement Monday.

“The president pro tempore has historically presided over Senate impeachment trials of non-presidents. When presiding over an impeachment trial, the president pro tempore takes an additional special oath to do impartial justice according to the Constitution and the laws,” Leahy said. “It is an oath that I take extraordinarily seriously.”

<img decoding="async" src="https://a57.foxnews.com/static.foxnews.com/foxnews.com/content/uploads/2021/01/640/320/Sen.-Patrick-Leahy-.jpg?ve=1&tl=1" alt="WASHINGTON, DC - OCTOBER 22: U.S. Sen.
He added: “I consider holding the office of the president pro tempore and the responsibilities that come with it to be one of the highest honors and most serious responsibilities of my career. When I preside over the impeachment trial of former President Donald Trump, I will not waver from my constitutional and sworn obligations to administer the trial with fairness, in accordance with the Constitution and the laws.”

Politico last week reported that Roberts “wants no further part” in overseeing an impeachment after he presided over Trump’s impeachment trial one year ago.

During that trial, Democrats pressured Roberts to get involved against the former president, including an instance in which Sen. Elizabeth Warren, D-Mass., asked Roberts whether he was harming the Supreme Court’s legitimacy because Republicans wouldn’t allow witnesses. And Trump himself habitually attacked Roberts on Twitter while he was in office.

Roberts is known for his desire to preserve the institutional integrity of the Supreme Court as a neutral arbiter that calls “balls and strikes.” He often will lead coalitions on the court to rule narrowly on hot-button issues, deciding merely the case in front of the justices without announcing broader proclamations that some of his fellow justices would like.

TRUMP IMPEACHMENT ARTICLE BEING SENT TO SENATE MONDAY

The chief justice of the United States is constitutionally required to oversee impeachment trials of sitting presidents. But it’s not clear whether the chief justice is required to oversee a trial of a former president. That Roberts will not oversee the upcoming trial is evidence that he and top Senate leaders do not believe he must be there for the body to hold a legitimate trial of a former president.

The news that Leahy will preside over the trial of Trump also means that Vice President Kamala Harris will also not. CNN first reported that Leahy will preside. Harris has a constitutional role as the president of the Senate and is expected to be highly involved in the upcoming Congress in order to break ties on votes that fall along party lines — the Senate is currently split evenly with 50 Republicans, 48 Democrats, and two independents who caucus with Democrats.

In almost all cases, the vice president and the Senate president pro tempore are interchangeable as far as who oversees Senate business. The job of Senate president pro tempore goes to the most senior member of the majority party — Leahy has been in office for more than 46 years.

The person who presides over the Senate trial of Trump is unlikely to have a substantive effect on the proceedings but will affect the optics of the event.

House impeachment managers will deliver the impeachment articles to the Senate at 7 p.m. Monday night, officially triggering the start of the trial. But a deal reached between Senate Majority Leader Chuck Schumer, D-N.Y., and Minority Leader Mitch McConnell, R-Ky., will allow both the impeachment managers and Trump’s legal team the opportunity to submit what are essentially pre-trial briefs over a period of a couple of weeks.

The meat and potatoes of the trial, when Leahy will be presiding over arguments on the floor from both sides, will not start until Feb. 9.

The House impeached Trump this month after a mob of his supporters stormed the Capitol while lawmakers and former Vice President Mike Pence were meeting in a joint session to certify President Biden’s electoral victory on Jan. 6.

Trump held a rally earlier that day at which he doubled-down on months of false claims that he won the presidential election and encouraged rallygoers to march to the Capitol “peacefully and patriotically.” At the same rally, his most vocal supporters used harsh rhetoric, including lawyer Rudy Giuliani, who said “let’s have trial by combat.”

It’s highly unlikely that Trump could be convicted at a Senate trial, as 17 Republicans would need to join all 50 Democrats to reach the two-thirds threshold. But if Trump is convicted, he could be barred from holding office in the future by a simple majority on a subsequent vote.

Greetings from Tyler,

There have been several important developments this week. One is the ascension of Boris Johnson to office of Prime Minister of the UK. The jury is still out on whether he’ll be able to extricate Britain from the European Union without remaining hostage to all manner of rules and regulations that deprive the nation of its sovereignty. Prime Minister Boris began by firing his entire cabinet, largely made up of politicians who were determined that Britain must remain hostage to the EU. He says that he’ll get the UK out of the EU by October 31st, “no ifs, ands or buts.”

It’s a tall order, one that Theresa May couldn’t manage, and the British press may well make it as difficult as possible. It seems that Boris Johnson gets along well with President Trump, which is two strikes against him as far as the media is concerned. This situation is ticklish. Nigel Farage, known as the “godfather of Brexit” says that great courage will be required of the new Prime Minister. Mr. Farage believes that a general election should be called, and believes that would solidify the authority of the new administration do to what must be done. That would fall in line with the things both Herbert W. and Garner Ted Armstrong were saying for 50 some years. “Britain will NOT be one of the TEN nations of Bible prophecy that make up the ‘beast’ power of Revelation.

The mainstream media is excited about both North Korea and Iran test-firing short and medium-range missiles. That’s causing plenty of energetic reporting because it gives the opportunity for them to report the prospect of failure for President Trump’s foreign policies. After the ruinous spectacle of the nationally televised Mueller hearings, they need something to hang their hat on.

This was their last gasp. They just had to get Mueller on camera to say something they could use to press ahead toward their impeachment dream. But Mueller was a tremendous disappointment. It looked like he’d had little if anything to do with the “report” that bore his name. He was completely unfamiliar with passages and footnotes that appeared within the report that he’d supposedly written. He’d apparently never heard of individuals and documents that were referenced (Glenn Simpson- Fusion GPS). For a few hours, it looked like those who were just sure that Mueller would produce the ammunition to destroy the Trump presidency were completely out of gas and defeated.

Even one of the most vocal proponents (Adam Schiff) of the “Trump-Russia” narrative concluded that the 2020 election remained the only method of getting rid of the Trump Presidency. But the air of defeat didn’t last. Soon, the networks were trotting out Congressmen to declare, “We have a felon in the White House. He lied, he obstructed justice and now it’s the job of Congress to see that justice is done” (Julian Castro, paraphrased).” After some behind-the-scenes meetings, the Trump-haters have regrouped and put impeachment back on the table. What else can they do?

They certainly can’t allow the news-cycle to be dominated by the slow trickle of information that will (someday) expose American intelligence agencies for attempting to overturn the 2016 election with bogus, filthy accusations made by Russian sources—bought and paid for by the opposing campaign—and carried out by high officials who are still doing their level best to destroy the President.

So impeachment is back on the table, and full-throated accusers are lined up for national television appearances.

It seems that there is plenty of documentation that will expose the plot and nail the high officials who put it in motion. It was CLASSIFIED. No one was authorized to access it, outside of a few individuals with high enough clearances, but they can’t tell us either. As many may know, the President declassified these materials and placed them at the disposal of new Attorney General Robert Barr. But they still haven’t been made public. The President did a LIVE interview last night in which he was asked about these materials, and we heard the same answer. “Bob Barr is highly respected, and it’s up to him to distribute these materials as he sees fit (paraphrased).” That’s it. Here we are, years into this debacle. The mainstream media have been intentionally dishonest. They have succeeded in convincing a sizable percentage of the public that Trump is a Russian agent, that he’s committed treason and is practicing criminality in the White House. The release of fraudulent documents, some of which were used to get court orders allowing domestic agencies to spy on Americans involved with the Trump campaign, pilfer through all their calls, e-mails and communications records, might finally put the truth of the situation out in the open where it would expose the perpetrators and their scheme.

For whatever reason (and we hope it’s a good one) the smoking-gun proof of their malfeasance remains hidden, and that’s where the mainstream media hopes it will stay.

For all the hype and exaggerated expectations, the whole Mueller investigation was an embarrassing flop. Now Mueller is a sympathetic figure. It appears his name and his reputation were used to lend credibility to another rogue operation designed to take Trump down. But it appears only a minor setback for his enemies. They’ll continue to investigate while calling the President and any who dare support him RACIST!

You might as well get comfortable with it. If we love our country, want it to survive a sovereign land where freedom reigns, that makes us racist according to politically-correct dogma. Unless you want everyone on earth to set up shop (or a tent on a sidewalk) in the United States, without going through the legal maze citizens must navigate, you are definitely guilty of their favorite charge. If you’re not prepared to pass the overwhelming burden of debt of unlimited health-care for all illegals (can we see a raise of hands?) on to your progeny, you might be– no, you are a RACIST!

That’s OK. The Bible says to count it all joy when falsely accused and spitefully used. So maybe we should be enjoying the constant drumbeat of hateful disgust aimed our way. Sooner or later (we hope sooner) the curtain will be pulled aside, and no one will be able to ignore the fact that the entire information conglomerate has been hijacked and used for propaganda and misinformation for two and a half years! It’s time we didn’t have to waste, and still don’t.

“Fox News Sunday” anchor Chris Wallace said former Special Counsel Robert Mueller’sHouse hearing has turned into a “disaster” for Democrats and for the former FBI director’s reputation.

Responding after the first few hours of the hearing before the House Judiciary Committee hearing, Wallace said Mueller offered little defense of his investigation amid repeated attacks from Republicans. He said Mueller has not put forth much “testimony” or new information.

“I think this has been a disaster for the Democrats and I think it’s been a disaster for the reputation of Robert Mueller. He has seemed very uncertain with his brief. He doesn’t seem to know things that are in the report,” Wallace told Bret Baier and Martha MacCallum during Fox News Channel’s all-day coverage of the House hearings.

“Over and over, Mueller just sits silent and allows the attacks from the Republicans to sweep over him and says nothing.”

Mueller was frequently tripped up and forced to ask lawmakers to repeat their questions during his rapid-fire questioning on Capitol Hill, though he reportedly prepared at length for the hearings.

At one point, he even said he wasn’t familiar with Fusion GPS, the opposition research firm behind the controversial anti-Trump dossier.

MUELLER REFUSES TO DISCUSS RUSSIA PROBE ORIGINS, STEELE DOSSIER IN TESTIMONY

The longtime lawman was known to be reluctant to testify, having made clear he would largely stick to the boundaries of his original report.

He reiterated Wednesday that his testimony before House committees would be based on the text of his report on Russian election interference and potential obstruction of the investigation.

Wallace said Mueller’s performance raises questions about the degree to which he was actually “in charge of the investigation.”

CLICK HERE TO GET THE FOX NEWS APP

Fox News contributor Katie Pavlich agreed, arguing that she questions whether “partisans” were the driving force behind the investigation, as President Trump has claimed.

“Robert Mueller is not doing himself any favors. He looks weak, he does not look strong, he cannot answer basic questions about what is in the report, when he’s saying the report is what I’m referring to,” she argued, adding Democrats are not getting what they wanted out of the hearing.

Later in the coverage, after the Judiciary Committee hearing ended, Wallace said Democrats “had their moments” but he does not believe the testimony will change the minds of many Democrats on impeachment.

The House voted down an impeachment resolution by a margin of 332 to 95 last week, with House Speaker Nancy Pelosi expressing her opposition to impeaching Trump.

“[Nancy Pelosi] may end up, unintentionally, being the big winner today because I don’t think the drive for impeachment gained any momentum, in fact, it may have lost some,” he said.

While House Speaker Nancy Pelosi is urging caution and patience in response to those in her party clamoring for impeachment proceedings against President Trump, her top deputies are signaling it’s only a matter of time before they begin.

South Carolina Rep. Jim Clyburn, the third-highest-ranking Democrat in the House, said in an interview Sunday that he believes impeachment proceedings ultimately will be launched against Trump at some point in the future. He suggested Democrats are already laying the groundwork in Congress.

DEMS RAMP UP CALLS FOR TRUMP IMPEACHMENT AFTER MUELLER SPEAKS OUT ON RUSSIA PROBE

“I think we’ve already begun,” Clyburn said on CNN’s “State of the Union.” “We’ve got all of these committees doing their work, we’re having hearings.”

He added: “We do believe that if we sufficiently, effectively educate the public, then we will have done our jobs, and we can move on an impeachment vote and it will stand, and maybe it will be what needs to be done to incent the Senate to act.”

Last week’s public statement from Robert Mueller, the special counsel who led the Russia investigation, emphasizing that his report did not exonerate the president of obstruction of justice accusations has triggered an avalanche of calls from Democrats to begin impeachment.

In a radio interview last week, House Judiciary Committee Chairman Jerry Nadler, D-N.Y., whose committee would lead impeachment proceedings, said “there certainly is” justification for Congress to begin impeachment proceedings against Trump, but said it was critical for the American public to be on board before launching the process.

NADLER: THERE ‘CERTAINLY’ IS JUSTIFICATION TO IMPEACH TRUMP

“Impeachment is a political act, and you cannot impeach a president if the American people will not support it,” Nadler said Friday. “The American people, right now, do not support it because they do not know the story. They don’t know the facts.”

Mueller’s statement has put renewed pressure on Pelosi, who has resisted the calls and questioned the political wisdom of moving forward. During a speech at the California Democratic Party’s convention on Saturday, Pelosi was greeted with “impeach” chants from liberal activists. Pelosi has been non-committal about impeachment and said last week, “Many constituents want to impeach the president. But we want to do what is right and what gets results.”

Despite the momentum, Democrats, even with their congressional majority, still appear to have some work to do in convincing their own party. A New York Times tally says 54 House Democrats support impeachment, 58 do not support it and 123 have not committed. Michigan Rep. Justin Amash is the only House Republican to support impeachment. It takes just a simple majority of the House to impeach.

However, even if they impeach, Democrats do not appear to have the votes in the Senate – where a super majority is required and Republicans have control – to remove Trump from office.

Other top House Democrats, though, are acknowledging the long odds of success.

House Intelligence Committee Chairman Adam Schiff said Sunday on ABC News’ “This Week” that impeachment “is destined for failure.”

SCHIFF SAYS IMPEACHMENT ‘IS DESTINED FOR FAILURE’

“I think we’re going to do what is right for the country, and at this point, the speaker has not reached the conclusion, and I haven’t either, that it’s the best for the country to put us through an impeachment proceeding that we know will, is, destined for failure in the Senate,” Schiff said.

The momentum inside the party comes as Trump is overseas. On Monday, he met with Queen Elizabeth II and other members of the royal family at Buckingham Palace amid D-Day commemoration ceremonies.

In a tweet on Sunday, the president ripped into Democrats for focusing on impeachment, saying Congress needs to focus on other issues, involving the border, drug prices and infrastructure.

House Speaker Nancy Pelosi has called an emergency meeting with Democrats Wednesday morning at 9 a.m. to discuss their demands for impeachment proceedings against President Trump, per Fox News.

“The pressure is actually real,” as Dana Perino noted.

Pelosi just had a closed door meeting with members of Congress in which she reiterated that now is not the time to consider impeachment – it’s time for them to turn to other issues. You know, issues that got them voted in in the first place.

Still, she faced push back from her own leadership team and from some of the more progressive lawmakers.

No wonder Donald Trump was so angry.

No wonder he wanted to stop the Mueller investigation.

He didn’t collude with the Russians to defeat Hillary Clinton in 2016.

He knew he was innocent.

And almost three years ago he foresaw that a biased fishing expedition by Special Counsel Robert Mueller and his liberal lawyers would undermine his ability to govern and provide Democrats and the liberal media with an endless supply of damaging political ammo.

Now that Attorney General William Barr released the redacted Mueller report, the whole world knows that Mueller completely exonerated Trump of collusion with Russia.

Mueller was unable to decide whether the president was guilty of obstruction of justice. But the desperate Democrats in the House and the disappointed fake journalists over at CNN don’t care that Mueller found Trump guilty of no crime.

They’ll spend the next 20 months parsing the Mueller report’s footnotes and milking the unanswered question of obstruction for every possible drop of political poison they can find.

By noon on Thursday CNN’s all-liberal panel of eight Trump-hating pundits and legal experts like Jeffrey Toobin already were back to their usual tricks.

They spent half the morning spinning the importance of the inconclusive “obstruction” part of Mueller’s report and trashing Attorney General Barr as a shill for the president.

Dana Bash and crew showed no sympathy for the unfair, incorrect, and deranged assault they and their soulmates at MSNBC, The New York Times, and elsewhere have subjected Trump to for three years.

You’d think Toobin and a few of the others would have been pleased to find out that the president of the United States did not collude or conspire with the Russians to fix the 2016 election.

Instead, ignoring how wrong they were about everything, they were excitedly talking about how the Mueller report’s examples of presidential obstruction attempts could serve as a handy road map to impeachment for House Democrats.

Some CNN panel members, to their shame, were visibly disappointed that Trump was saved by several staffers who had the good sense and ethics to refuse to do what he asked of them.

According to the Mueller report, there were ten examples of Trump trying to get control of the Russia investigation.

They included firing FBI Director James Comey, urging Trump’s useless Attorney General Jeff Sessions to “re-recuse” himself, and trying to get various staffers to lie or not cooperate with Mueller.

The facts surrounding those presidential attempts to interfere are not in dispute.

But the president never fired anyone, even though he had the Constitutional power to do it, and he never obstructed Mueller from doing his work.

The White House even turned over millions of documents and the president waived his right to use executive privilege.

If any of his White House staff had followed the president’s requests concerning the Mueller investigation there might have been a legitimate case for obstruction.

But they ignored him. And they did exactly what they are supposed to do — they kept the boss from making a serious mistake.

I say bravo to the president’s staff for saving his butt. They did their job. They protected President Trump from himself.

As the president’s lawyer Rudy Giuliani said Thursday, the president reacted to the Russia collusion charges the way any innocent man would react to a frame up.

President Trump had every right to be outraged and frustrated by Mueller’s investigation, which he always knew was a Democratic witch hunt.

If he never colluded with anyone in the first place, as Mueller has proved to the satisfaction of everyone except maybe Rachel Maddow and Adam Schiff, it’s hard to see how the president could be guilty of the crime of obstruction.

If anything, the only thing President Trump was guilty of was trying to obstruct injustice.

No matter when and how Special Counsel Robert Mueller’s Russia probe ends, House Democrats are planning to aggressively ramp up their own Trump-related investigations that will include a network of committees and high-profile public hearings likely to last well into the 2020 election year.

It is unclear at this point when the special counsel’s investigation into Russian meddling and potential collusion with Trump campaign associates will be complete, though several officials have said the probe is nearing its end.

TRUMP ACCUSES SCHIFF OF ‘UNLIMITED PRESIDENTIAL HARASSMENT’ AMID NEW PROBE

But the Mueller report will not mark the end of Russia investigations. House Democrats have ramped up their own efforts to investigate the president on matters related to Russia, his personal finances, his relationships and communications with foreign officials, and more.

The House Financial Services Committee, led by Rep. Maxine Waters, D-Calif., is the latest panel to join in on the investigations. Axios reported Wednesday that the committee will coordinate with the House Intelligence Committee on money-laundering inquiries — while the House Foreign Affairs Committee is also involved.

The details emerged after House Intelligence Chairman Adam Schiff, D-Calif., already announced a sweeping new probe into the president’s foreign business dealings and Russian election meddling.

Committee Democrats alleged last year that Trump’s financial records with Deutsche Bank and Russia may reveal a “form of compromise” that “needs to be exposed.” Schiff has long maintained there had to be some reason that the German banking giant, which has what he called a “history of laundering Russian money,” was willing to work with the Trump Organization.

The same committee has also floated a potential subpoena for notes or testimony from the interpreter in meetings between Trump and Russian President Vladimir Putin—a move that would dramatically escalate Democrats’ investigations into the Trump administration. Should Schiff choose to subpoena the interpreter, it would likely trigger a major confrontation between the executive and legislative branches concerning discussions with foreign leaders.

Reports last month suggested that Trump took possession of the notes from the interpreter after his summit with Putin in Hamburg in 2017, and instructed the individual not to discuss what had taken place in the meetings with Putin with any other administration officials. But the president’s decision to ask the interpreter not to share details of his meetings with foreign leaders with other members of the administration could have been a response to prior leaks of private conversations with Australian Prime Minister Malcolm Turnbull and then-Mexican President Enrique Peña Nieto in 2017.

TRUMP CALLS SCHIFF ‘POLITICAL HACK’ AS DEMS OPEN NEW RUSSIA PROBE, SEND TRANSCRIPTS TO MUELLER

Schiff posed the idea of subpoenaing the interpreter in 2018, but again, last month, suggested they could use subpoena power to obtain the notes and testimony.

The House Foreign Affairs Committee also has directed resources from their former subcommittee on terrorism and nonproliferation to one focused on investigations and oversight. Chairman Eliot Engel, D-N.Y., said that it “made sense” to have a panel like this when there are “so many questionable activities of this Administration vis-à-vis foreign policy.”

Engel also pointed to Trump’s summit with Putin in Helsinki, Finland in 2018.

“It’s been many months since Helsinki, and we still don’t know what Putin and Trump talked about,” Engel said, adding that a new panel could also look at the “business interests of the president” and how his financial dealings with certain countries in the Middle East and Russia have “affected what he’s done in foreign policy.”

WHITE HOUSE ANNOUNCES ADDITIONS TO PRESS SHOP IN ANTICIPATION OF SUBPOENAS AND HEARING INVITES FROM HOUSE DEMS

Meanwhile, sources told Fox News that the House Judiciary Committee has staffed up with former Obama chief ethics counsel Norm Eisen helping Chairman Jerrold Nadler, D-N.Y., conduct the panel’s oversight of Mueller’s Russia investigation and the Justice Department. The Judiciary Committee also would lead the charge on any potential impeachment proceedings.

And the House Oversight Committee, while not leading a full investigation, had invited former Trump attorney Michael Cohen to testify before the panel. He accepted, but then postponed the public hearing citing alleged threats made by Trump and his legal team. Cohen was also invited by Schiff to testify before the House Intelligence Committee, but his hearing has yet to be scheduled.

On the other side of the Capitol, the Senate Intelligence Committee has subpoenaed Cohen for a deposition before their panel. That same committee, chaired by Sen. Richard Burr, R-N.C., and Ranking Member Mark Warner, D-Va., has been probing whether the Trump campaign colluded with Russia during the 2016 presidential election. But this week, NBC News reported that the committee has found “no evidence” of collusion.

While the timeline of Mueller’s investigation remains to be seen, Trump’s former attorney John Dowd ripped the entire probe as a “terrible waste of time” on Wednesday in an interview with ABC News.

BETWEEN ACTING AG WHITAKER AND HOUSE DEMS, TRUMP-MUELLER HEARING TURNS TESTY

“I will be shocked, if anything regarding the president is made public, other than, ‘we’re done,’” Dowd said.

“I know exactly what he has. I know exactly what every witness said, what every document said. I know exactly what he asked. And I know what the conclusion [is],” Dowd said, again blasting the probe as “one of the greatest frauds this country’s ever seen.”

CLICK HERE TO GET THE FOX NEWS APP

“I’m just shocked that Bob Mueller didn’t call it that way and say, ‘I’m being used.’ I would have done that,” Dowd added.
