Democrats are worried their party lacks a clear plan to push back at what is certain to be an onslaught of abortion restrictions in the wake of a Supreme Court draft ruling striking down Roe v. Wade.

While Democrat after Democrat has cried out over the possibility a conservative Supreme Court could eviscerate abortion rights, strategists say little is being offered in terms of a clear way to fight back.

Some also say the party wasn’t ready for something that was clearly coming down the pike.

“Why are we so behind the curve on this? Where is the plan? We knew this was coming in theory since Coney Barrett joined the court, and in practice since December,” said Democratic strategist Christy Setzer.

“I don’t want to hear empty rhetoric about how ‘we won’t go back,’ I want to hear that there is a legislative or federal plan to change things,” she added.

President Biden and Vice President Harris have assailed the leaked draft opinion. In an impassioned speech at the EMILY’s List gala on Tuesday night, Harris declared that women’s rights were under attack, previewing her party’ midterm messaging.

Strategists say the rage is real. But they are worried the party has no real strategy.

“We’re all so enraged but now what? What’s the plan? Sadly, I don’t think we have one,” said one strategist. “There’s so much talk of ‘We can’t let this happen.’ But I don’t think anyone knows what to do next.”

There are significant limits to what the White House and Democrats in Congress can do if the Supreme Court strikes down Roe v. Wade and GOP states begin to outlaw abortion rights.

Previous efforts to codify abortion rights into law have failed and Democrats do not have the votes in Congress to overcome a filibuster.

“I think their options are very limited, and what I’ve been advising is for the White House to focus on winnable battles,” said Lawrence Gostin, a public health law professor at Georgetown University.

While some progressive Democrats have renewed a push to do away with the legislative filibuster, Biden isn’t joining that effort – at least not yet. Instead, he’s called on voters to elect more pro-abortion Democrats to Congress, a message echoed throughout his administration.

Democrats may not even have 50 votes to codify abortion rights. Sen. Joe Manchin (R-W.Va.), who describes himself as a pro-life Democrat, voted against advancing the Women’s Health Protection Act earlier this year.

Biden has ordered the Gender Policy Council and the White House counsel’s office to develop a response plan in preparation for a Supreme Court ruling, but it’s too early to know what that plan will entail. Any steps could also face legal challenges from Republican attorneys general.

White House press secretary Jen Psaki said Wednesday that the administration will not release its plan until after the final opinion is released, conscious of not getting ahead of the official ruling expected to come over the next two months.

“We don’t have a final conclusion. The Supreme Court themselves made clear this is not the final opinion,” Psaki said. “We are already working a great deal behind the scenes and we will have more to say.”

Psaki said that officials across the administration are focused on helping those who will be most affected by the ruling, including women of color and poorer Americans who will face bigger financial challenges accessing abortions if Roe is overturned and states enact restrictions. The White House believes that as many as 26 states will move to restrict abortion if the draft opinion holds.

Gostin offered that the Centers for Disease Control and Prevention could prepare a report on the physical and mental consequences for women for don’t have access to safe and lawful abortions. He also said the Food and Drug Administration could expand its guidance on the use of abortion pills, such as specifying where people can safely order them.

He also said that Biden is considering allowing the use of Medicaid funding to pay for time off and travel for women who need to travel out-of-state to receive abortions.

The administration’s actions thus far have offered little solace to frustrated Democrats.

Some progressives are calling for more aggressive action, including renewing a controversial push to expand the number of justices on the Supreme Court.

“We aren’t powerless,” Rep. Hank Johnson (D-Ga.) said on an organizing call for the progressive advocacy group Demand Justice Wednesday night. “Two things that we must do to protect and preserve our democracy: one, we must get rid of the filibuster and, two, we need to add some seats to the United States Supreme Court.”

Meanwhile, a coalition of organizations including Planned Parenthood, MoveOn and Women’s March announced plans Thursday to hold marches in four major cities including in Washington, D.C., as part of a coordinated effort to protest the forthcoming ruling.

The White House has pointed to steps the administration has already taken, such as creating $6.6 million in grants for family planning services and emergency contraception for people in states with restrictive laws.

“We are going to double down on the effort to make sure that the legal rights of all Americans, women to access the care that they’re entitled to continues forward,” Health and Human Services Secretary Xavier Becerra told lawmakers at a Senate hearing this week.

Gostin said the White House was unprepared for the uproar created by the leaked draft opinion earlier this week.

“The leak has really made this an outsized public and political issue even more so than the actual opinion would have been,” he said. “It’s caused a huge political tsunami.”

Title 42 order was implemented in March 2020.

The Biden administration on Friday announced that it will be terminating the Title 42 public health policy, that has been used by both the Trump and Biden administrations to quickly expel migrants at the southern border since the start of the COVID-19 outbreak, at the end of May – despite fears of a massive migrant wave in the coming months.

“After considering current public health conditions and an increased availability of tools to fight COVID-19 (such as highly effective vaccines and therapeutics), the CDC Director has determined that an Order suspending the right to introduce migrants into the United States is no longer necessary,” the Centers for Disease Control said in a statement.

DEM SENATORS SOUND ALARM OVER REPORTS BIDEN ADMINISTRATION WILL END TITLE 42 BORDER POLICY

The order was implemented by the Trump administration due to the outbreak of COVID-19 and has since been used by bot

The order was implemented by the Trump administration due to the outbreak of COVID-19 and has since been used by both the Trump and Biden administrations to expel a majority of migrants at the border. While it is a public health order, not an immigration policy, it has become one of the central border policies in place as the U.S. faces a continuing crisis of numbers at the border. In February, approximately 55% of migrants were returned due to the order, rather than being released into the U.S.

Activists and left-wing Democrats have been calling for the Biden administration to end the order for months, claiming it is cruel and denied migrants due process.

“This is a momentous day for immigrant rights activists, and immigrants and refugees everywhere,” Rep. Pramila Jayapal, D-Wash., said in a statement. “Title 42 was a cruel and discriminatory policy that circumvented U.S. law, preventing people from accessing protections established by Congress. Today is the product of years of advocacy from both inside and outside Congress. I’m thrilled to see the Biden Administration do the right and moral thing by ending this extremely harmful, xenophobic, and shortsighted policy that disproportionately impacted Black and Brown migrants.”

But Republican and moderate Democratic lawmakers, as well as law enforcement at the border, have expressed concern that it could lead to a surge in migration that could overwhelm agents and exceed the enormous numbers seen last year. Former Trump White House adviser Stephen Miller said that ending Title 42 would “open the floodgates on a biblical scale.”

“At every opportunity, Biden has enacted policies that open our southern border, empower drug smugglers and human traffickers, and make American communities less safe. Joe Biden has overseen the worst border crisis in DHS history,” Republican National Committee Chairwoman Ronna McDaniel said in a statement. “By removing Title 42, Biden’s doubling down on his commitment to actively worsening the crisis he created.”

Multiple Border Patrol officials have told Fox News that ending Title 42 would lead to what one agent described as a “surge on top of a surge” as word spreads among migrants that they will not be deported. There are also believed to be a considerable number of migrants waiting in Mexican cities waiting for Title 42 to drop.

“We are expecting to get wrecked,” one Border Patrol agent told Fox News Digital.

The order will end on May 23, giving the Department of Homeland Security time to prepare for what the Biden administration has admitted will be an “influx” in numbers at the border.

DHS Secretary Alejandro Mayorkas on Friday claimed that DHS has “put in place a comprehensive, whole-of-government strategy to manage any potential increase in the number of migrants encountered at our border.”

ARIZONA DEM SENATORS WARN BIDEN AGAINST ‘SHARP END’ TO TITLE 42 BORDER RESTRICTIONS WITHOUT PLAN

“We are increasing our capacity to process new arrivals, evaluate asylum requests, and quickly remove those who do not qualify for protection,” he said in a statement. “We will increase personnel and resources as needed and have already redeployed more than 600 law enforcement officers to the border. We are referring smugglers and certain border crossers for criminal prosecution. Over the next two months, we are putting in place additional, appropriate COVID-19 protocols, including ramping up our vaccination program.”

Border Patrol agents have expressed skepticism that they can prepare for what DHS has estimated could be potentially up to 18,000 migrants a day, even as they are already overwhelmed and overcrowded with the numbers that are already at the border.

“If there’s a strategy in place, we haven’t seen it, it hasn’t been disseminated to us and there’s no way you can prepare in a month and a half for what is expected to be a mass illegal migration crisis,” Brandon Judd, head of the National Border Patrol Council, told Fox News Digital this week. “The only thing this administration is going to be able to do is just release people on a mass scale, that’s it, that’s all they can do.”

Moderate Democrats too had expressed concern about the move. Sen. Joe Manchin, D-W.Va., said the administration should “reconsider.”

CLICK HERE TO GET THE FOX NEWS APP

“If anything we should be looking at permanency on Title 42,” he said. “Maybe that would spur us to get a good immigration policy that works for Americans and secure our borders — the borders have to be secure,” he said.

Sens. Mark Kelly, D-Ariz,, and Kyrsten Sinema, D-Ariz., also warned the administration about ending the policy without what they said was a sufficient plan in place. Sinema, who is Chair of the Senate Subcommittee on Border Management, said she told Mayorkas she intends to hold a hearing on the matter.

Schumer pushes Senate filibuster reform to secure election legislation

Senate Minority Leader Mitch McConnell slammed Democrats in a floor speech Wednesday for using the Jan. 6 Capitol riot to justify proposed filibuster reform to pass election legislation.

“It is surreal to hear sitting senators invoke Jan. 6 to justify breaking the rules to grab outcomes they have not earned,” said McConnell, R-Ky. “It is jaw-dropping for colleagues to propose to commemorate that by breaking the Senate themselves.”

SCHUMER TARGETS FILIBUSTER REFORM TO PASS VOTING RIGHTS LEGISLATION

McConnell’s condemnation comes one day after he accused Majority Leader Chuck Schumer, D-N.Y., of trying “to break the Senate” by gutting the filibuster.

In a Monday letter to his Democratic colleagues, Schumer said the upper chamber would debate rule changes in an attempt to carve a path for voting reform legislation.

Schumer said the move was necessary to circumvent situations like the Jan. 6 attack that could jeopardize the legitimacy of the current democratic process.

“We must adapt,” he wrote. “The Senate was designed to evolve and has evolved many times in our history.”

But McConnell, who told Politico Wednesday that he may support making changes to the 1887 Electoral Count Act, has taken issue with making any sweeping changes to Senate rules or broader election reform.

SCHUMER TO USE JAN. 6 ANNIVERSARY TO MAKE PUSH FOR FEDERAL VOTING RIGHTS BILL

“No party that would trash the Senate’s legislation traditions can be trusted to seize control over election laws all across America,” McConnell said Wednesday from the Senate floor. “Nobody who is this desperate to take over our democracy on a one-party basis can be allowed to do it.”

“Finally, it is beyond distasteful for some of our colleagues to ham-fistedly invoke the Jan. 6 anniversary to advance these aims,” he said.

McConnell has faced criticism for his stark condemnation of filibuster reform after he amended the rule during Donald Trump’s presidency in order to confirm Supreme Court nominees by a simple majority – securing the former president three justices to the high court.

But despite the majority leader’s recent push to amend the filibuster, he continues to face an uphill battle from within his own party.

Moderate Democrat Sens. Joe Manchin of West Virginia and Kyrsten Sinema of Arizona have repeatedly said they do not support filibuster reform.

CLICK HERE TO GET THE FOX NEWS APP

This means Democrats will still need to secure 60 votes in favor of voting reform in order to pass legislation – a tough feat in a 50-50 split Senate.

Schumer has said the upper chamber will consider rule changes on or before Jan. 17 – Martin Luther King Jr. Day – in an attempt to push through voting rights legislation by simple majority and bypass the 60-vote margin needed to avoid threat of filibuster.

The GOP representative argues Biden has ‘given’ Americans ‘record crime,’ inflation

Rep. Jim Jordan, R-Ohio, slammed the Biden administration on Sunday for doing “everything wrong.”

During an exclusive interview with “Sunday Morning Futures” the congressman argued that President Biden has “given” Americans “record crime” and inflation during his first year in office.

Jordan made the comments three days after it was revealed that annual inflation is running at the hottest pace in nearly four decades as widespread supply disruptions, extraordinarily high consumer demand and worker shortages fuel rapidly rising price increases.

Prices soared by 5.7% through November, according to the Personal Consumption Expenditures price index data released Thursday morning. That topped the previous month’s rate of 5%, becoming the fastest pace increase since February 1982, when the gauge hit 6.17%.

The inflation spike largely reflected surging energy costs, which rose 34% from a year ago, and food costs, which were up 5.6% over that same time period. Services inflation rose by 4.3% in November, and goods inflation increased 8.5% – up from the 7.6% pace a month prior, the data shows.

MANCHIN SAYS HE ‘CANNOT VOTE’ FOR BUILD BACK BETTER: ‘I’VE DONE EVERYTHING HUMANLY POSSIBLE’

“The American people would like safe streets, they’d like affordable gas and they’d like freedom,” Rep. Jordan argued on Sunday. “Instead what Biden is giving them is record crime, record inflation and Dr. Fauci.”

“You pick the policy area, they’ve [The Biden administration has] done it wrong,” he added.

Jordan then argued that in “literally in 11 months,” the country “went from safe streets to record crime.”

“We went from a secure border to complete chaos,” he continued. “We went from stable prices to now record inflation. We went from projecting strength around the world to the debacle that was the exit in Afghanistan.”

A White House spokesperson did not immediately respond to Fox News’ request for comment.

Rep. Jordan also said that Sen. Joe Manchin, D-W.Va., “stays firm and this crazy so-called ‘Build Back Better’ bill never passes.”

Speaking on “Fox News Sunday,” Sen. Joe Manchin, D-W.Va., declared last Sunday that after months of negotiations he has determined that there is no way he can support Biden’s massive social spending bill known as the Build Back Better Act.

Manchin said that he has spoken with President Biden, House Speaker Nancy Pelosi, and Senate Majority Leader Chuck Schumer, D-N.Y., but could not reach an agreement on the legislation.

He said that between ongoing inflation, the national debt, “geopolitical unrest,” and the COVID-19 pandemic, the bill being pushed by his fellow Democrats was too much.

“When you have these things coming at you the way they are right now … I cannot vote to continue with this piece of legislation,” he said, stating that if he cannot explain to his constituents why he would vote for a bill, then he cannot vote for it, despite all the work he and other Democrats have put into trying to make it work.

Senator Joe Manchin (D., W. Va.) said Sunday that he “cannot vote to continue with” President Biden’s nearly $2 trillion social spending plan, dashing Democrats’ hopes that the moderate Democrat could be persuaded to support the bill.

“I cannot vote to continue with this piece of legislation. I just can’t. I’ve tried everything humanly possible. I can’t get there,” Manchin said during an appearance on Fox News Sunday.

“You’re done — this is a no,” host Bret Baier said.

“This is a no, on this legislation,” Manchin responded. “I have tried everything I know to do.”

Manchin later added that Biden “has a lot of logs in the fire,” including Covid, inflation and the $29 trillion federal debt.

“That’s where our efforts should be at right now,” Manchin said.

“When you have these things coming at you the way they are right now, I’ve always said this, Bret, if I can’t go home to the people of West Virginia, I can’t vote for it,” he said.

Jake Sherman@JakeSherman
Now Manchin has released a statement saying he’s no. Crystal clear no

“My Democratic colleagues in Washington are determined to dramatically reshape our society in a way that leaves our country even more vulnerable to the threats we face. I cannot take that risk”

Manchin had held out on supporting the social spending measure, leaving Democrats short of the 50 votes needed to pass the legislation via budget reconciliation. Without Manchin’s support, Democrats became increasingly likely to miss their self-imposed deadline to pass the bill by the end of the month. Manchin’s latest comments effectively kill the bill.

Sources close to Manchin say that while he will not vote for the “Build Back Better” bill, that he is committed to working on the issues through more focused legislation and regular legislative order, CBS News Ed O’Keefe reported.

“I also think he could find a way to yes on a version of it,” one source reportedly told O’Keefe. “I don’t see it as dead dead.”

CNN’s Manu Raju reported last week that talks between Manchin and Biden about the bill were not going well. The child tax credit had been a huge sticking point as Manchin wanted to cut the measure, according to Raju.

Raju asked House Speaker Nancy Pelosi if Democrats miscalculated Manchin on the bill last week and she responded: “I think that this is called the legislative process. And we have our rules than they have their rules. I’m not going to have a post-mortem on something that hasn’t died. I think we will have legislation that will pass.”

Last week Biden had struck a hopeful tone about his conversations with Manchin, saying the moderate Democrat has “reiterated his support for Build Back Better funding at the level of the framework plan I announced in September.”

“I believe that we will bridge our differences and advance the Build Back Better plan, even in the face of fierce Republican opposition,” Biden said in a statement on Thursday. “My team and I are having ongoing discussions with Senator Manchin; that work will continue next week.”

“It takes time to finalize these agreements, prepare the legislative changes, and finish all the parliamentary and procedural steps needed to enable a Senate vote,” he added. “We will advance this work together over the days and weeks ahead; Leader Schumer and I are determined to see the bill successfully on the floor as early as possible.”

Still, Manchin said his opposition would not be a huge surprise to the president.

“He knows that I’ve had concerns and the problems I’ve had,” Manchin said on Sunday. “The thing we should all be directing our attention towards is the variant of COVID we have coming back at us in so many different aspects and different ways. It’s affecting our lives again.”

Manchin expressed concern that rising inflation could “really harm a lot of Americans” and suggested that is where the government’s attention “needs to be directed toward immediately.”

Representative Ayanna Pressley (D., Mass.) blasted Manchin during an appearance on CNN on Sunday: “To be clear my lack and deficit of trust was about Senator Manchin. He has continued to move the goal post. He has never negotiated in good faith and he is obstructing the President’s agenda.”

“All I want for Christmas is a Senator that has compassion for the American people, not contempt,” she added.

Senator Bernie Sanders (I., Vt.) said on CNN’s State of the Union that he wants to hold a vote on the bill and that Manchin should be forced to vote no if he’s opposed.

“Let him vote no in front of the whole world,” Sanders said.

Biden also urges Congress to ban ‘assault weapons’.

President Biden on Tuesday implored the Senate to pass new gun control measures in the wake of a mass shooting that left 10 dead in Boulder, Colorado, this week.

Biden said he didn’t “want to wait another minute, let alone an hour,” to act on gun violence.

He urged the House and Senate to ban “assault weapons,” as he said he did as a senator.

“I got that done as a senator. It brought down mass shootings, we can do it again,” Biden said. “We can ban assault weapons and high-capacity magazines in this country once again.”

Senate Majority Leader Chuck Schumer, D-N.Y., said Tuesday he hasn’t spoken without the White House about an assault weapons ban. Such a ban is not part of a pair of House bills on gun control that passed earlier this month.

Among other efforts, the Senate took up an assault weapons ban in 2013, after the shooting that left 20 children and six adults dead, but it failed in a 40-60 vote.

Sens. Joe Manchin, D-W.Va., and Pat Toomey, R-Pa., led a bipartisan effort to close commercial background check loopholes that year, but their effort fell six votes short of passage.

The president also called on the Senate to pass two House bills, one that closed loopholes on background checks, including the Charleston loophole, and one that expanded background checks to include gun sales on the internet and at gun shows.

“These are bills that received votes with both Republicans and Democrats in the House. This is not and should not be a partisan issue. This is an American issue that will save lives, American lives. And we have to act. We should also ban assault weapons in the process,” Biden said.

BOULDER MASS SHOOTING SUSPECT IDENTIFIED

The House passed an expansion of gun background checks in March. The two bills expand federal gun background checks on all firearms sales and extend the background check review period from three days to a minimum of 10 business days. One bill would close the “Charleston loophole,” where a gun sale is allowed to proceed if the background check is not completed in three days.

According to police, 21-year-old Ahmad Al Aliwi Alissa opened fire at a grocery store on Monday, leaving nine civilians and one police officer dead.

Officials said they are still working to determine a motive in the shooting.

Monday’s midafternoon attack was the seventh mass killing this year in the U.S., following the March 16 shooting that left eight people dead at three Atlanta-area massage businesses, according to a database compiled by the Associated Press, USA Today and Northeastern University.

SCHUMER VOWS SENATE WILL TAKE ON GUN CONTROL MEASURES

Senate Majority Leader Chuck Schumer, D-N.Y., said Tuesday the Senate will specifically move to expand gun background checks – an effort that has long evaded passage in the upper chamber.

“We cannot seem to finish grieving one tragedy before another takes place,” Schumer said of the back-to-back Atlanta and Boulder mass shootings. “It is a reminder that we must confront a devastating truth in the United States: an unrelenting epidemic of gun violence steals innocent lives with alarming regularity.”

Six days before the Boulder shooting, a gunman shot and killed eight, six of them Asian American, at various spas in Atlanta, Georgia.

The U.S. is set to borrow more money in the next 12 months than the previous 200+ years combined

The U.S. national debt will swell to nearly $30 trillion if Democrats are able to ram through their COVID-19 relief package via budget reconciliation.

The $1.9 trillion spending package will grow the U.S. budget deficit to $3.8 trillion in 2021 and put the government on a path to spend more money in one year than the previous 200+ years.

“Biden and company are set to borrow more money over the next 12 months than the U.S. government borrowed to finance the Revolutionary War, the Civil War, World War I, World War II, and the Cold War,” wrote Stephen Moore, former economic adviser to President Trump, in his Committee to Unleash Prosperity newsletter.

HOUSE COMMITTEE CLEARS $1.9T COVID RELIEF PACKAGE

The bill, which includes $1,400 direct payments to American households and extends federal unemployment benefits, was approved by the House Budget Committee on Monday evening by a 19 to 16 tally, paving the way for a full House vote later week.

Democrats hold a slim 221 to 211 majority in the lower chamber and the vote is expected to pass along party lines. Congress has already authorized about $4 trillion in direct COVID relief.

“We must act swiftly to put an end to this pandemic and to stem the suffering felt by so many millions,” House Speaker Nancy Pelosi, D-Calif. said in a statement.

The size of the package has come under increased scrutiny from Republican lawmakers. Rep. Steve Scalise of Louisiana labeled the plan a “blue state bailout” for awarding $350 billion to state and local governments to fix budget problems that have been festering for years well before the pandemic began in March.

The aid plan also grants $750 million for COVID relief outside the U.S., $100 million for a Silicon Valley underground rail project, and $50 million toward environmental justice purposes, among other things.

“If Republicans are ready to work with Democrats on constructive amendments that will improve the bill, we are ready to work,” wrote Sen. Majority Leader Chuck Schumer of New York. “However, we must not allow Republican obstructionism to deter us from our mission of delivering help to Americans who desperately need this relief.”

Without amendments, the relief package could have a difficult time passing in the Senate, where two moderate Democrats, Joe Manchin of West Virginia and Kyrsten Sinema of Arizona, have expressed concerns about backing the bill due to the inclusion of a $15 federal minimum wage.

The Senate’s 50-50 split between Democrats and Republicans means both Manchin and Sinema, barring Republican defections, would have to support the measure before Vice President Kamala Harris could cast a tie-breaking vote.

READ MORE ON FOX BUSINESS BY CLICKING HERE

Passage of the $1.9 trillion COVID-19 relief package may not mark the end of Biden’s unprecedented spending spree.

Reports have been circulating in recent days that his administration has begun working on a recovery package that could address infrastructure, climate change, inequality or some of the other promises that Biden made on the campaign trail.
