<p class=" story-text__paragraph">An 1807 law invoked only in the most violent circumstances is now a rallying cry for the MAGA-ites most committed to the fantasy that Donald Trump will never leave office.</p>
<p class=" story-text__paragraph">The law, the Insurrection Act, allows the president to deploy troops to suppress domestic uprisings — not to overturn elections.</p>

<p class=" story-text__paragraph">But that hasn’t stopped the act from becoming a buzzword and cure-all for prominent MAGA figures like Sidney Powell and Lin Wood, two prominent pro-Trump attorneys leading efforts to overturn the 2020 election, and <a href="https://www.washingtonpost.com/nation/2020/12/16/north-carolina-republican-trump-insurrection/" target="_blank" rel="noopener"><u>even one</u></a> North Carolina state lawmaker. Others like Michael Flynn, Trump’s first national security adviser who was recently pardoned for lying to the FBI, have made adjacent calls for Trump to impose martial law. The ideas have circulated in pro-Trump outlets and were being discussed over the weekend among the thousands of MAGA protesters who descended on state capitols and the Supreme Court to falsely claim Trump had won the election.</p>

<p class=" story-text__paragraph" data-content-child-index="0-0">At its core, the Insurrection Act gives the president authority to send military and National Guard troops to quell local rebellions and violence, offering an exemption to prohibitions against using military personnel to enforce domestic laws. Historically, it has been used in moments of extreme national strife — the Civil War, the rise of the Ku Klux Klan, violent labor disputes, desegregation battles, rioting following Martin Luther King Jr.’s death.</p>
<p class=" story-text__paragraph" data-content-child-index="0-1">Only once, however, has it been used in the wake of an election — and that was to stop a literal militia from seizing the Louisiana government on behalf of John McEnery, a former Confederate officer who had lost the 1872 governor’s race.</p>
<p class=" story-text__paragraph" data-content-child-index="0-2">Nonetheless, in the minds of some authoritarian-leaning and conspiracy-minded Trump supporters, the Insurrection Act has become a needed step to prevent President-elect Joe Biden from assuming the presidency. Their evidence-deficient reasoning: Democrats illegally rigged the election and are attempting a coup, and Trump must send in the troops to undo this conspiracy.</p>
<p class=" story-text__paragraph" data-content-child-index="0-3">The conviction shows how hard-edged MAGA ideology has become in the wake of Trump’s election loss. While scattered theories about a “deep state” arrayed against Trump have long circulated in MAGA circles, calls for troops to stop a democratically elected president from taking office have taken those ideas to a more conspiratorial and militaristic level. It also displays the exalted level to which Trump has been elevated among his most zealous fans as his departure looms.</p>
<p class=" story-text__paragraph" data-content-child-index="0-5">“The central theme here is that there supposedly exists a network of nefarious actors trying to undermine Trump and destroy the United States, and that this is a tool that Trump could use to save the day,” said Jared Holt, a research fellow at the Atlantic Council’s Digital Forensics Research Lab, who focuses on far-right extremism.</p>
<p class=" story-text__paragraph" data-content-child-index="0-0">The Insurrection Act has been rarely invoked since the civil unrest of the 1960s — the last time was to quell violence during the 1992 Los Angeles riots. And when it has been used over that period, it was always at the request of a state governor.</p>
<p class=" story-text__paragraph" data-content-child-index="0-1">But over the past several years, it has gained popularity among the far-right fringes, mainly as a way for Trump to solve all their problems, from <a href="https://www.thegatewaypundit.com/2019/05/its-happening-president-trump-plans-to-invoke-insurrection-act-to-remove-illegal-aliens-from-united-states/" target="_blank" rel="noopener"><u>expelling</u></a> undocumented migrants, to arresting generals and other “deep state” actors for allegedly plotting coups against Trump.</p>
<p class=" story-text__paragraph" data-content-child-index="0-2">The idea has also become intertwined with the QAnon movement, the far-reaching and baseless conspiracy that Trump is secretly working to disrupt a cabal of pedophiliac, sex trafficking Democrats and global elite.</p>
<p class=" story-text__paragraph" data-content-child-index="0-3">In May, a Q-drop — the name for the mysterious missives allegedly from a person at the center of the QAnon movement — floated the Insurrection Act for the first time as a way to solve “growing unrest” after George Floyd was killed by Minnesota police. “Call the ball,” Q said mysteriously.</p>
<p class=" story-text__paragraph" data-content-child-index="0-4">Then, in June, GOP Sen. Tom Cotton brought the idea of the Insurrection Act into the national dialogue with a New York Times op-ed that called on Trump to invoke the law in response to rioting that was occurring amid largely peaceful protests over racial justice. Trump himself leaned into the idea, <a href="https://townhall.com/tipsheet/mattvespa/2020/08/29/president-trump-in-new-hampshire-oh-i-might-invoke-the-insurrection-act-to-put-down-these-leftist-thugs-n2575294" target="_blank" rel="noopener"><u>suggesting</u></a> to a rally audience that he would use the act to put down “leftist thugs” protesting that summer.</p>
<p class=" story-text__paragraph" data-content-child-index="0-5">From there, the Insurrection Act became a quick fix to everything among the more extreme MAGA figures.</p>
<p class=" story-text__paragraph" data-content-child-index="0-6">Trump ally and convicted political operative Roger Stone brought it up on Infowars as a way for Trump to combat anything from coups to protests to election fraud.</p>
<p class=" story-text__paragraph" data-content-child-index="0-7">“The president&#8217;s authority is the Insurrection Act and his ability to declare martial law,” he told host and conspiracy theorist Alex Jones. Stone added that Trump could also use the law to arrest anyone from Facebook CEO Mark Zuckerberg for election interference, to Democratic power couple Bill and Hillary Clinton — an interpretation that legal experts say strains credulity.</p>
<p class=" story-text__paragraph" data-content-child-index="0-0">Jimmy Gurulé, a former Justice Department prosecutor now teaching at Notre Dame Law School, called the argument tenuous. While the Insurrection Act can be legally invoked as a response to a “conspiracy” that hinders people’s rights, there must actually be a conspiracy to justify sending in federal troops over the objection of local and state officials.</p>
<p class=" story-text__paragraph" data-content-child-index="0-1">“I think that the key here is, &#8216;Well, what the hell is that conspiracy?’” he said. “No one can articulate the participants in the conspiracy, the scope of the conspiracy, the object of the conspiracy. It’s all over the place.”</p>
<p class=" story-text__paragraph" data-content-child-index="0-2">Still, Trump himself seemed keen to the idea, telling Fox News host Jeanine Pirro that he would “put down [anti-Trump protests] very quickly” if they broke out after the election: “Look, it&#8217;s called insurrection. We just send in and we do it very easy.”</p>
<p class=" story-text__paragraph" data-content-child-index="0-3">Further out on the MAGA fringe, Trump supporters suggested the president jump the gun and simply arrest everyone — <a href="https://thecommonsenseshow.com/activism-agenda-21-conspiracy/save-america-trump-must-immediately-invoke-insurrection-act-declare-martial-law-and-arrest-all" target="_blank" rel="noopener"><u>before</u></a> the election.</p>
<p class=" story-text__paragraph" data-content-child-index="0-4">And now, with the Electoral College confirming Biden’s win, recounts failing to change the results and courts at every level swatting down lawsuits challenging the outcome, some MAGA figures have latched on to the specific Insurrection Act clause granting the president authority to use the military to quash a “rebellion against the authority of the United States.” In their strained interpretation, the clause gives Trump the power to go after the Democrats and deep state actors conspiring to remove him from office. It’s a reading of the law experts immediately rejected.</p>
<p class=" story-text__paragraph" data-content-child-index="0-5">“When you&#8217;re talking about a group of conspiracy theorists, and others who lack any kind of legal knowledge, they&#8217;ll just pull that arrow out of their quiver when the rest don’t work,” said Brian Levin, executive director of the Center for the Study of Hate and Extremism at California State University, San Bernardino.</p>
<p>It seems nearly impossible Trump would actually invoke the law in this manner. But that hasn’t stopped prominent Trump supporters like Wood, one of the lawyers pushing unsubstantiated lawsuits through the courts, from suggesting Trump send the military into Georgia to break up a meeting of electors.</p>
<p class=" story-text__paragraph">And over the weekend, after the Supreme Court rejected a Trump-boosted lawsuit from Texas asking to overturn the election results in four other swing states, MAGA supporters took to the streets to <a href="https://www.nytimes.com/2020/12/12/us/4-stabbed-and-one-shot-as-trump-supporters-and-opponents-clash.html?searchResultPosition=1" target="_blank" rel="noopener"><u>demand</u></a>, among other things, that Trump use the Insurrection Act to force an election do-over, or at the very least, stop Biden from taking office.</p>
<p class=" story-text__paragraph">The Epoch Times itself ran an editorial on Monday <a href="https://www.theepochtimes.com/at-this-critical-time-president-trump-should-take-action_3617674.html" target="_blank" rel="noopener"><u>arguing</u></a> that it was time for Trump to invoke the act and send in the military to seize thousands of voting machines in order to find fraud: “Our system is in crisis. Trump would act to restore the rule of law.”</p>
<p class=" story-text__paragraph">Gurulé, the former DOJ prosecutor, pointed out that even if Trump tried to invoke the Insurrection Act, there really is nothing for the military to suppress.</p>
<p class=" story-text__paragraph">“I guess it’d be a voting fraud conspiracy, but how is the military going to suppress that?” he said. “By what, seizing all the ballots? By seizing all the voting machines? By then, what are they going to do, conduct the votes? It just doesn&#8217;t make sense.”</p>
<p class=" story-text__paragraph">The point, however, might just be to have the Insurrection Act as a talking point to keep the MAGA movement motivated. And Levin, the extremism researcher, feared a darker path if Trump — a man who already speaks in militaristic terms on a regular basis — continued to goad his base into thinking a Biden presidency is an insurrection.</p>
<p class=" story-text__paragraph">“What is the heart of the Second Amendment, pro-militia, anti-government patriot movement? It&#8217;s the insurrectionist theory of the Second Amendment,” he said. “It says people can rise up against a tyrannical government. To me, this looks like the last exit on the Jersey Turnpike before we get to that spot.”</p>

<p>The White House later in the day sent out a statement saying that Flynn &#8220;should never have been prosecuted&#8221; and that the pardon ends &#8220;the relentless, partisan pursuit of an innocent man.&#8221;</p>
<p>&#8220;While today’s action sets right an injustice against an innocent man and an American hero, it should also serve as a reminder to all of us that we must remain vigilant over those in whom we place our trust and confidence,&#8221; the statement continued.</p>
<p>Flynn pleaded guilty twice to lying to the FBI about his conversations with Russian ambassador Sergey Kislyak prior to Trump&#8217;s inauguration.</p>
<p>Flynn said during his interview with the FBI that he and Kislyak had not discussed sanctions that had just been imposed on Russia for election interference by the outgoing Obama administration.</p>
<p>During that conversation, Flynn urged Kislyak for Russia to be “even-keeled” in response to the punitive measures and assured him “we can have a better conversation” about relations between the two countries after Trump became president.</p>
<p>The conversation alarmed the FBI, which at the time was investigating whether the Trump campaign and Russia had coordinated to sway the election&#8217;s outcome. In addition, White House officials were stating publicly that Flynn and Kislyak had not discussed sanctions.</p>
<p><strong><a href="https://www.foxnews.com/politics/flynn-case-judge-issues-unusual-order-telling-government-to-certify-its-evidence-is-true-and-correct">FLYNN CASE JUDGE ISSUES UNUSUAL ORDER TELLING GOVERNMENT TO CERTIFY EVIDENCE IS &#8216;TRUE AND CORRECT&#8217;</a></strong></p>
<p>However, the prosecution came under scrutiny after the release of FBI documents that suggested a plot to get him to lie.</p>
<p>&#8220;What is our goal?&#8221; read one of the FBI&#8217;s notes. &#8220;Truth/Admission or to get him to lie, so we can prosecute him or get him fired?&#8221;</p>
<p>Following those revelations, Trump&#8217;s Justice Department moved to drop its case against Flynn, but encountered hurdles in court after the D.C. Circuit Court of Appeals rejected Flynn&#8217;s plea to force U.S. District Judge Emmet Sullivan to drop his criminal case in August.</p>
<p>Flynn’s legal team had clashed with Sullivan, demanding in a filing last month that he should <a href="https://www.foxnews.com/politics/judge-emmet-sullivan-hears-arguments-over-whether-to-dismiss-flynn-case" target="_blank" rel="noopener noreferrer">recuse</a> himself from &#8220;further participation&#8221; in the Flynn case, citing an &#8220;appearance of bias&#8221; the lawyers claimed was &#8220;terrifying and mandates disqualification.&#8221;</p>
<p>Flynn was awaiting Sullivan&#8217;s ruling when Trump issued the pardon.</p>

<p>In a statement, House Judiciary Committee Chairman Jerry Nadler, D-N.Y., blasted the move, arguing the pardon is &#8220;undeserved, unprincipled, and one more stain on President Trump’s rapidly diminishing legacy.&#8221;</p>
<p>&#8220;President Trump dangled this pardon to encourage Flynn to backtrack on his pledge to cooperate with federal investigators—cooperation that might have exposed the President’s own wrongdoing.  And it worked,&#8221; Nadler said. &#8220;Flynn broke his deal, recanted his plea, received the backing of the Attorney General over the objections of career prosecutors, and now has secured a pardon from the President of the United States.&#8221;</p>
<p>He noted that the move by Trump is &#8220;part of a pattern,&#8221; citing his previous decision to grant clemency to former Trump adviser Roger Stone.</p>
<p>&#8220;These actions are an abuse of power and fundamentally undermine the rule of law,&#8221; Nadler added. &#8220;The President’s enablers have constructed an elaborate narrative in which Trump and Flynn are victims and the Constitution is subject to the whims of the President. Americans soundly rejected this nonsense when they voted out President Trump.&#8221;</p>

<p>A DOJ spokesperson told Fox News that the department was &#8220;not consulted&#8221; but officials were given a &#8220;heads-up&#8221; Wednesday.</p>
<p>&#8220;We would have preferred to see if Judge Sullivan would act and for the matter to be resolved in court. We were confident in the likelihood of our success in the case,&#8221; the spokesperson added. &#8220;That being said, this is obviously an appropriate use of the President’s pardon power.&#8221;</p>

<p>According to a <a href="https://www.foxnews.com/politics/trump-flynn-pardon-michael-flynn" target="_blank" rel="noopener noreferrer">report by Axios</a>, Flynn&#8217;s pardon is one of many that the president intends to issue before leaving office.</p>

<p class="speakable">Attorney General <a href="https://slack-redir.net/link?url=https%3A%2F%2Fwww.foxnews.com%2Fcategory%2Fperson%2Fwilliam-barr" target="_blank" rel="noopener noreferrer">Bill Barr</a> clashed with Democrats on the House Judiciary Committee Tuesday over accusations that he is carrying out <a href="https://slack-redir.net/link?url=https%3A%2F%2Fwww.foxnews.com%2Fcategory%2Fperson%2Fdonald-trump" target="_blank" rel="noopener noreferrer">President Trump</a>&#8216;s political wishes, as he appeared for a long-awaited hearing where tensions also flared over protests and riots following George Floyd&#8217;s death in police custody.</p>
<p class="speakable">The hearing, originally scheduled for 10 a.m. local time, was delayed after committee chairman Rep. Jerrold Nadler, D-N.Y., was in a car accident. Nadler did not suffer any injuries.</p>
<p>Once the hearing began, which lasted until mid-afternoon, Nadler did not hesitate to express his scorn for Barr and his Justice Department.</p>
<p><a href="https://www.foxnews.com/politics/nadler-involved-in-car-accident-but-unhurt-barr-hearing-delayed"><strong>NADLER INVOLVED IN CAR ACCIDENT BUT UNHURT; BARR HEARING DELAYED</strong></a></p>
<p>&#8220;Thank you for being here, Mr. Barr,” Nadler said with a note of sarcasm, pointing out that this was the attorney general’s first time appearing before the committee.</p>
<p>The chairman went on to claim that Barr and his department have &#8220;downplayed the effects of systemic racism&#8221; in the wake of Floyd&#8217;s death and ongoing protests.</p>
<p>Addressing the department&#8217;s approach to cases related to the Russia probe, Nadler summed up the DOJ&#8217;s attitude by claiming that &#8220;the president’s enemies will be punished, his friends will be protected,&#8221; no matter the cost, and saying that the DOJ&#8217;s actions have caused &#8220;real damage to our democratic norms.&#8221;</p>
<p>&#8220;In your time at the department, you have aided and abetted the worst failings of the president,&#8221; Nadler said.</p>
<p>Ranking member Rep. Jim Jordan, R-Ohio, fired back in his opening that Democrats&#8217; hostility toward Barr is based on one thing: &#8220;Spying.&#8221;</p>
<p>Jordan said that Democrats took exception to Barr accusing the Obama administration of spying on the Trump campaign, despite evidence that has come out revealing flaws in the FBI&#8217;s process in acquiring a warrant to monitor former Trump campaign adviser Carter Page.</p>
<p>Jordan also pointed to evidence that the FBI engaged in questionable tactics in investigating Michael Flynn, whose criminal case the DOJ requested be dismissed. At another point in the hearing, Barr affirmed <a href="https://www.foxnews.com/politics/barr-asks-us-attorney-john-bash-to-review-unmasking-before-and-after-2016-election-doj-tells-fox-news">earlier reporting</a> that he has appointed U.S. Attorney John Bash of the Western District of Texas to investigate the practice of &#8220;unmasking&#8221; Americans who have had conversations with foreign officials.</p>
<p>Jordan then addressed the ongoing unrest in the U.S., showing a lengthy montage of media clips that began with reporters calling the incidents &#8220;peaceful protests&#8221; and then going into a string of clips of violence and fires in various parts of the country.</p>
<p>Barr, speaking next with his opening remarks, did not shy away from Democrats&#8217; accusations against him. He insisted that he acts independently of the president and that his goal is to make sure that everyone is treated equally under the law.</p>
<p>He emphatically stated that Trump &#8220;has not attempted to interfere&#8221; in decisions regarding the handling of criminal matters.</p>
<p><strong><a href="https://www.foxnews.com/politics/dem-impeachment-lawyer-nadler-barr">DEM IMPEACHMENT LAWYER DINGS NADLER&#8217;S &#8216;INEFFECTIVE&#8217; QUESTIONING OF BARR</a></strong></p>
<p>&#8220;On the contrary, he has told me from the start that he expects me to exercise my independent judgment to make whatever call I think is right,&#8221; he continued. &#8220;That is precisely what I have done.&#8221;</p>
<p>Barr also addressed the racial tension following Floyd&#8217;s death. While acknowledging the tragedy, he defended the criminal justice system by arguing that in the past 50 years progress has been made and that any racism on the part of individual officers is not due to &#8220;some deep-seated racism generally infecting our police departments.&#8221; He noted that &#8220;[p]olice forces today are far more diverse than ever before.&#8221;</p>

<p>The attorney general responded by recent calls to defund police as &#8220;grossly irresponsible.&#8221;</p>
<p>Barr also spoke out against &#8220;violent rioters and anarchists&#8221; that he said have &#8220;hijacked legitimate protests,&#8221; specifically mentioning the ongoing unrest in Portland as an example.</p>
<p>The Trump administration has been blasted in the media for sending federal officers in to quell the unrest, but Barr defended the effort, arguing that these are not peaceful protests, but &#8220;an assault on the Government of the United States.&#8221; He described the weapons that some demonstrators have used and noted that a federal courthouse has been under siege.</p>
<p>The tension only escalated once the questioning began, with Nadler implying that Barr was using federal forces responding to unrest to provide material to aid Trump&#8217;s campaign.</p>
<p>When asked if he has discussed the campaign with Trump, Barr answered sharply, stating, &#8220;I’m a member of the Cabinet and there’s an election going on, obviously the topic comes up,&#8221; adding that “it shouldn’t be a surprise.&#8221;</p>
<p>Nadler later accused Barr of using federal forces to provide Trump with footage for campaign ads. When Barr tried to respond and say that he was not using federal law enforcement to help Trump&#8217;s campaign, Nadler spoke over him.</p>
<p>Later in the hearing, Barr got an opportunity to explain federal activities in Portland.</p>

<p>&#8220;Federal courts are under attack. Since when is it OK to burn down a federal court?&#8221; Barr said.</p>
<p>He said: &#8220;If someone went down the street to the Prettyman Court here, that beautiful courthouse we have right at the bottom of the hill and started breaking windows and firing industrial-grade fireworks in to start a fire, throw kerosene balloons in and start fires in the court, is that OK? Is that OK now? No, the U.S. Marshals have a duty to stop that and defend the courthouse, and that’s what we are doing in Portland. We are at the courthouse, defending the courthouse.&#8221;</p>
<p>&#8220;We are not out looking for trouble.&#8221;</p>
<p>At another point in the hearing, Barr lamented that only one political party seemed to be sticking up for federal property and condemning mobs.</p>
<p>&#8220;What makes me concerned for the country is this is the first time in my memory that the leaders of one of our two great political parties, the democratic party are not coming out and condemning mob violence and the attack on federal courts,&#8221; Barr said. &#8220;Why can&#8217;t we just say, you know, violence against federal courts has to stop? Could we hear something like that?&#8221;</p>
<p>Barr also had an opportunity to explain his positions in the Michael Flynn and Roger Stone cases, and launched an impassioned defense against the accusations that he has treated the president’s friends with particular and improper favor and gone after his enemies.</p>
<p>“What enemies have I indicted?” Barr asked.</p>
<p>He then turned to the cases involving Trump&#8217;s associates.</p>
<p>&#8220;The cases that are cited, the Stone case and the Flynn case, are both cases where I determined that some intervention was necessary to rectify the rule of law, to make sure people are treated the same,&#8221; Barr said.</p>
<p>&#8220;Stone was prosecuted under me. And I said all along I thought that was a righteous prosecution, I thought he should go to jail, and I thought the judge’s sentence was correct,&#8221; he continued. &#8220;But the line prosecutors were trying to advocate for a sentence that was more than twice anyone in a similar position had ever served, and this was a 67-year-old man, first-time offender, no violence. And they were trying to put him in jail for seven to nine years. And I wasn’t going to advocate that, because that is not the rule of law.&#8221;</p>
<p>Barr said: &#8220;I agree the president’s friends don’t deserve special breaks but they also don’t deserve to be treated more harshly than other people and sometimes that’s a difficult decision to make, especially when you know you’re going to be castigated for it.”</p>

<p>Later in the hearing, Barr touched on the Flynn case, noting that the case against him warranted dismissal in light of exculpatory evidence surrounding his initial FBI interview, which had recently become public. This included notes that indicated that federal agents may have been trying to get Flynn to lie so that he could be prosecuted.</p>
<p>&#8220;The interview was untethered to any legitimate investigation,&#8221; Barr said.</p>
<p>Rep. Cedric Richmond, D-La., called into question Barr&#8217;s claim that there is no inherent racism in the American justice system, pointing to Barr&#8217;s own department as evidence to support his claim.</p>
<p>&#8220;The one thing that you have in common with your two predecessors, both Attorney General [Jeff] Sessions and [acting] Attorney General [Matt] Whitaker, is that when you all came here and brought your top staff, you brought no black people,&#8221; Richmond said. &#8220;That, sir, is systematic racism. That is exactly what John Lewis spent his life-fighting.&#8221;</p>
<p>Early in his opening statement, Barr paid his respects to Lewis, who was a champion of civil rights. Richmond did not appreciate the kind words.</p>
<p>&#8220;You really should keep the name of the Honorable John Lewis out of the Department of Justice&#8217;s mouth,&#8221; Richmond said.</p>
<p>Richmond also brought up an issue that Democrats have raised, regarding whether or not the president would leave office if he loses November&#8217;s election. Trump himself has refused to state whether he would accept the election results, claiming that the election would be rigged by a Democratic push for mail-in voting.</p>
<p>When asked if an election result could be contested, Barr pointed to 2000&#8217;s Gore v. Bush, in which the Supreme Court had to intervene before an outcome was finalized. When asked if the president could contest the election if the result is not close, Barr said, &#8220;Not that I&#8217;m aware of.&#8221;</p>
<p>Barr said that he has no reason to believe that the election will be rigged, although he did state that mail-in voting exposes the system to a high risk of fraud.</p>
<p>The hearing was also full of tension between Barr and Democratic lawmakers as they fought to speak over one another. The questioning from Reps. Lou Correa, D-Calif., and Mary Gay Scanlon, D-Pa., became particularly heated as kept trying to respond to their comments.</p>
<p>&#8220;This is a hearing,&#8221; Barr said. &#8220;I thought I was the one who was supposed to be heard?&#8221;</p>
<p>Jordan came to Barr&#8217;s defense when he questioned Nadler on why he was permitting Democratic lawmakers to interrupt the attorney general and not let him respond to questions.</p>

<p>&#8220;For months you&#8217;ve tried to get the attorney to come,&#8221; Jordan told Nadler. &#8220;He&#8217;s here. Why don&#8217;t you let him speak? Why don&#8217;t you let him answer the questions?&#8221;</p>
<p>Jordan continued: &#8220;If you want the attorney general to come at least let him answer the accusations made against him&#8230;Time after time you refuse to let the attorney general answer the questions posed to him.&#8221;</p>

But the truth behind this anarchy is another matter. There are powerful individuals, institutions, and maybe most important of all, media outlets that are working together to foment an overthrow of America. They desperately need to overthrow the presidency, the economy, and law and order in the United States because they&#8217;ve been exposed. It&#8217;s not like we didn&#8217;t know what they&#8217;d done nearly three years ago. We did and said as much. But the mainstream media has not gone anywhere near the truth. If you can stand it, take a look at the mainstream media. They&#8217;re explaining that what we&#8217;re seeing in all the looting and burning is righteous indignation. It&#8217;s not stealing, they explain, but “symbolic taking.” It&#8217;s reparations by force. Don&#8217;t you believe it.</p>
<p>The heroes of the deep state (<span style="color: #008000;"><em>you know many of their names</em></span>) are in life-changing legal trouble for having tried to overthrow the Presidency. It&#8217;s proven in the clearest terms by official reports of inspectors general, by released, formerly classified private testimony, and is available to those that know where to look. But the mainstream media is NOT the place to look. Why? As we&#8217;ve said before in numerous letters and weekly updates, they were in on it. They were promoting the overthrow, the impeachment, and every effort to make the masses HATE the President with all the passion they can muster.</p>
<p>They&#8217;re not through. They&#8217;re doing it right now as you read this. They&#8217;re playing the video and expressing their disgust at the police killing of George Floyd, over and over and over again. They tell you to, “Open your eyes, America.” It&#8217;s “systemic racism.” It&#8217;s evil capitalism which is inherently racist according to the daily propaganda.</p>
<p>They didn&#8217;t need to tell us to be disgusted and angry. We couldn&#8217;t even watch the whole video of that slow-motion, utterly unnecessary killing, with other police officers standing around with nothing better to do than loiter. IT OUTRAGED EVERY AMERICAN. They didn&#8217;t need to loot and burn everything they could get their hands on, beat and kill police officers, and try to burn down the White House in order that we understand. We already understood.</p>
<p>It&#8217;s being played as if this is the end game, and it might be if things are not immediately brought under control. This is quite a spectacle, not only for those of us who love the U. S. and the freedom bequeathed to us at God&#8217;s inspiration. From the standpoint of antifa, black lives matter, and most importantly the deep state, the United States must be overthrown NOW. They think they&#8217;ve got the upper hand, and every nation around the world is now wondering if this is the end of the USA.</p>
<p>The mainstream media, in league with the deep state, is all in. Evidence has come out that the effort to destroy the Trump Presidency was coordinated. There was collusion all right, but not the “collusion” they pushed into American living rooms for three years. It all fell apart. Mueller failed spectacularly, and the lies that had been spewed by the deep state and the media have been exposed in hearings, in the sham-impeachment, and by several extraneous sources, “fact-checked” or banned by the social media giants.</p>
<p>Most interested observers may still not know that the heroes of the deep state and the plot to destroy the Trump Presidency were saying one thing under oath, where it mattered from a legal standpoint, but were claiming to have evidence of “Russian collusion” every night on all the mainstream networks, and quoted under headlines designed to deceive the public into believing that Donald Trump, Michael Flynn, and ALL CONSERVATIVE THINKERS were aiding and abetting “RUSSIA.” It was a ridiculous lie, and they knew it. But these wretched TV anchors with their hooded eyes and angry demeanors claimed to know it to be the truth. They criticized and demeaned all who did not believe them. They called the truth a conspiracy theory as it came out. They&#8217;re still doing it. It&#8217;s a non-stop push, and it&#8217;s getting even worse going forward.</p>
<p>The big-name heroes of the deep state are in deep trouble of the legal variety. <p></strong>    You obviously don&#8217;t need to find out the details of rioting, looting, and arson, as it&#8217;s playing out LIVE wherever you look. But the truth behind this anarchy is another matter. There are powerful individuals, institutions, and maybe most important of all, media outlets that are working together to foment an overthrow of America. They desperately need to overthrow the presidency, the economy, and law and order in the United States because they&#8217;ve been exposed. It&#8217;s not like we didn&#8217;t know what they&#8217;d done nearly three years ago. We did and said as much. But the mainstream media has not gone anywhere near the truth. If you can stand it, take a look at the mainstream media. They&#8217;re explaining that what we&#8217;re seeing in all the looting and burning is righteous indignation. It&#8217;s not stealing, they explain, but “symbolic taking.” It&#8217;s reparations by force. Don&#8217;t you believe it.</p>
<p>The heroes of the deep state (<span style="color: #008000;"><em>you know many of their names</em></span>) are in life-changing legal trouble for having tried to overthrow the Presidency. It&#8217;s proven in the clearest terms by official reports of inspectors general, by released, formerly classified private testimony, and is available to those that know where to look. But the mainstream media is NOT the place to look. Why? As we&#8217;ve said before in numerous letters and weekly updates, they were in on it. They were promoting the overthrow, the impeachment, and every effort to make the masses HATE the President with all the passion they can muster.</p>
<p>They&#8217;re not through. They&#8217;re doing it right now as you read this. They&#8217;re playing the video and expressing their disgust at the police killing of George Floyd, over and over and over again. They tell you to, “Open your eyes, America.” It&#8217;s “systemic racism.” It&#8217;s evil capitalism which is inherently racist according to the daily propaganda.</p>
<p>They didn&#8217;t need to tell us to be disgusted and angry. We couldn&#8217;t even watch the whole video of that slow-motion, utterly unnecessary killing, with other police officers standing around with nothing better to do than loiter. IT OUTRAGED EVERY AMERICAN. They didn&#8217;t need to loot and burn everything they could get their hands on, beat and kill police officers, and try to burn down the White House in order that we understand. We already understood.</p>
<p>It&#8217;s being played as if this is the end game, and it might be if things are not immediately brought under control. This is quite a spectacle, not only for those of us who love the U. S. and the freedom bequeathed to us at God&#8217;s inspiration. From the standpoint of antifa, black lives matter, and most importantly the deep state, the United States must be overthrown NOW. They think they&#8217;ve got the upper hand, and every nation around the world is now wondering if this is the end of the USA.</p>
<p>The mainstream media, in league with the deep state, is all in. Evidence has come out that the effort to destroy the Trump Presidency was coordinated. There was collusion all right, but not the “collusion” they pushed into American living rooms for three years. It all fell apart. Mueller failed spectacularly, and the lies that had been spewed by the deep state and the media have been exposed in hearings, in the sham-impeachment, and by several extraneous sources, “fact-checked” or banned by the social media giants.</p>
<p>Most interested observers may still not know that the heroes of the deep state and the plot to destroy the Trump Presidency were saying one thing under oath, where it mattered from a legal standpoint, but we&#8217;re claiming to have evidence of “Russian collusion” every night on all the mainstream networks, and quoted under headlines designed to deceive the public into believing that Donald Trump, Michael Flynn, and ALL CONSERVATIVE THINKERS were aiding and abetting “RUSSIA.” It was a ridiculous lie, and they knew it. But these wretched TV anchors with their hooded eyes and angry demeanors claimed to know it to be the truth. They criticized and demeaned all who did not believe them. They called the truth a conspiracy theory as it came out. They&#8217;re still doing it. It&#8217;s a non-stop push, and it&#8217;s getting even worse going forward.</p>

<p class="css-h6rhrn">Donald Trump continued to fume over the Russia investigation on Sunday, more than a year after special counsel Robert Mueller filed his report without recommending charges against the president but only three days after the justice department said it would <a href="https://www.theguardian.com/us-news/2020/may/07/michael-flynn-criminal-case-trump-russia" data-link-name="in body link">drop its case against Michael Flynn</a>, Trump’s first national security adviser.</p>
<p class="css-h6rhrn">“The biggest political crime in American history, by far!” the president <a href="https://twitter.com/realDonaldTrump/status/1259493483733270530" data-link-name="in body link">wrote in a tweet</a> accompanying a conservative talk show host’s claim that Barack Obama “used his last weeks in office to target incoming officials and sabotage the new administration”.</p>
<p class="css-h6rhrn">The tweet echoed previous messages retweeted by Trump, which earned <a href="https://www.theguardian.com/media/2020/may/04/don-lemon-trump-cnn-coronavirus-conspiracy-theories" data-link-name="in body link">rebukes</a> for relaying conspiracy theories. On Sunday afternoon the president continued to send out a stream of tweets of memes and rightwing talking heads claiming an anti-Trump conspiracy. <a href="https://twitter.com/realDonaldTrump/status/1259561821289226248" data-link-name="in body link">One tweet by Trump simply read</a>: “OBAMAGATE!”</p>
<p class="css-h6rhrn">Trump fired Flynn, a retired general, in early 2017, for lying to Vice-President Mike Pence about conversations with the Russian ambassador regarding sanctions levied by the Obama administration in retaliation for interference in the 2016 election.</p>
<p class="css-h6rhrn">The US intelligence community has long held that such efforts were meant to tip the election towards Trump and away from Hillary Clinton, the Democratic nominee.</p>
<p class="css-h6rhrn">Flynn pleaded guilty to lying to the FBI – which Trump has <a href="https://twitter.com/realDonaldTrump/status/937007006526959618?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E937007006526959618&amp;ref_url=https%3A%2F%2Fwww.theguardian.com%2Fus-news%2F2020%2Fmay%2F07%2Fmichael-flynn-criminal-case-trump-russia" data-link-name="in body link">acknowledged</a> – and co-operated with Mueller, who was appointed to take over the investigation of Russian interference after Trump <a href="https://www.theguardian.com/us-news/2018/apr/12/james-comey-book-trump-unethical-untethered-to-truth-a-higher-loyalty" data-link-name="in body link">fired FBI director James Comey</a>.</p>
<p class="css-h6rhrn">Mueller did not establish a criminal conspiracy but did lay out extensive links between Trump and Moscow and <a href="https://www.theguardian.com/us-news/ng-interactive/2019/apr/18/mueller-report-trump-russia-key-takeaways" data-link-name="in body link">instances of possible obstruction of justice</a> by the president.</p>
<p class="css-h6rhrn">Flynn sought to change his plea while awaiting sentencing and the president championed his case, floating a possible pardon. On Thursday, in an act that stunned the US media, attorney general William Barr said the justice department would drop the case entirely.</p>

<p class="css-h6rhrn">Trump and his supporters have loudly trumpeted the decision and across Saturday and Sunday, the president unleashed a storm of retweets of supporters and conservative commentators attacking targets including Obama, Mueller, Comey, and House intelligence committee chair Adam Schiff.</p>
<p class="css-h6rhrn">The talk show host retweeted by the president, Buck Sexton, is a former CIA analyst who now <a href="https://podcasts.apple.com/us/podcast/the-buck-sexton-show/id1208232103" data-link-name="in body link">hosts a show</a> which he says “speaks truth to power, and cuts through the liberal nonsense coming from the mainstream media”.</p>
<p class="css-h6rhrn">In another message retweeted by the president, <a href="https://www.bucksexton.com/" data-link-name="in body link">Sexton</a> called former FBI deputy director Andrew McCabe – <a href="https://www.theguardian.com/us-news/2019/feb/12/the-threat-review-andrew-mccabe-fbi-trump" data-link-name="in body link">who Trump fired</a> just short of retirement – “a dishonorable partisan scumbag who has done incalculable damage to the reputation of the FBI and should be sitting in a cell for lying under oath”.</p>
<p class="css-h6rhrn"><a href="https://www.nytimes.com/2020/02/14/us/politics/andrew-mccabe-fbi.html" data-link-name="in body link">In February</a>, the US justice department said it would not charge McCabe over claims he lied to investigators about a media leak.</p>
<p class="css-h6rhrn"><a href="https://www.theguardian.com/us-news/2018/apr/12/james-comey-book-trump-unethical-untethered-to-truth-a-higher-loyalty" data-link-name="in body link">Like Comey</a>, McCabe released a book <a href="https://www.theguardian.com/us-news/2019/feb/08/rosenstein-did-not-want-to-write-memo-justifying-comey-firing-new-book" data-link-name="in body link">in which he was highly critical of Trump</a>, who he said acted like a mob boss. McCabe also wrote that Trump had unleashed a “strain of insanity” in American public life.</p>
<p class="css-h6rhrn">In his own tweets, Trump did not directly address <a href="https://www.theguardian.com/us-news/2020/may/09/obama-leaked-conversation-us-rule-of-law-at-risk-flynn-case-dropped" data-link-name="in body link">comments by Obama himself</a> which were reported by Yahoo News. The former president told associates the Flynn decision was “the kind of stuff where you begin to get worried that basic – not just institutional norms – but our basic understanding of rule of law is at risk”.</p>
<p class="css-h6rhrn">But Trump’s anger was evident.</p>
<p class="css-h6rhrn">“When are the Fake Journalists,” <a href="https://twitter.com/realDonaldTrump/status/1259450009734516736" data-link-name="in body link">he wrote on Sunday</a>, “who received unwarranted Pulitzer Prizes for Russia, Russia, Russia, and the Impeachment Scam, going to turn in their tarnished awards so they can be given to the real journalists who got it right. I’ll give you the names, there are plenty of them!”</p>
<p class="css-h6rhrn">The president did not immediately name anyone.</p>
<p class="css-h6rhrn">But in 2018 <a href="https://www.pulitzer.org/prize-winners-by-year/2018" data-link-name="in body link">the Pulitzer committee did</a>, awarding its prize for national reporting jointly to the Washington Post and the New York Times for “deeply sourced, relentlessly reported coverage in the public interest that dramatically furthered the nation’s understanding of Russian interference in the 2016 presidential election and its connections to the Trump campaign, the president-elect’s transition team, and his eventual administration.”</p>
<p class="css-h6rhrn">Trump has further reason to resent the Pulitzer committee and question its choices.</p>
<p class="css-h6rhrn"><a href="https://www.pulitzer.org/news/announcement-2019-pulitzer-prize-winners" data-link-name="in body link">In 2019</a>, for example, a New York Times team won a Pulitzer for an “exhaustive 18-month investigation of President Donald Trump’s finances that debunked his claims of self-made wealth and revealed a business empire riddled with tax dodges”.</p>
<p class="css-h6rhrn">The Wall Street Journal, meanwhile, was rewarded for “uncovering President Trump’s secret payoffs to two women during his campaign who claimed to have had affairs with him, and the web of supporters who facilitated the transactions, triggering criminal inquiries and calls for impeachment”.</p>
<p class="css-h6rhrn">Trump’s actual impeachment, which he survived at trial in the Senate in February, concerned his attempts to have Ukraine investigate his political rivals. No reporter or news outlet won a 2020 Pulitzer, <a href="https://www.pulitzer.org/prize-winners-by-year/2020" data-link-name="in body link">announced this week</a>, for its coverage of that affair.</p>
<p class="css-h6rhrn">Trump’s focus on Sunday remained largely on the Russia investigation despite continuing developments in the coronavirus outbreak, which has infected more than 1.3m Americans and killed nearly 80,000.</p>
<p class="css-h6rhrn">With cases confirmed among White House aides close to the president, top public health experts <a href="https://www.theguardian.com/world/2020/may/10/anthony-fauci-self-quarantine-donald-trump" data-link-name="in body link">including Dr. Anthony Fauci in quarantine</a> and Trump reported by the New York Times to be “<a href="https://www.nytimes.com/2020/05/10/us/politics/white-house-coronavirus-trump.html" data-link-name="in body link">spooked</a>”, the president claimed in a rare non-Russia-related tweet: “We are getting great marks for the handling of the CoronaVirus pandemic.”</p>
<p class="css-h6rhrn">He also attacked Obama and his vice-president, Joe Biden, the presumptive Democratic nominee for president this year, over their response to the “disaster known as H1N1 Swine Flu” <a href="https://obamawhitehouse.archives.gov/realitycheck/the-press-office/declaration-a-national-emergency-with-respect-2009-h1n1-influenza-pandemic-0" data-link-name="in body link">in 2009</a>.</p>
<p class="css-h6rhrn">Trump also marked a special day in the calendar, <a href="https://twitter.com/realDonaldTrump/status/1259455786482311168" data-link-name="in body link">tweeting in trademark capitals</a>: “HAPPY MOTHER’S DAY!”</p>

										<content:encoded><![CDATA[<p>The Justice Department on Thursday moved to drop its case against former National Security Adviser Michael Flynn, in a stunning development that comes after internal memos were released raising serious questions about the nature of the investigation that led to <a href="https://www.foxnews.com/politics/michael-flynn-prosecution-a-timeline-of-trumps-ex-national-security-advisers-case" target="_blank" rel="noopener noreferrer">Flynn’s</a> late 2017 guilty plea of lying to the FBI.</p>
<p class="speakable">The announcement came in a court filing, with the department saying it is dropping the case &#8220;after a considered review of all the facts and circumstances of this case, including newly discovered and disclosed information.&#8221; The DOJ said it had concluded that Flynn&#8217;s interview by the FBI was &#8220;untethered to, and unjustified by, the FBI&#8217;s counterintelligence investigation into Mr. Flynn&#8221; and that the interview was &#8220;conducted without any legitimate investigative basis.&#8221;</p>
<p><strong><a href="https://www.foxnews.com/politics/read-dojs-motion-to-dismiss-charges-against-michael-flynn" target="_blank" rel="noopener noreferrer">READ: DOJ MOTION TO DISMISS FLYNN CASE</a></strong></p>
<p>The federal judge overseeing the case would have to make the final determination to dismiss the case.</p>
<p>The retired Army lieutenant general for months has been trying to <a href="https://www.foxnews.com/politics/michael-flynn-prosecution-a-timeline-of-trumps-ex-national-security-advisers-case" target="_blank" rel="noopener noreferrer">withdraw</a> his plea, aided by a new attorney who has aggressively challenged the prosecution’s case and conduct. But the case has been plodding through the court system with no resolution ever since his original plea, even amid <a href="https://www.foxnews.com/politics/flynn-bombshell-stirs-speculation-over-possible-dismissal-pardon" target="_blank" rel="noopener noreferrer">speculation</a> about whether President Trump himself could extend a pardon.</p>
<p><a href="https://www.foxnews.com/politics/mueller-prosecutor-removed-from-flynn-case-after-questions-surface-concerning-his-compliance-with-court-order" target="_blank" rel="noopener noreferrer"><strong>MUELLER PROSECUTOR WITHDRAWS FROM FLYNN CASE AFTER QUESTIONS SURFACE CONCERNING HIS COMPLIANCE WITH COURT ORDER</strong></a></p>
<p>The DOJ decision would appear to put an end to that process.</p>
<p>Earlier Thursday, the top prosecutor on the case, Brandon Van Grack, abruptly withdrew from the case, without explanation, in a brief filing with the court.</p>

<p>Breadcrumbs were being dropped in the days preceding the decision that his case could be reconsidered. Documents unsealed a week ago by the Justice Department revealed agents discussed their motivations for interviewing him in the Russia probe—questioning whether they wanted to“get him to lie” so he&#8217;d be fired or prosecuted, or get him to admit wrongdoing. Flynn allies howled over the revelations, arguing that he was essentially set up in a perjury trap. In that interview, Flynn did not admit wrongdoing and instead was accused of lying about his contacts with the then-Russian ambassador – to which he pleaded guilty.</p>
<p>The latest DOJ filing stated noted Flynn&#8217;s false statement plea pertains to a crime that requires a statement &#8220;to be not simply false, but &#8216;materially&#8217; false with respect to a matter under investigation.&#8221; The filing said the government &#8220;is not persuaded that the January 24, 2017 interview was conducted with a legitimate investigative basis and therefore does not believe Mr. Flynn&#8217;s statements were material even if untrue.&#8221;</p>
<p>The U.S. attorney reviewing the Flynn case, Jeff Jensen, recommended dropping the case to Attorney General William Barr last week and formalized the recommendation in a document this week.</p>
<p>&#8220;Through the course of my review of General Flynn&#8217;s case, I concluded the proper and just course was to dismiss the case,&#8221; Jensen said in a statement. &#8220;I briefed Attorney General Barr on my findings, advised him on these conclusions, and he agreed.&#8221;</p>
<p>Meanwhile, on Wednesday, the DOJ released a mostly unredacted version of former acting Attorney General Rod Rosenstein’s August 2017 “scope memo,” outlining the authority then-Special Counsel Robert Mueller had for his investigation. That document revealed for the first time that Mueller’s authority went significantly beyond what was previously known.</p>
<p>Rosenstein’s memo was known to have authorized Mueller to probe “any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump,” and “any matters that arose or may arise directly from the investigation,” and “any other matters within the scope of [obstruction of justice laws].”</p>
<p>But the new document made clear that Rosenstein authorized a deep-dive criminal probe into the Trump campaign that extended well beyond Russian interference efforts.</p>
<p>The memo revealed that Mueller was, among other things, looking into whether Flynn “committed a crime or crimes by engaging in conversations with Russian government officials during the period of the Trump transition.”</p>
<p>That was an apparent reference to the Logan Act, which is an obscure statute that has never been successfully used in a criminal prosecution and was intended to prevent individuals from falsely claiming to represent the United States government abroad.</p>
<p><strong><a href="https://www.foxnews.com/politics/michael-flynn-prosecution-a-timeline-of-trumps-ex-national-security-advisers-case" target="_blank" rel="noopener noreferrer">MICHAEL FLYNN PROSECUTION: A TIMELINE OF TRUMP&#8217;S EX-NATIONAL SECURITY ADVISER&#8217;S CASE</a></strong></p>
<p>Meanwhile, the handwritten notes showing agents discussing his interview &#8212; which were penned by the FBI’s former head of counterintelligence Bill Priestap after a meeting with then-FBI Director James Comey and then-FBI Deputy Director Andrew McCabe &#8212; caused even bigger reverberations for the case.</p>
<p>The notes, released last week, showed agents considered various options in the run-up to the fateful January 2017 interview, including getting Flynn “to admit to breaking the Logan Act” when he spoke to former Russian Ambassador Sergey Kislyak during the presidential transition period.</p>
<p>&#8220;What is our goal?&#8221; one of the <a href="https://twitter.com/Techno_Fog/status/1255627278249349122">notes</a> read. &#8220;Truth/Admission or to get him to lie, so we can prosecute him or get him fired?”</p>
<p>&#8220;If we get him to admit to breaking the Logan Act, give facts to DOJ + have them decide,&#8221; another <a href="https://twitter.com/Techno_Fog/status/1255628331137019904/photo/1">note</a> read. The memo appears to weigh the pros and cons of pursuing those different paths, while cautioning: &#8220;If we’re seen as playing games, WH [White House] will be furious.”</p>
<p>Aside from swiftly being ensnared in Mueller’s investigation in the fallout from that interview, Flynn was fired from his prominent post as national security adviser in February 2017. The resignation came as he was accused of misleading Vice President Pence and other senior White House officials about his communications with Kislyak.</p>
<p>Flynn’s communications with Kislyak in December 2016 had been picked up in wiretapped discussions, unbeknownst to him. The FBI agents in January 2017 questioned him on the communications and later used his answers to form the basis for the false statement charge and his guilty plea.</p>
<p>Flynn&#8217;s supporters have insisted he is innocent but was pressured to plead guilty when his son was threatened with prosecution and he exhausted his financial resources. The release of the handwritten FBI notes fueled accusations from Flynn&#8217;s defenders that agents did not conduct themselves properly in the case.</p>
<p><a href="https://www.foxnews.com/politics/now-imperiled-case-against-flynn-cost-him-millions-of-dollars-his-house-his-job" target="_blank" rel="noopener noreferrer"><strong>NOW-IMPERILED CASE AGAINST FLYNN COST HIM MILLIONS OF DOLLARS, HIS HOUSE, JOB</strong></a></p>
<p>Meanwhile, the Rosenstein scope memo further authorized a Foreign Agents Registration Act (FARA) review into Flynn&#8217;s dealings with Turkey. Prosecutors have <a href="https://www.nbcnews.com/politics/national-security/mueller-gives-new-details-flynn-s-secretive-work-turkey-n943926">suggested</a> Flynn&#8217;s guilty plea on one count of false statements to the FBI is what allowed him to escape liability for a possible FARA charge &#8212; in other words, the FARA case may have provided leverage.</p>
<p>FARA prosecutions have picked up dramatically in recent years, and prosecutor Van Grack, who led the DOJ’s case against Flynn, was appointed to head up the new FARA unit at the Justice Department in 2019.</p>
<p>Van Grack has been <a href="https://www.foxnews.com/politics/flynn-evidence-calls-into-question-statements-by-former-special-counsel-brandon-van-grack">under scrutiny</a> for claiming to a federal court that he had turned over all relevant exculpatory informing involving Flynn &#8212; even though a slew of “exculpatory” documents <a href="https://www.foxnews.com/politics/flynn-evidence-calls-into-question-statements-by-former-special-counsel-brandon-van-grack">surfaced</a> last week.</p>
<p>The case has come at an enormous cost for the retired three-star Army lieutenant general and his family, as he racked up millions of dollars in legal bills, was forced to sell his house, lost his job, and saw his reputation sullied.</p>
<p>Attorney Sidney Powell told Fox News last week that Flynn paid his first law firm, Covington &amp; Burling, approximately $3.5 million. It is unclear the total amount of Flynn’s legal bills, but reports suggested last year that he had more than $4.6 million in unpaid legal bills at that time.</p>
<p>Flynn earlier this year moved to withdraw his guilty plea for making false statements to the FBI regarding his communications with Kislyak. His legal team, at the time, said that the move was “because of the government’s bad faith, vindictiveness and breach of the plea agreement.”</p>
<p>In December 2017, and on the brink of financial ruin, Flynn was forced to put his home in Old Town Alexandria, Va.—located just outside Washington D.C.—on the market with an asking price of $895,000 to pay his mounting legal bills.</p>
<p>According to <a href="https://www.zillow.com/homedetails/411-N-Pitt-St-Alexandria-VA-22314/192157219_zpid/">Zillow, </a>the townhouse sold for $819,995 in September 2018. Powell confirmed the sale of the house to Fox News.</p>

										<content:encoded><![CDATA[<p>As federal <span class="link"><a href="https://www.cbsnews.com/news/suspicious-packages-former-fbi-profiler-says-theres-an-arrogance-to-coordinated-attack/" target="_blank" rel="noopener" data-invalid-url-rewritten-http="">investigators work to discover</a></span> who&#8217;s behind the <a href="https://www.cbsnews.com/live-news/suspicious-packages-sent-pipe-bombs-in-mail-democrats-cnn-nyc-de-niro-latest-live-updates/" target="_blank" rel="noopener" data-invalid-url-rewritten-http="">pipe bombs mailed</a> to a number of <span class="link"><a href="https://www.cbsnews.com/news/recipients-of-suspicious-packages-have-been-criticized-by-trump-in-the-past/" target="_blank" rel="noopener" data-invalid-url-rewritten-http="">prominent Trump critics</a></span>, some right-wing figures were quick to float the theory that it&#8217;s all a politically motivated &#8220;false flag&#8221; planted by Democrats to make Republicans look bad. Without offering evidence, a handful of commentators raised the possibility, pointing out the coincidence of the timing two weeks before the midterms and the recipients&#8217; political affiliations.</p>
<p>The FBI is currently <span class="link"><a href="https://www.cbsnews.com/news/suspicious-packages-former-fbi-profiler-says-theres-an-arrogance-to-coordinated-attack/" target="_blank" rel="noopener" data-invalid-url-rewritten-http="">investigating the devices</a></span> and has not yet identified a suspect or motive.</p>
<p>While the news was still unfolding Wednesday, radio host <a href="https://www.rushlimbaugh.com/daily/2018/10/24/there-are-no-coincidences-with-the-clintons/" target="_blank" rel="noopener">Rush Limbaugh</a> aired the theory on his show. When a caller said &#8220;my gut is telling me this is a left wing smoke screen,&#8221; Limbaugh didn&#8217;t disagree, suggesting that a Democrat was more likely to have sent the explosives than a Republican because &#8220;things are not working out the way they thought&#8221; for the party.</p>
<p>Right-wing commentator Bill Mitchell went further, calling the bomb scare &#8220;<a href="https://twitter.com/mitchellvii/status/1055117930944446465" target="_blank" rel="noopener">false flag BS</a>&#8221; and flooding his Twitter feed with claims that Democrats are to blame.</p>
<p>&#8220;Tip to Democrats: If you&#8217;re gonna mail fake bombs to yourself, don&#8217;t do it in bomb-shaped envelopes without a postmark. Looks fishy,&#8221; he <a href="https://twitter.com/mitchellvii/status/1055178583839330305" target="_blank" rel="noopener">tweeted</a>.</p>
<p>Ann Coulter, the provocative author and commentator, <a href="https://twitter.com/AnnCoulter/status/1055121317911965696" target="_blank" rel="noopener">tweeted</a> her observation that, &#8220;From the Haymarket riot to the Unibomber, bombs are a liberal tactic.&#8221;</p>
<p>The false flag theory also spread to a wider audience on Fox News Wednesday when a former FBI profiler, Jim Fitzgerald, brought up the &#8220;false flag&#8221; possibility on air. He said, &#8220;It could be someone in there, some Democrat, low-level person &#8230; who just decided, you know what, I&#8217;m going to put this out, because two weeks before a major election, who&#8217;s going to look like the bad guy here? The Republicans.&#8221; Host Martha MacCallum replied, &#8220;Fascinating.&#8221;</p>
<p>MacCallum later pointed out in a tweet that Fitzgerald &#8220;cited different avenues investigators will pursue to catch this bomber, starting with the most obvious: a republican who is out to get democrats&#8221; as well as the &#8220;less likely he said, insider angle.&#8221;</p>

<p>Another prominent conservative voice, <a href="https://michaelsavage.com/savage-mail-bombs-are-false-flag-to-distract-from-hordes-of-illegal-aliens/" target="_blank" rel="noopener">Michael Savage</a>, said, &#8220;It&#8217;s a high probability that the whole thing is set up as a false flag to gain sympathy for the Democrats&#8230; and to get our minds off the hordes of illegal aliens approaching our southern border.&#8221;</p>
<h3><strong>What is a false flag?</strong></h3>
<p>The term originally referred to pirate ships that flew flags of countries as a disguise to prevent their victims from fleeing or preparing for battle.</p>
<p>According to the <a href="https://www.adl.org/news/article/boston-bombing-prompts-extremist-conspiracy-theories" target="_blank" rel="noopener">Anti-Defamation League</a>, it&#8217;s a concept frequently used by the &#8220;anti-government extremist &#8216;patriot&#8217; movement&#8221; to discredit terrorist activities. &#8220;&#8216;False flag operations are incidents staged by a government but blamed on some other government or entity as a pretext to curtail civil liberties or justify military action,&#8221; the ADL explains.</p>
<p>In the online context, conspiracy theorists often point to &#8220;false flags&#8221; when an official explanation doesn&#8217;t fit their world view.</p>
<p>Sarah Sobieraj, a sociology professor at Tufts University, told CBS News that the dissemination of such a theory without evidence can be &#8220;toxic,&#8221; especially with midterms coming up soon.</p>

<p>After months of criticizing special counsel Robert Mueller’s Russia probe, President Donald Trump’s supporters are issuing increasingly bold calls for presidential pardons to limit the investigation’s impact.</p>
<p>“I think he should be pardoning anybody who’s been indicted and make it clear that anybody else who gets indicted would be pardoned immediately,” said Frederick Fleitz, a former CIA analyst and senior vice president at the conservative Center for Security Policy.</p>
<div class="story-interrupt format-s pos-alpha predetermined fixed-story-third-paragraph">The pleas for mercy mainly extend to the four former Trump aides who have already been swept up in the Russia probe: former campaign manager Paul Manafort, former deputy campaign manager Rick Gates, former national security adviser Michael Flynn and former campaign foreign policy adviser George Papadopoulos. But they don’t stop there.</p>

<p>“It’s kind of cruel what’s going on right now and the president should put these defendants out of their misery,” said Larry Klayman, a conservative legal activist. “I think he should pardon everybody — and pardon himself.”</p>
<p>Klayman and Fleitz spoke before Mueller indicted thirteen Russian nationals on Friday for staging an elaborate 2016 election interference operation in the United States. Democratic leaders said the hard evidence of Russian meddling underscores the importance of letting Mueller’s investigation run its course.</p>
<p>But many conservatives note that the new indictment shows no evidence of collusion between Trump associates and the Kremlin. That reinforces their view that Mueller’s real target, if any, should be Russian President Vladimir Putin — not Trump’s circle. “[H]ow long will the leftist witch hunt against @RealDonaldTrump continue,” the president’s son, Donald Trump Jr., <a href="https://twitter.com/DonaldJTrumpJr/status/964631095819030528" target="_blank" rel="noopener">tweeted</a> hours after the indictment’s release.</p>
<p>And while the latest indictment could make it harder than ever for Trump to fire Mueller, as he has sought to before, mass pardons would be another means of defying the special counsel.</p>
<p>A president has the Constitutional power to pardon any citizen convicted of a federal crime, ending any prison sentence and clearing his or her record with the stroke of a pen. Pardons face no judicial or Congressional review, and the president is not obliged to explain his decision. The act of a president pardoning himself, however, has never been tested.</p>
<p>Some Democrats are taking all the possibilities seriously.</p>
<p>“Doling out presidential pardons to try to cover up any collusion or obstruction of justice is unacceptable and will be met with furious resistance across the country,” Patty Murray, the third-ranking Democrat in the Senate, <a href="https://www.youtube.com/watch?v=ZLew6r5VUSw&amp;feature=youtu.be" target="_blank" rel="noopener">said</a> during a floor speech earlier this month.</p>
<p>Last fall, several dozen House Democrats co-sponsored a largely symbolic <a href="https://bass.house.gov/sites/karenbass.house.gov/files/Prevent%20POTUS%20from%20pardoning%20himself%20and%20Family.pdf" target="_blank" rel="noopener">resolution</a> expressing disapproval for the prospect of Trump pardoning himself or any of his family members. They’ve also been <a href="https://democrats-judiciary.house.gov/sites/democrats.judiciary.house.gov/files/documents/HJC%20Dems%20letter%20to%20Goodlatte%20re%20pardon%20power.pdf" target="_blank" rel="noopener">asking</a> without success for Judiciary Committee oversight hearings on the issue.</p>
<p>So far, the talk of pardons has mostly centered around Flynn, whose clemency Trump did not rule out in a brief mid-December exchange with reporters. “I don’t want to talk about pardons with Michael Flynn yet. We’ll see what happens,” Trump said.</p>
<p>That “yet” was music to the ears of Flynn’s supporters and family members, many of whom have taken to social media to build support for pardoning the retired Army lieutenant general who pleaded guilty in December to Mueller’s team for lying to the FBI.</p>
<p>“About time you pardoned General Flynn who has taken the biggest fall for all of you given the illegitimacy of this confessed crime in the wake of all this corruption,” Flynn’s brother, Joseph Flynn, wrote in a mid-December tweet. “Pardon Flynn NOW!” he added in a later <a href="https://twitter.com/JosephJFlynn1/status/941897512402632709" target="_blank" rel="noopener">message</a>.</p>
<p>During a video <a href="https://www.pscp.tv/w/1kvJpWDrWLDGE" target="_blank" rel="noopener">interview</a> with the prominent alt-right activist Jack Posobiec at the Trump International Hotel in Washington D.C., last week, Flynn’s outspoken adult son, Michael Flynn Jr., encouraged viewers to promote online messages calling for his father’s exoneration and pardon.</p>
<p>“Just keep pushing out those hashtags, the ‘#ClearFlynnNow’ and the ‘#PardonFlynnNow,” Flynn Jr., said.</p>
<p>Tom Fitton, president of the conservative activist group Judicial Watch, said that allegations of anti-Trump bias among Justice Department and FBI officials circulated by conservatives would justify granting clemency to Trump associates like Flynn.</p>
<p>“The whole super structure of the Russia investigation is compromised,” Fitton said. “Those caught up in it deserve some protection. Rather than just let the virus run its course, it’d be appropriate for the president to consider pardons for people who are caught up in the prosecution.”</p>
<p>Trump’s lawyers and aides insist it’s premature to discuss even the possibility of pardons. “There have been no pardon discussions at the White House,” Ty Cobb, the White House attorney who leads the president’s official response to the Russia investigation, told POLITICO on Friday just hours before Mueller’s latest indictment was released.</p>
<p>After the Washington Post reported in July that Trump had tasked his aides with researching his pardon powers, Trump dismissed the story — while also making clear his view of the law.</p>
<p>“While all agree the U. S. President has the complete power to pardon, why think of that when only crime so far is LEAKS against us. FAKE NEWS,” Trump <u>tweeted</u>.</p>
<p>Attorneys for Flynn, Flynn Jr. and Gates declined comment. Lawyers for Manafort and Papadopoulos did not respond to requests for comment.</p>
<p>Presidential pardons or other acts of mercy can be highly controversial — and typically occur at the end of a president’s term.</p>
<p>President Barack Obama was criticized for commuting the 35-year prison sentence of Army Pvt. Chelsea Manning, who was convicted of leaking hundreds of thousands of sensitive diplomatic cables and military reports to WikiLeaks.</p>
<p>Siding against his own vice president, President George W. Bush denied a pardon for former White House staffer I. Lewis “Scooter” Libby, who was convicted for obstructing a federal investigation into the leaked identity of a CIA operative, though Bush did commute Libby’s prison sentence.</p>
<p>Perhaps most famously, in September 1974, President Gerald Ford pre-emptively pardoned the man he replaced in the Oval Office, Richard Nixon, who resigned rather than face impeachment over the Watergate scandal. Nixon had also stepped down just days after an<a href="https://www.justice.gov/file/20856/download" target="_blank" rel="noopener"> opinion</a> from his acting attorney general, Mary C. Lawton, found that “under the fundamental rule that no one may be a judge in his own case, the President cannot pardon himself.”</p>
<p>Explaining the Nixon pardon, Ford cited a need for the country to avoid “prolonged and divisive debate” that would accompany the criminal trial of the former Republican president that many expected. He also<b> </b><a href="https://archive.nytimes.com/www.nytimes.com/learning/general/onthisday/big/0908.html" target="_blank" rel="noopener">decreed</a> that his pardon would cover all federal crimes that Nixon &#8220;committed or may have committed or taken part in” as president.</p>
<p>Critics were furious at the move, which a New York Times editorial <a href="http://www.nytimes.com/1974/09/09/archives/the-failure-of-mr-ford.html" target="_blank" rel="noopener">declared</a> a &#8220;profoundly unwise, divisive, and unjust act.”</p>
<p>A federal district court <a href="http://www.ucs.louisiana.edu/~ras2777/conlaw/murphy.html" target="_blank" rel="noopener">rejected</a> a constitutional challenge to Ford’s pardon the next year, citing an 1867 Supreme Court decision during the Andrew Johnson administration which held that presidents have “unlimited” pardoning power. “It extends to every offense known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment,” the justice writing for the 5-4 majority wrote.</p>
<p>Some conservatives want Trump to heed those words. In an Oct. 29 Wall Street Journal op-ed column — published on the eve of Mueller’s first indictments against Manafort and Gates and the release of the Papadopoulos guilty plea<b> </b>—<b> </b>two conservative lawyers <a href="https://www.wsj.com/articles/begging-your-pardon-mr-president-1509302308" target="_blank" rel="noopener">called on</a> Trump to “end this madness by immediately issuing a blanket presidential pardon to anyone involved in supposed collusion with Russia or Russians during the 2016 presidential campaign… and to anyone for any offense that has been investigated by Mr. Mueller’s office.”</p>
<p>“The president himself would be covered by the blanket pardon we recommend,” <a href="https://www.wsj.com/articles/begging-your-pardon-mr-president-1509302308" target="_blank" rel="noopener">wrote</a> the lawyers, David B. Rivkin Jr. and Lee A. Casey, veterans of the White House counsel’s office and Justice Department in the Reagan and George H.W. Bush administrations. They argued that Russian election interference is a matter for a Congressional investigation, not a criminal one.</p>
<p>At a mid-November hearing of the House Judiciary Committee, Rep. Ted Deutch (D-Fla.) grilled Attorney General Jeff Sessions on whether he thinks Trump can pardon former aides and family members even before they might be convicted of — or even charged with — crimes. Sessions declined to answer beyond saying that “the president has the power to pardon, no doubt about that.”</p>
<p>&#8220;We should be worried if you are telling us the president should be able to pardon in advance all of those being investigated,&#8221; Deutch replied.</p>
<p>Trump has <a href="https://www.justice.gov/pardon/pardons-granted-president-donald-trump" target="_blank" rel="noopener">issued</a> one pardon since taking office, to the controversial Arizona Sheriff Joe Arpaio, who was facing criminal contempt of court charges for defying a court order to stop profiling Latinos.</p>
<p>That August action, in the face of strong political opposition, makes some conservatives think that Trump would be willing to defy his critics again. “He did it for Sheriff Joe, so I’m thinking he would do it for other circumstances as well,” Fitton said.</p>
<p>There has been little sign of Congressional Republican support for the idea of pardons. In the days after Flynn pleaded guilty, South Carolina Senators Lindsey Graham and Tim Scott both urged Trump not to pardon Flynn. Scott said it is important to have accountability and “a process that is clear and transparent.”</p>
<p>Pardons would also come at a high political cost, former George W. Bush White House spokesman Ari Fleischer said. “It’d just raise even more questions about Donald Trump if he pardons those closest to him because people will think he’s trying to protect himself.”</p>
<p>“You should let justice run its course,” he added.</p>
<p>Even some conservatives who support pardons in principle are wary of the severe political backlash they are certain to trigger.<b> </b>Mike Cernovich, a conservative activist who has been affiliated with the alt-right but rejects that label, said he believes the moment for pardons has passed and that Trump needs to wait until after the November mid-term elections.</p>
<p>“If the Democrats take over, pardon everyone,” Cernovich said. “They’re coming for you anyway. They have their nuke with impeachment. You have your nuke with pardons. And then settle in for an interesting two years.”</p>

										<content:encoded><![CDATA[<p>Last week, we discovered that former national security adviser Michael Flynn lied to the FBI about the import of what he told it regarding his contacts with former Russian Ambassador Sergey Kislyak. Yet Flynn once served as director of the Defense Intelligence Agency during the presidency of Barack Obama. Why would he lie to the FBI about what passed between him and Kislyak? Had he forgotten that, for a certitude, the conversation of a Russian ambassador was being recorded secretly by American intelligence agencies? Moreover, when he was being interviewed by the FBI, why did he not bring with him a lawyer? When I was being interviewed by the FBI about my perfidious Arkansas Project, I most certainly brought a lawyer with me, and it helped that my lawyer looked like he once worked for Don Corleone. Thinking back on it, I should have brought two lawyers.</p>
<p>We are told Flynn is now cooperating with the government. Yet it appears that he has implicated President Donald Trump not at all, or at least in no criminal activity. So what is the fuss all about? Flynn presumably was acting on behalf of people high up in the Trump administration, but unless they were giving Kislyak state secrets or accepting bribes from him, there is nothing wrong with that. I have in my library the memoirs of Anatoly Dobrynin for recreational reading. Dobrynin was the ambassador representing the Soviet Union for 24 years in Washington, DC, during the Cold War. In his memoirs, the ambassador writes of meeting with then-President Jimmy Carter’s representative Averell Harriman in September 1976 before the November election. He met with other Carter advisers before and after the election. Doubtless he did the same with other presidential emissaries during his long years in Washington. No one was prosecuted. In those happy years, diplomatic contacts were not adjudged criminal acts.</p>
<p>How did the Russians become such an ominous force in American elections, or at least in the tragic election of 2016? I would direct you to turn to page 395 of Shattered: Inside Hillary Clinton’s Doomed Campaign, the highly acclaimed chronicle of that epochal election written by Jonathan Allen and Amie Parnes.</p>
<p>On election night, Hillary Clinton may have been gently soused, but slowly even she saw the light. The authors tell us that in the days after the election, she “kept pointing her finger at Comey and Russia.” It was the beginning of her post-election “strategy.” The authors proceed to say, “That strategy had been set in motion within twenty-four hours of her concession speech.” Despite her Karamazovian hangover, she and her aides “went over the script they would pitch to the press and the public.” And “Already, Russian hacking was the centerpiece of the argument.” From that point on, Clinton and her aides kept flogging it.</p>
<p>Today even the FBI has taken up Clinton’s strategy, but nothing has implicated Trump, and no White House grandee is implicated in a Russian-related crime. As of this weekend, we know that a Clinton supporter working high up in the FBI, Peter Strzok, shaped then-Director James Comey’s relatively lenient — if improper — judgment of her handling of emails. Additionally, before Strzok was demoted, he had a role in investigating the Trump campaign and Russia. The FBI has a lot to answer for, and it ought to be investigated itself.</p>
<p>As for the Russians, they now have more say in Washington than at any time I can remember. Those in Official Washington who have adopted Clinton’s strategy have made Kislyak a powerful force in the Trump investigation and his boss, Russian President Vladimir Putin, quite possibly the most powerful man in the world. Together they have power over the Trump administration through their willing agents in the FBI and the office of special counsel Robert S. Mueller III.</p>
<p>All Kislyak has to do is dispute what Flynn told him, or for that matter, what some other personage in the administration told him. From Mueller’s public statements there is no hint that the FBI doubts Kislyak’s good word. It is the administration’s word that the FBI finds dubious. Kislyak could tell investigators that Flynn or some other administration aide had sent him a letter or expressed himself through “body language.” Off the FBI would go chasing after Kislyak’s lead. And, by the way, other Russians could insist that they had conspired with Trump’s people in private conversations that no intelligence agency of the federal government apprehended. Flynn’s fate might well be just the beginning. This investigation ought to be shut down somehow. Mueller is compromised, and the FBI appears complicitous in Hillary Clinton’s strategy.</p>
