<p class="gnt_ar_b_p">X said the law known as the Stop Hiding Hate Act violated the First Amendment and state constitution by subjecting it to lawsuits and heavy fines unless it disclosed &#8220;highly sensitive and controversial speech&#8221; that New York may find objectionable.</p>
<p class="gnt_ar_b_p">Deciding what content is acceptable on social media platforms &#8220;engenders considerable debate among reasonable people about where to draw the correct proverbial line,&#8221; X said. &#8220;This is not a role that the government may play.&#8221;</p>

										<content:encoded><![CDATA[<p>So much for “no means no.”</p>
<p>That’s the message from the state Court of Appeals, which ruled last week that New Yorkers don’t need an excuse to cast an absentee ballot by mail when they’re otherwise able to vote in person — even though the voters themselves have directly rejected such a measure.</p>
<p>Mail-in voting is hardly a revolutionary idea: Oregon since 2000 has conducted elections exclusively by mail, and several other states have followed, including Vermont.</p>
<p>But it involves an important balancing act, as state officials seek to maximize election participation while minimizing — <a href="https://nypost.com/2023/11/05/metro/connecticut-judge-orders-new-bridgeport-mayoral-primary-after-videos-showed-possible-ballot-stuffing/">to varying levels of success</a> — fraud.</p>
<p>That’s what made the new ruling from New York’s top court so problematic.</p>

										<content:encoded><![CDATA[<h4>The U.S. Geological Survey initially measured the earthquake at a 4.8-magnitude.</h4>
<p class="">An earthquake struck the East Coast of the United States on Friday morning, according to the U.S. Geological Survey, causing buildings to shake and rattling nerves from Maryland to Maine.</p>
<p class="">The USGS<a href="https://earthquake.usgs.gov/earthquakes/map/?extent=21.69827,-130.16602&amp;extent=51.99841,-59.85352" target="_blank" rel="noopener"> measured the quake as a 4.8 temblor</a> with its epicenter near Lebanon, New Jersey. It struck a little before 10:30 a.m. ET.</p>
<p class="">The earthquake was the strongest recorded in the Northeast in more than a decade, <a href="https://earthquake.usgs.gov/earthquakes/map/?extent=31.84023,-100.19531&amp;extent=51.6998,-50.97656&amp;range=search&amp;sort=largest&amp;timeZone=utc&amp;search=%7B%22name%22:%22Search%20Results%22,%22params%22:%7B%22starttime%22:%222011-01-01%2000:00:00%22,%22endtime%22:%222024-04-05%2023:59:59%22,%22maxlatitude%22:47.636,%22minlatitude%22:39.232,%22maxlongitude%22:-65.918,%22minlongitude%22:-80.728,%22minmagnitude%22:2.5,%22orderby%22:%22time%22%7D%7D" target="_blank" rel="noopener">according to USGS records</a>.</p>
<p class="">There were no immediate reports of major destruction or any fatalities. Local and regional officials from cities in the earthquake zone said inspections had been launched to ensure that buildings, bridges and other infrastructure were not damaged.</p>

<p class="paragraph inline-placeholder" data-uri="archive.cms.cnn.com/_components/paragraph/instances/paragraph_F1917E8B-73C1-4C7C-455B-2CA2E9D2F46A@published" data-editable="text" data-component-name="paragraph" data-analytics-observe="off">The mandate, which has<a href="https://www.ny1.com/nyc/all-boroughs/news/2022/09/23/pba-covid-19-vaccine-mandate-ruling" target="_blank" rel="noopener"> prompted numerous lawsuits</a>, is set to end on Friday after the city’s Board of Health adopts amendments to the city’s vaccination policy, City Hall said in a news release.</p>
<p class="paragraph inline-placeholder" data-uri="archive.cms.cnn.com/_components/paragraph/instances/paragraph_12C07B10-8157-E751-9470-2CA2E9D6768E@published" data-editable="text" data-component-name="paragraph" data-analytics-observe="off">“With more than 96% of city workers and more than 80 percent of New Yorkers having received their primary Covid-19 series and more tools readily available to keep us healthy, this is the right moment for this decision. I continue to urge every New Yorker to get vaccinated, get boosted, and take the necessary steps to protect themselves and those around them from Covid-19,” Democratic Mayor Eric Adams said in a statement.</p>
<p class="paragraph inline-placeholder" data-uri="archive.cms.cnn.com/_components/paragraph/instances/paragraph_5BE952F9-D64F-4FCB-105B-2CA939186A37@published" data-editable="text" data-component-name="paragraph" data-analytics-observe="off">Additionally, visitors to Department of Education school buildings will no longer be required to show proof of having at least one dose of the vaccine, the release said.</p>
<p class="paragraph inline-placeholder" data-uri="archive.cms.cnn.com/_components/paragraph/instances/paragraph_0A6E64A8-8696-48D9-AD33-2CF052057661@published" data-editable="text" data-component-name="paragraph" data-analytics-observe="off">The roughly 1,780 city workers who were terminated for not complying with the mandate will not be automatically reinstated and will have to reapply for their old jobs, the city said.</p>

<p class="default__StyledText-sc-1wxyvyl-0 dcbLDX body-paragraph">The blizzard roared through the western New York Friday and Saturday, stranding motorists, knocking out power and preventing emergency crews from reaching residents in frigid homes and stuck cars.</p>

<p>NEW YORK CITY – New Yorkers admit to feeling the impacts of rising crime but told Fox News they expect &#8220;absolutely nothing&#8221; to come from President Biden’s meeting with the mayor Thursday.</p>
<p>Biden will travel to New York City Thursday to discuss a &#8220;comprehensive strategy to combat gun crime&#8221; with Mayor Eric Adams.</p>
<p>The president’s trip comes after thousands of police officers from across the nation traveled to Manhattan to pay their respects to fallen NYPD officers Jason Rivera and Wilbert Mora, who were shot and killed while responding to a domestic violence call last.</p>
<p>&#8220;I think it&#8217;s a total waste,&#8221; one woman said of the president’s visit to the city. &#8220;He&#8217;s going to do absolutely nothing to help New York City.&#8221;</p>
<p>&#8220;Political – it&#8217;s all political,&#8221; the 75-year-old lifelong New Yorker continued. &#8220;That&#8217;s why he&#8217;s coming. No other reason.&#8221;</p>
<p>The Biden administration on Thursday morning rolled out a strategy to stop the flow of guns, bolster law enforcement and increase funding for community policing ahead of the visit.</p>
<p>New York City saw 485 people murdered last year, a slight increase from 2020. It also experienced a sharp rise in hate crimes and an increase in almost all categories of major crimes. Additionally, subway crimes are up 65% so far in 2022.</p>
<p>&#8220;I cannot believe what’s happened in this city,&#8221; one resident of the Big Apple told Fox News. &#8220;Crime is out of control.&#8221;</p>
<p>&#8220;I know people who won&#8217;t get on the subway,&#8221; another woman said. &#8220;People rearrange their day around it…it definitely has an impact, especially for women.&#8221;</p>
<p>One woman who owns a business in Manhattan said, &#8220;My customers, they&#8217;re very afraid, after 5 o&#8217;clock, to walk in the city.&#8221;</p>
<p>&#8220;My mom calls me every night, she’s scared to go out,&#8221; a construction worker told Fox News. &#8220;Unfortunately, where she lives at, crime is up in the Bronx.&#8221;</p>
<p>&#8220;A lot of people are doing bad,&#8221; the man continued. &#8220;You know, COVID – when people don&#8217;t have money, crime goes up.&#8221;</p>

<p>One woman said the rise in crime started even before the pandemic hit.</p>
<p>&#8220;When they passed the bail and discovery laws, the state legislature passed them, Cuomo pushed them through, and it&#8217;s changed everything,&#8221; she said, referring to former Gov. Andrew Cuomo.</p>
<p>&#8220;Sadly, no one is caring, nobody&#8217;s taking care of these issues,&#8221; she continued.</p>
<p>When asked if they thought the president’s visit would bring positive change, many were skeptical: &#8220;Every president, they sell dreams. Let’s see what happens,&#8221; one said.</p>

<p class="speakable">Legal experts are warning that <a href="https://www.foxnews.com/category/person/andrew-cuomo">New York Gov. Andrew Cuomo’s</a> alleged undercounting of nursing-home deaths amid the <a href="https://www.foxnews.com/category/health/infectious-disease/coronavirus">COVID-19 pandemic</a> may rise to the level of a <a href="https://www.foxnews.com/category/us/crime">criminal</a> offense.</p>
<p class="speakable">Cuomo has found himself at the center of a federal investigation into whether his administration sought to hide the true toll of the pandemic.</p>
<p>The New York Post <a href="https://nypost.com/2021/02/11/cuomo-aide-admits-they-hid-nursing-home-data-from-feds/" target="_blank" rel="noopener">reported earlier this month</a> that Melissa DeRosa, Cuomo’s top aide, told lawmakers it had withheld the numbers for fear of them being &#8220;used against us.&#8221;</p>

<p>In an op-ed for the <a href="https://www.wsj.com/articles/why-cuomo-should-be-worried-about-a-federal-probe-11613945987" target="_blank" rel="noopener">Wall Street Journal</a>, John B. Daukas, who served as acting U.S. attorney general for the Justice Department’s Civil Rights Division, wrote that DeRosa’s reported admissions who that Cuomo’s administration &#8220;wasn’t merely negligent, but intentional and perhaps criminal.&#8221;</p>
<p>Daukas said numerous federal statutes could apply, noting that Cuomo’s administration is accusing of both making false statements to the federal government and trying to thwart an investigation.</p>
<p>&#8220;Even if it cannot be proved that the Cuomo administration knowingly provided false information to Justice and the (Centers for Medicare and Medicaid Services), New York’s willful failure to provide information may itself constitute a criminal offense—particularly if the intent was to thwart a federal investigation—which, after all, is exactly what Ms. DeRosa reportedly said the administration did,&#8221; Daukas wrote.</p>
<p>And on Saturday, Fox News legal analyst Gregg Jarrett said DeRosa’s admission to lawmakers – if true – constitutes a <a href="https://www.foxnews.com/opinion/cuomos-nursing-home-scandal-crimes-gregg-jarrett">potential obstruction of justice charge</a>. Per the federal statute, Jarrett noted, if a government official falsifies or hides evidence to avoid triggering an investigation (or acts out of fear that such a probe may occur) that official is still culpable under the law of obstruction.&#8221;</p>

<p>The nursing home scandal has dealt a harsh blow to the governor’s high favorability. Early on in the pandemic, the governor went on television for daily briefings that were paternal, almost philosophical, and also sharply critical of the <a href="https://www.foxnews.com/category/person/donald-trump">Trump administration</a>. They became must-see TV across the country, aided in part by his <a href="https://www.foxnews.com/media/cnns-chris-cuomo-mocked-tweeting-resignation-texas-mayor-brother">CNN news host brother</a>.</p>
<p>Despite his state&#8217;s death toll — more than 46,000 people in New York state have died of COVID-19, according to <a href="https://www.foxnews.com/category/us/education/college">Johns Hopkins University</a> — Cuomo&#8217;s popularity soared. In October, Cuomo took an early victory lap, releasing a book titled &#8220;American Crisis: Leadership Lessons from the COVID-19 Pandemic.&#8221;</p>
<p>But the nursing home issue exploded onto the political scene with two recent revelations. First, the state&#8217;s Democratic attorney general chastised the Cuomo administration for minimizing the death toll at nursing homes by excluding certain fatalities from the count. Cuomo&#8217;s administration then revealed at least 15,000 people living in long-term care facilities have died of COVID-19, nearly double the number Cuomo had initially disclosed.</p>

<p>&#8220;The nursing homes story really exposed quite a bit about questions about his leadership style and the success of his leadership during COVID,&#8221; said Christina Greer, a political science professor at Fordham University. &#8220;The governor wrote a book touting his accomplishments, and we don&#8217;t know if we&#8217;re halfway out of the pandemic.&#8221;</p>
