<p class="body-graf">WASHINGTON — Conservative members of <a href="https://www.nbcnews.com/politics/supreme-court" target="_blank" rel="noopener">the Supreme Court</a> on Wednesday leaned toward allowing Oklahoma to approve the first-ever religious public charter school in a case that could weaken the separation of church and state.</p>
<p class="body-graf">While several conservative justices expressed support for the school&#8217;s arguments, Chief Justice John Roberts emerged during the more than two-hour argument as a potentially decisive vote.</p>
<p>There is the possibility of a 4-4 split, as one justice, conservative Amy Coney Barrett, is not participating. That outcome would preserve an Oklahoma Supreme Court ruling that blocked the proposed school.</p>

<p class="sics-component__html-injector sics-component__story__intro sics-component__story__paragraph">The US Supreme Court said this week that a large swath of eastern Oklahoma in the US remains an American Indian reservation, a decision with potential implications for nearly 2 million residents and one of the most significant victories for tribal rights in years.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The land at issue contains much of Tulsa, the state&#8217;s second-largest city. The question for the court was whether Congress officially eliminated the Muscogee (Creek) Nation reservation when Oklahoma became a state in 1907.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">In a 5-to-4 decision invoking the country&#8217;s long history of mistreating Native Americans, the court said &#8220;we hold the government to its word&#8221; and the land Congress promised to the Creek Nation is still Indian land.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;If Congress wishes to withdraw its promises, it must say so. Unlawful acts, performed long enough and with sufficient vigour, are never enough to amend the law,&#8221; wrote Justice Neil Gorsuch, who was joined by the court&#8217;s liberal justices.</p>

<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;To hold otherwise would be to elevate the most brazen and long-standing injustices over the law, both rewarding wrong and failing those in the right.&#8221;</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The dissent, led by Chief Justice John Roberts Jr, warned of significant upheaval in the criminal justice system, and in other areas of government such as taxing and zoning. But state and tribal leaders downplayed those concerns and said they are negotiating an agreement to address jurisdictional issues.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Most directly, the ruling means that federal officers, not state authorities, have the power to prosecute tribal members for major crimes committed in the defined area. Less certain is how the decision affects the authority of state and city leaders when it comes to imposing taxes, zoning laws, and other regulations.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Oklahoma Attorney General Mike Hunter and leaders of five tribal groups issued a joint statement after the ruling indicating they have made &#8220;substantial progress toward an agreement&#8221; to submit to Congress and the Justice Department that would put in place a &#8220;framework of shared jurisdiction”.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;We have a shared commitment to maintaining public safety and long-term economic prosperity for the Nations and Oklahoma,&#8221; according to the statement from Hunter and the Creek, Cherokee, Chickasaw, Choctaw and Seminole nations.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Lawmakers in Washington would have to pass legislation, for instance, for state officials to continue prosecuting crimes involving tribal members in the area affected by the Supreme Court&#8217;s ruling.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The case was brought by Jimcy McGirt, a member of the Creek Nation who was convicted in state court of molesting a child. Because the crime occurred on the land in question, McGirt said that state courts had no jurisdiction and that the federal government would have to prosecute. The court&#8217;s ruling tosses McGirt&#8217;s state conviction and means he must be tried in federal court.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Oklahoma and the federal government contended that laws passed between 1890 and 1907 gave the state jurisdiction over the land. The state said that there are thousands of similar cases and that a ruling in favour of McGirt would not only throw the criminal-justice system in turmoil but also disrupt taxing powers and other municipal jurisdictions.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">In his dissent Thursday (local time), Roberts agreed, writing that the state&#8217;s ability to prosecute crimes &#8220;will be hobbled and decades of past convictions could well be thrown out&#8221;.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;On top of that, the Court has profoundly destabilized the governance of eastern Oklahoma. The decision today creates significant uncertainty for the State&#8217;s continuing authority over any area that touches Indian affairs,&#8221; wrote Roberts, who was joined by Justices Samuel Alito Jr, Brett Kavanaugh, and Clarence Thomas.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The ruling specifically addresses the Creek Nation. But the state said as much as half of its land and roughly 1.8 million residents could end up living within Indian country, abutting Kansas, Arkansas, and Texas. Four other tribes have reservations in eastern Oklahoma, all created by treaties during the same time period.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">But the majority insisted the opinion is a narrow one and that &#8220;each tribe&#8217;s treaties must be considered on their own terms&#8221;. Gorsuch pointed out that many defendants prosecuted by the state may still choose to finish their sentences rather than risk proceeding in federal court where penalties are often steeper than in state court.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;We do not pretend to foretell the future and we proceed well aware of the potential for cost and conflict around jurisdictional boundaries, especially ones that have gone unappreciated for so long,&#8221; Gorsuch wrote. &#8220;But it is unclear why pessimism should rule the day. With the passage of time, Oklahoma and its Tribes have proven they can work successfully together as partners.&#8221;</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Attorneys for the Creek Nation and McGirt recalled the country&#8217;s broken promises and poor treatment of Native Americans. In the 1830s, members of the Creek Nation and four other tribal groups were forcibly marched by the US Army from Alabama and Georgia to the land in eastern Oklahoma which they were promised in exchange for leaving.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Ian Gershengorn, McGirt&#8217;s attorney, said in a statement that the court&#8217;s ruling reaffirmed that &#8220;when the United States makes promises, the courts will keep those promises&#8221;.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;Congress persuaded the Creek Nation to walk the Trail of Tears with promises of a reservation &#8211; and the Court today correctly recognized that this reservation endures.&#8221;</p>
<p class="sics-component__html-injector sics-component__story__paragraph">Riyaz Kanji, the Creek Nation&#8217;s lawyer, said he does not expect the ruling to result in major upheaval because of long-standing cooperation between tribal and state leaders.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;Life is not going to change dramatically within the reservation, but it will allow the Nation to continue exercising governmental authority and engaging in governmental programmes that benefit Indians and non-Indians&#8221; such as health care services, he said.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The court also resolved a second similar case that was argued last term but not decided until Thursday. In that case, Gorsuch had recused himself because he had participated in it as a judge on the appeals court in Colorado. Apparently deadlocked, the justices took the new case and on Thursday invalidated the state convictions of both McGirt and Patrick Murphy, a Creek Indian convicted and sentenced to death in the murder of a fellow Creek Nation member in 1999.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">State and tribal leaders said in their joint statement that they are &#8220;committed to ensuring that Jimcy McGirt, Patrick Murphy, and all other offenders face justice for the crimes for which they are accused”.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">In its ruling Thursday, the majority held that only Congress, not the court, has the authority to modify treaty agreements and change reservation boundaries.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">&#8220;The opinion is a strong, clear, and important statement that limits the court&#8217;s role in diminishing tribal rights,&#8221; said Sarah Krakoff, a professor of American Indian law at the University of Colorado&#8217;s law school.</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The decision, she said, &#8220;reflects the better aspects of what is otherwise an incredibly fraught and negative history for tribes in this country.&#8221;</p>
<p class="sics-component__html-injector sics-component__story__paragraph">The cases are McGirt v Oklahoma and Sharp v Murphy.</p>

<p>Strong winds are fueling more than two dozen wildfires burning across <a class="r_lapi" href="http://abcnews.go.com/topics/news/oklahoma.htm">Oklahoma </a>and <a class="r_lapi" href="http://abcnews.go.com/topics/news/texas.htm">Texas</a>.</p>
<p>Authorities say one blaze in western Oklahoma is estimated to be nearly 40 miles (64 kilometers) across at its widest point.</p>
<p>Oklahoma Forestry Services spokeswoman Michelle Finch-Walker says 14 wildfires in the state have charred more than 572 square miles (1,500 square kilometers).</p>
<p>The largest is in Dewey County, where more than 375 square miles (970 square kilometers) have been charred. Hundreds of people have been evacuated .</p>
<p>There also are at least a dozen wildfires in Texas, including a 12 square mile (31 square kilometer) fire in Wheeler County in the Panhandle.</p>
<p>Texas A&amp;M Forest Service fire <a class="r_lapi" href="http://abcnews.go.com/topics/news/weather.htm">weather</a> analyst Scott Breit says wind gusts of up to 55 mph (86 kph) are fueling the fires Saturday.</p>

										<content:encoded><![CDATA[<p>A STRING of powerful earthquakes have rocked the west and central US with several of them hitting near to the dreaded RING OF FIRE.</p>
<p>Some eight earthquakes have rocked the United States in quick succession, all of which have taken place on April 9.</p>
<p>The strongest of the earthquakes, and also the most recent, came in Perry, Oklahoma, when a 4.3 magnitude tremor hit the central US state.</p>
<p>However, there have been no reports of damage to buildings in the area.</p>
<p>People took to social media to share their experience, with one writing: “Another earthquake in Oklahoma, shaking us awake just now!”</p>

<p>The strongest earthquake came in Oklahoma.</p>
<p>Other people share similar views, with Twitter user Arianna saying that she believes this is a sign that a bigger earthquake is coming.</p>
<p>She wrote: “All these little earthquakes just leading up to the big earthquake soon that destroys us”.</p>
<p>Since midnight, there have also been earthquakes in Alaska, Nebraska, Texas and three in California.</p>
<p>Both California and Alaska sit on the deadly Ring of Fire – the largest and most active fault line in the world, stretching from New Zealand, all around the east coast of Asia, over to Canada and the USA and all the way down to the southern tip of South America – which causes more than 90 percent of the world’s earthquakes.</p>
<p>Also in California sits the San Andreas fault, where two huge plates meet.</p>
<p>This has also caused many earthquakes over the years, including the recent 5.3 magnitude tremor striking just off the Pacific coast on April 6, rattling Santa Barbara and Los Angeles.</p>
<p>Researchers believe that the San Andreas fault is overdue the ‘Big One’ – a potentially catastrophic earthquake which could cause widespread destruction in the southwest of the US.</p>
<p>Last year, Robert Graves, a research geophysicist at the USGS, said that the Big One could be overdue by 10 years.</p>

<section class="text-description">He told Raw Story: &#8220;The San Andreas fault in southern California last had a major quake in 1857 (magnitude 7.9).&#8221;Studies that have dated previous major offsets along the fault trace show that there have been about 10 major quakes over the past 1,000-2,000 years.</p>
<p>&#8220;The average time between these quakes is about 100-150 years.”</p>

<p>There is a 1-in-20 chance of Thursday’s quake leading to a bigger one in the next few weeks, John Vidale, director of the Southern California Earthquake Center at USC told the Los Angeles Times.</p>

<p>“It&#8217;s right on the edge of being an earthquake that could be dangerous.It&#8217;s a reminder that we need to be ready in the future.”</p>

<p><strong>COVINGTON, Okla. &#8212; </strong>A magnitude 4.6 earthquake shook Oklahoma on Saturday and was also felt in neighboring Kansas and Missouri, according to the U.S. Geological Survey. It was one of several earthquakes recorded in northwest Oklahoma on Saturday morning. USGS in Oklahoma said in a tweet there were eight earthquakes with magnitudes ranging from 2.5 to 4.6 in northern Oklahoma in the past 24 hours.</p>
<p>Garfield County Emergency Management Director Mike Honigsberg said there are no immediate reports of injury or serious damage following the quakes.</p>

<p>The largest temblor was at 7:16 a.m. a few miles outside Covington, a town of about 500 people. Reports on the USGS website show it was felt as far away as Kansas City, Missouri, some 300 miles (480 kilometers) northeast of Covington. People in Joplin, Missouri, and Wichita, Kansas, also reported feeling it.</p>
<p>Saturday&#8217;s quakes were in the same area where four others struck Friday, including one of magnitude 3.7.</p>
<p>The threshold for damage usually starts at 4.0. The strongest earthquake on record in Oklahoma was a magnitude 5.8 recorded near Pawnee in September 2016.</p>
<p>Many of the thousands of earthquakes in Oklahoma in recent years have been linked to the underground injection of wastewater from oil and natural gas production. State regulators have directed several producers to close or reduce volumes in some wells.</p>
