										<content:encoded><![CDATA[<p>Denmark will no longer automatically accept a quota of refugees under a U.N. resettlement program after passing a law on Wednesday that enables the government to determine how many can enter each year.</p>
<p>Since 1989, Denmark has agreed to take 500 refugees a year selected by the United Nations under a program to ease the burden on countries that neighbor war zones. But after the European migration crisis in 2015 brought almost 20,000 claims for asylum, Denmark has refused to take any U.N. quota refugees.</p>
<p>Under the new law, the immigration minister will decide how many refugees will be allowed under the U.N. program, with 500 now the maximum except in an &#8220;exceptional situation&#8221;.</p>
<p>&#8220;It is hard to predict how many refugees and migrants will show up at the border to seek asylum, and we know it may be hard to integrate those who arrive here,&#8221; Immigration and Integration Minister Inger Stojberg said last month when her ministry proposed the law, according to Reuters.</p>
<p>The opposition Social-Liberal Party said opting out of the U.N. program would increase pressure on countries already accommodating large numbers of refugees, and the move could encourage other countries to follow suit.</p>
<p>Last year, more than 6,000 people claimed asylum in Denmark. Between January and November this year just over 3,000 people did.</p>
<p>Regarding the crisis over migration among the European countries, eastern states have been opposed ever since other EU states adopted by majority the quotas in 2015 as a form of solidarity with frontline states Greece and Italy. Under the plan, asylum seekers are relocated to other members of the bloc in a temporary exception to the so-called Dublin rules, which requires countries where they first land to process them.</p>
<p>EU President Donald Tusk and European Commission chief Jean-Claude Juncker nonetheless tried to defuse a row that had even divided them when they opened talks with the bloc&#8217;s 28 leaders on Thursday. &#8220;Mandatory quotas remain a contentious issue although its temperature has decreased substantially,&#8221; Tusk told a press conference ending the last European Union summit of 2017, as reported by AFP. &#8220;Will a compromise be possible? It appears very hard,&#8221; the former Polish premier said. During two hours of debate, the leaders of Hungary, Poland, the Czech Republic and Slovakia all stood firm against refugee quotas, participants said.</p>

<article class="paywall">BRUSSELS — European Union leaders will grapple Thursday with one of the most divisive issues ever to face the 28-nation bloc; how to collectively share responsibility for the tens of thousands of people arriving on Europe’s southern shores in search of a better life.</p>
<p>Ahead of an EU summit in Brussels, fresh tensions have surfaced over the perceived need for national refugee quotas. So far, solidarity with front-line nations Greece and Italy, where the refugees land, has been limited. A mandatory quota scheme was opposed mainly by eastern European nations — the Czech Republic, Hungary, Poland and Slovakia.</p>
<p>For Europe, the political crisis over migrants is existential, despite the fact that migrant arrivals have dropped dramatically this year.</p>
<p>As hundreds of thousands of Syrian refugees trekked northward from Greece in 2015, some EU nations erected fences, launched police crackdowns and closed borders, forcing migrants onto their neighbors. ID checks were reintroduced in parts of Europe’s passport-free travel area, hampering trade, business and tourism.</p>
<p>That fueled anti-immigrant parties and the far-right made significant political inroads.</p>
<div>“The migration crisis was a kind of character test for the EU,” Roderick Parkes, senior analyst at the EU’s Institute for Security Studies, wrote Wednesday.</div>
<p>It has tested the EU’s “capacity to lead in the field of refugee reception, to seize the economic opportunities of immigration and to share the burden borne by Turkey, Lebanon or Kenya by resettling refugees. And the EU failed the test, on all counts,” he wrote.</p>
<p>At the center of Europe’s migrant malaise are refugee quotas. In response to the arrival of more than 1 million migrants in 2015, EU nations voted by a large majority to share 160,000 of those fleeing conflict or persecution to help ease the burden on overwhelmed Greece and Italy.</p>
<p>Hungary challenged the quotas at Europe’s top court but lost.</p>
<p>In an effort to clear the air, EU Council President Donald Tusk, who will chair the two-day summit in Brussels, has put the issue at the top of the agenda. But in branding the scheme ineffective, he has angered Europe’s top migration official and lawmakers involved in drawing it up.</p>
<p>“The issue of mandatory quotas has proven to be highly divisive and the approach has received disproportionate attention in light of its impact on the ground; in this sense it has turned out to be ineffective,” Tusk wrote to the EU leaders.</p>
<p>But EU Migration Commissioner Dimitris Avramopoulos slammed the note as “unacceptable. It is anti-European and it denies, it ignores, all the work we have done during the past years.”</p>
<div>“This paper is undermining one of the main pillars of the European project; the principle of solidarity. Europe without solidarity cannot exist,” he said. “It is a duty — moral and legal — to protect refugees.”</div>
<p>Greens lawmaker Ska Keller said “Tusk is undermining the prospects of a solidarity-based refugee policy in Europe” and that “without a fair redistribution of refugees, European asylum policy will remain vulnerable to crisis.”</p>
<p>The European Commission says 32,000 people from the asylum scheme have found homes. But that figure — less than a quarter of the original target — masks the legal challenges, abuses and suffering as thousands of migrants and refugees have languished in the Greek islands.</p>
<p>The main reason for the drop in migrant numbers is the EU’s agreement with Turkey, which saw the bloc mobilize its financial might to convince Ankara to stop Syrian refugees from crossing the sea to nearby Greece and to take back thousands already there</p>

<div class="clear">Spurred by that success, the EU is leveraging its considerable development aid as it draws up other outsourcing arrangements, mostly with Libya’s poor neighbors to stop Africans unlikely to qualify for asylum from heading there to take treacherous sea journeys to Italy.</div>

<p>Tusk wants Thursday’s summit discussions to promote mutual understanding about the migration challenges that the EU’s neighbors face. He also wants the leaders to endorse plans to make migration a part of the EU’s long-term budget, rather than rely on ad-hoc contributions.</p>
<p>No concrete decisions will be made Thursday. The future of mandatory refugee quotas for nations should be made clearer next June.</p>
<p>“It is important to look at what has — and what has not — worked over the past two years, and draw the necessary lessons,” Tusk wrote. “The migration challenge is here to stay.”</p>

<p>The EU could scrap a divisive scheme that compels member states to accept quotas of refugees, one of the bloc’s most senior leaders will say this week.</p>
<p>The president of the European council, Donald Tusk, will tell EU leaders at a summit on Thursday that mandatory quotas have been divisive and ineffective, in a clear sign that he is ready to abandon the policy that has created bitter splits across the continent.</p>
<p>Tusk will set a six-month deadline for EU leaders to reach unanimous agreement on reforms to the European asylum system, but will propose alternatives if there is no consensus.</p>
<p>“If there is no solution … including on the issue of mandatory quotas, the president of the European council will present a way forward,” states a draft letter from Tusk to national capitals, seen by the Guardian.</p>
<p>In effect this means scrapping mandatory quotas, because Hungary, Poland and Czech Republic are fiercely opposed to the idea of dispersing refugees around the bloc based on a formula drawn up in Brussels. Tusk is likely to face opposition, however, from other EU bodies, including the European commission.</p>
<p>EU leaders introduced <a class="u-underline" href="https://www.theguardian.com/world/2015/sep/22/eu-governments-divisive-quotas-deal-share-120000-refugees" data-link-name="in body link">compulsory quotas in 2015 at the height of the migration crisis</a>, as thousands of people arrived daily on Europe’s shores, many of whom were refugees from Syria, Iraq and Eritrea. Hungary, Slovakia, Romania and the Czech Republic voted against the move, but the policy was forced through by a majority vote.</p>
<p>Hungary and Poland have defied the rest of the EU by not taking a single refugee under the scheme, which aimed to relocate about 120,000 refugees, mainly Syrians. The Czech republic has taken in only 12. All three countries were <a class="u-underline" href="https://www.theguardian.com/world/2017/dec/07/eu-hungary-court-crackdown-george-soros" data-link-name="in body link">referred to the European court of justice</a> last week for failing to implement the policy, the usual procedure for flouting EU rules.</p>
<p>Despite the backlash against the emergency scheme, the European commission proposed making quotas a permanent feature of EU law in 2016. Under its proposal, countries that refuse to take part in a “corrective allocation mechanism” to take the pressure off member states bearing the brunt <a class="u-underline" href="https://www.theguardian.com/world/2016/may/03/eu-refugee-crisis-closed-door-countries-pay-solidarity-contributions" data-link-name="in body link">would have to pay a “solidarity contribution”</a> of €250,000 (£220,000) per asylum seeker.</p>
<p>The idea has been stalled for months, as home affairs ministers who make the law have been unable to agree on it. Any move to drop the plan is likely to upset Italy and Greece, countries that have urged the rest of the EU to help them cope with large numbers of refugees and migrants in recent years. Germany and Sweden, backed by the European commission, are also likely to contest any plan deemed to reduce the help offered by other member states.</p>
<p>One EU diplomat said some member states were surprised by Tusk’s letter “because it doesn’t seem to be in sync” with work undertaken by home affairs ministers working on the file.</p>

<p>Tusk, a former prime minister of Poland, thinks mandatory quotas have been a gift to hardliners, such as the Hungarian prime minister, Viktor Orbán, who has seized on migration as part of his wider Stop Brussels campaign. Eurosceptics in Poland, such as the Law and Justice leader Jarosław Kaczyński, whose party won an election victory over Tusk’s centre-right group in October 2015, have also criticised the policy.</p>
<p>Tusk’s scepticism about the prospect of consensus has been evident for months. He said in October that mandatory quotas had put members states in almost permanent conflict.</p>
<p>Tusk will call on EU governments to take charge, rather than leaving Brussels to set the pace in managing refugee policy.</p>
<p>“Only member states are able to tackle the migration crisis effectively,” Tusk’s letter says. “The EU’s role is to offer its full support in all possible ways to help member states handle the migration crisis. But the EU has neither the capacity nor legal possibilities to replace member states.”</p>
<p>He will also urge EU leaders to spend more on schemes aimed at keeping refugees and would-be migrants outside Europe, such as €3bn for Syrian refugees in Turkey and the <a class="u-underline" href="https://www.theguardian.com/global-development/2017/oct/31/2bn-eu-africa-anti-migration-fund-too-opaque-say-critics" data-link-name="in body link">€1.9bn EU Africa trust fund</a>.</p>
<p>The EU will confront an earlier promise to give Turkey’s government a further €3bn to help Syrian refugees in early 2018, which could lead to a repeat of <a class="u-underline" href="https://www.theguardian.com/world/2017/oct/20/eu-running-out-of-money-stop-migrants-travelling-africa" data-link-name="in body link">EU institutions asking governments to find more cash</a>.</p>
<p>The EU has improvised such schemes in response to crises, but Tusk wants more funds available from the new seven-year budget covering the period from 2021, which will come up for discussion next year.</p>
<p>He is calling for “stable and long-term financing mechanisms, in place of the existing ad hoc pledging on a much larger scale”, but has stopped short of putting a price tag on future migration policy.</p>
