										<content:encoded><![CDATA[<p>President Biden ranted against ownership of what he called “high-caliber weapons” Monday — appearing to suggest that there should be restrictions on the most popular handgun in America, the 9mm pistol, and repeating a previously debunked claim that the Second Amendment prohibits ownership of cannons.</p>
<p>Speaking to reporters outside the White House after returning to Washington from a weekend that included a visit to the site of last week’s mass shooting in Texas, Biden recounted a visit to a trauma hospital in New York, where he said doctors had showed him X-rays of gunshot wounds caused by various firearms.</p>
<p>“They said a .22-caliber bullet will lodge in the lung, and we can probably get it out — may be able to get it and save the life,” Biden said. “A 9mm bullet blows the lung out of the body.</p>
<p>“So the idea of these high-caliber weapons is, uh, there’s simply no rational basis for it in terms of thinking about self-protection, hunting,” the president went on.</p>
<p>Later in his remarks, Biden appeared to rule out the possibility of taking major executive action on guns, saying: “I can’t dictate this stuff. I can do the things I’ve done and any executive action I can take, I’ll continue to take. But I can’t outlaw a weapon. I can’t, you know, change the background checks. I can’t do that.”</p>
<p>Biden’s statements about 9mm pistols are in keeping with his rhetoric before entering the White House. At a 2019 fundraiser in Seattle, for example, then-candidate Biden asked his audience: “Why should we allow people to have military-style weapons including pistols with 9mm bullets and can hold 10 or more rounds?”</p>
<p>According to Shooting Industry magazine, 9mm pistols accounted for 56.8% of all handguns made in the US during 2019. In all, more than 15.1 million 9mm guns were produced in this country during the 2010s. The possibility of outlawing or otherwise regulating such weapons is likely to be a non-starter among conservatives and gun rights advocates.</p>
<p>“Remember, the Constitution, the Second Amendment, was never absolute,” Biden said. “You couldn’t buy a cannon when the Second Amendment was passed. You couldn’t go out and purchase a lot of weapons.”</p>
<p>Biden has made that claim before, most recently when he announced new regulations to stop the spread of so-called “ghost guns,” and they have been repeatedly declared false by fact-checkers.</p>
<p>“The Second Amendment did not place limits on individual ownership of cannons,” PolitiFact stated in April when it rated his claim false.</p>
<p>The website pointed out the text of the Constitution: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”​</p>
<p>Despite widespread public outrage over Tuesday’s massacre at an elementary school in Uvalde, Texas, and the racially motivated May 14 mass shooting at a Buffalo grocery store, Biden said he had not yet spoken with any Republicans about potential gun control legislation, but expressed hope for a compromise.</p>
<p>“I think things have gotten so bad that everybody is getting more rational about it,” he said. “At least, that’s my hope and prayer.”</p>
<p>Asked whether Senate Minority Leader Mitch McConnell (R-Ky.) authorizing Sen. John Cornyn (R-Texas) to work with Democrats could lead to results, Biden said, “I don’t know.”</p>
<p>“I think Senator McConnell is a rational Republican. I think Cornyn is as well,” he added. “I think there’s a recognition in their part that they — we can’t continue like this. We can’t do this.”</p>
<p>Without Republican support, Democrats are powerless to pass any gun legislation in the 50-50 Senate unless they manage to temporarily set aside the filibuster’s 60-vote threshold for passing most bills.</p>
<p>Biden’s comments came less than 48 hours after Vice President Kamala Harris called for an assault weapons ban after attending a funeral for Buffalo shooting victim Ruth Whitfield, 86.</p>
<p>“You know what an assault weapon is? You know how an assault weapon was designed?” Harris said Saturday. “It was designed for a specific purpose — to kill a lot of human beings quickly. An assault weapon is a weapon of war with no place, no place in a civil society.”</p>

<p>HOUSTON – Former President Trump traveled to Houston on Friday to offer support for the National Rifle Association and echo the group&#8217;s mission as it faces pushback from gun control advocates following a deadly school shooting in Texas this week.</p>
<p>Speaking from the George R. Brown Convention Center, Trump addressed NRA members and touted the work his administration did to preserve the Second Amendment during his tenure in the White House.</p>

<p>Trump&#8217;s remarks at the 2022 NRA convention came days after a shooting at Robb Elementary School in Uvalde, Texas, that left 19 children and two adults dead.</p>
<p>&#8220;The existence of evil is one of the very best reasons to arm law-abiding citizens and that is why one of the core missions of the NRA is to train, prepare and equip responsible American men and women with the knowledge and tools they need to defend themselves,&#8221; Trump said, highlighting efforts from the NRA to enhance gun safety measures.</p>
<p>&#8220;The NRA has 125,000 certified instructors,&#8221; he added. &#8220;These are highly trained, very, very capable people. They train an incredible 1,000,000 Americans to be safer. Gun owners ready to act when the situation calls… incredible job.&#8221;</p>
<p>Trump said his administration worked to stop the siege on the Second Amendment and told those in attendance at the convention that &#8220;those on the left&#8221; will soon come for guns of all types.</p>

<p>&#8220;We all know they want total gun confiscation, we know that this would be a first step,&#8221; he added. &#8220;Once they get the first step, they&#8217;ll take the second step, the third, the fourth, and then you&#8217;ll have a whole different look at the Second Amendment, which is, by the way, totally under siege. But we stopped it for four years. We stopped it.&#8221;</p>
<p>Trump also told the NRA members that &#8220;schools should be the single-hardest target in our country&#8221; and noted the need to mend the issues surrounding &#8220;broken families&#8221; and mental health. He also suggested that some teachers should be able to &#8220;conceal carry.&#8221;</p>

<p>Speaking at the convention on Friday, NRA CEO Wayne LaPierre pushed back against calls for legislative gun control measures after the shooting in Uvalde.</p>
<p>&#8220;If we as a nation were capable of legislating evil out of the hearts and minds of criminals who commit these heinous acts, we would have done it a long time ago,&#8221; LaPierre said.</p>

										<content:encoded><![CDATA[<p>A Florida politician sparked controversy Wednesday after tweeting that President Joe Biden would “learn” why the Second Amendment was created if he sought to “take our guns” after the Texas school shooting.</p>
<p>“I have news for the embarrassment that claims to be our President,” state Rep. Randy Fine wrote on Twitter. “Try to take our guns and you’ll learn why the Second Amendment was written in the first place.”</p>
<p>The remark was met by a flood of criticism, with posters asserting that Fine, a Melbourne Beach Republican, had issued a threat.</p>
<p>Actress Rosanna Arquette entered Fine’s inferno of outraged Twitter replies.</p>
<p>“Are you threatening president Biden?” she asked. “Because it sure sounds like it.”</p>
<p>Congressman Jamal Bowman of New York also weighed in.</p>
<p>“Further evidence that the Republican Party has completely lost its way,” he wrote, arguing that Fine and the GOP were promoting “fascism.”</p>
<p>Thousands of posters tagged the FBI and Secret Service in their condemnations.</p>
<p>Fine later doubled down.</p>
<p>“The reaction exposes the lie of the left that they just want ‘common sense gun control.&#8217;” he tweeted later. “They want one thing and one thing only — gun confiscation and an end to the 2A — and the notion that Americans will exercise their right to fight them makes them go crazy. Boo hoo.”</p>
<p>Fine was surrounded by reporters in the Florida Capitol in Tallahassee Wednesday as the controversy spiraled.</p>
<p>He denied that he had threatened Biden but repeated his critique of the president’s handling of the Texas massacre thus far.</p>
<p>“He turned his speech into a speech on gun control,” Fine said outside an elevator. “It was hugely inappropriate.”</p>
<p>In his address on the shooting, Biden called for politicians to take a stronger position against gun manufacturers but did not offer any detailed proposals.</p>

										<content:encoded><![CDATA[<p><span class="dateline"><strong>WASHINGTON</strong> &#8211; </span>The White House believes the United States is enduring a &#8220;gun violence public health epidemic,&#8221; so President Joe Biden is taking executive action to address it.</p>
<p>Biden spoke from the Rose Garden Thursday morning, announcing new gun control measures that target ghost guns, red flag laws, pistol-stabilizing braces, and other issues.</p>
<p>He said he wants Congress to do more than offer &#8220;thoughts and prayers&#8221; to the victims of gun violence.</p>
<p>&#8220;They’ve offered plenty of thoughts and prayers, members of Congress,&#8221; Biden said, &#8220;But they’ve passed not a single new federal law to reduce gun violence. Enough prayers, time for some action.&#8221;</p>
<p>Because substantial changes to gun laws have always met fierce Republican resistance in Congress, Biden said he asked Attorney General Merrick Garland to prioritize gun violence and help him with concrete actions the president could take without Congress.</p>

<p>Biden first spoke of regulating ghost guns, which are homemade firearms that often lack serial numbers authorities would use to trace them. They’ve increasingly turned up at crime scenes, and federal agents have found them in undercover purchases from gang members and other criminals.</p>
<p>There’s no federal requirement for ghost gun buyers to undergo a background check, but Biden’s actions would change that.</p>
<p>Biden said he’ll also tighten regulations on pistol-stabilizing braces. The president said the brace makes the pistol more lethal and &#8220;a hell of a lot more accurate.&#8221; He wants to designate pistols with the brace as short-barreled rifles, which would require owners to have a federal license.</p>
<p>The braces came under scrutiny last month after a gunman allegedly used a braced pistol to kill 10 people at a grocery store in Boulder, Colorado.</p>

<p>That shooting, along with shootings at three Atlanta-area spas that left eight dead plunged the U.S. back into a gun debate that has dominated American politics for years.</p>
<p>Part of Biden’s action asks Congress to pass an appropriate national red flag law that would allow family members or law enforcement to petition for a court order temporarily barring people in crisis from accessing firearms if they present a danger to themselves or others.</p>
<p>And he hopes Congress will incentivize states to pass similar laws. Biden praised the House for passing bills that would close loopholes in America’s gun legislation.</p>
<p>The gun show loophole allows buyers to purchase a gun from a gun show, where background checks aren’t required. The Charleston loophole allows guns to be purchased if the FBI hasn’t completed a background check within three business days. And the boyfriend loophole allows physically abusive ex-boyfriends and stalkers with previous convictions to maintain access to firearms.</p>
<p>Democrats control both chambers of Congress, but the slim Senate advantage likely wouldn’t be enough to pass the bills that would end the loopholes.</p>
<p>Republicans are expected to oppose many, if not all, of Biden’s measures. The party has positioned itself as defender of the Second Amendment and tried to paint the opposition as gun confiscators. Before he went into his plans, Biden dismissed the notion that his measures were a threat to the Second Amendment — calling it a &#8220;phony argument.&#8221;</p>
<p>While enhanced background checks are generally popular with the American public — even with some conservatives — Congress has so far not been able to find compromise on gun control as a whole, thus the president’s reliance on executive action.</p>
<p>&#8220;Universal background checks are supported by the vast majority of American people — and I might add the majority of responsible gun owners,&#8221; Biden said. &#8220;Let me be clear: This is not a partisan issue among the American people. This is a view by the American people as an American issue. And I’m willing to work with anyone to get these done.&#8221;</p>
<p>But of all the ideas Biden presented, the removal of gun manufacturers’ immunity to lawsuits sits closes to his heart, he said.</p>
<p>&#8220;If I get one thing on my list, the Lord came down and said ‘Joe, you get one of these,’ give me that one,&#8221; Biden said. &#8220;Because I tell you what: There would be a come to the Lord moment these folks would have real quickly.&#8221;</p>

<p>Thursday’s news conference also served as an introduction of David Chipman, Biden’s nominee to direct the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Chipman is a former federal agent and adviser to the gun-control group Giffords. He spent 25 years with ATF where he worked to stop a trafficking ring that sent illegal guns from Virginia to New York.</p>
<p>Gun-control advocates have long stressed how crucial the director of the ATF is in enforcing gun laws. John Feinblatt, president of Everytown for Gun Safety, lauded Chipman as an &#8220;invaluable point person&#8221; in the fight against illegal gun trafficking.</p>
<p>Feinblatt also applauded Biden for his upcoming gun control measures.</p>
<p>&#8220;Each of these executive actions will start to address the epidemic of gun violence that has raged throughout the pandemic, and begin to make good on President Biden’s promise to be the strongest gun safety president in history,&#8221; Feinblatt said.</p>

<p class="speakable"><a href="https://www.foxnews.com/category/person/joe-biden" target="_blank" rel="noopener">President Biden</a> on Thursday announced a set of executive actions and legislative proposals on gun control, saying that gun violence is &#8220;a public health crisis&#8221; and the administration&#8217;s actions do not contravene <a href="https://www.foxnews.com/category/us/personal-freedoms/second-amendment" target="_blank" rel="noopener">Second Amendment</a> rights.</p>
<p class="speakable">The administration aims to &#8220;confront not just the gun crisis but what is actually a public health crisis,&#8221; Biden said in his remarks in the Rose Garden. He was joined by Vice President Harris.</p>
<p>&#8220;Nothing I&#8217;m about to recommend in any way impinges on the Second Amendment,&#8221; Biden said. &#8220;These are phony arguments suggesting that these are Second Amendment rights at stake from what we&#8217;re talking about.&#8221;</p>
<p>Continuing, Biden said: &#8220;But no amendment to the Constitution is absolute &#8230; From the very beginning, you couldn&#8217;t own any weapon you wanted to own. From the very beginning the Second Amendment existed, certain people weren&#8217;t allowed to have weapons. So the idea is just bizarre to suggest that some of the things we&#8217;re recommending are contrary to the Constitution.&#8221;</p>
<p><a href="https://www.foxnews.com/politics/biden-actions-gun-violence" target="_blank" rel="noopener"><strong>BIDEN TO TARGET &#8216;GHOST GUNS,&#8217; STABILIZING BRACES IN NEW GUN CONTROL ACTIONS</strong></a></p>
<p>In attendance were several high-profile gun control activists, including Brady United president Kris Brown, former Rep. Gabby Giffords, D-Ariz., and Fred Guttenberg.</p>
<p>An administration official detailed the actions to reporters on Wednesday. Among them, Biden is asking the Justice Department (DOJ) to propose within a month a rule to stop &#8220;ghost guns,&#8221; which are &#8220;kits&#8221; people can buy legally to assemble a functioning firearm that does not have a serial number.</p>
<p>Biden is also asking the DOJ to propose within 60 days a rule on braces used for handguns, which make them more accurate; to propose action on &#8220;community violence intervention&#8221;; to publish suggestions for &#8220;red flag&#8221; legislation; and is asking his administration to issue a report on gun trafficking.</p>
<p>Biden also formally announced David Chipman as the director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).</p>
<p>A senior administration official Wednesday said that Chipman will respect the Second Amendment while he enforces gun laws.</p>

<p>&#8220;I&#8217;ve seen with my own two eyes what a bullet can do to the human body &#8230; and I&#8217;ve fought my entire career to fight this violence and to pass reasonable gun safety measures,&#8221; Harris said as she introduced Biden.</p>
<p>&#8220;What are we waiting for? Cause we aren&#8217;t waiting for a tragedy&#8230; We&#8217;ve had more tragedy than we can bear,&#8221; she said. &#8220;The solutions exist&#8230; people on both sides of the aisle want action, real people &#8230; so all that is left is the will and the courage to act.&#8221;</p>
<p>The Biden administration is also expected to throw its weight behind gun control proposals in Congress.</p>
<p>&#8220;Enough prayers, time for some action,&#8221; Biden said of Congress. &#8220;I believe the Senate should immediately pass three House-passed bills to close loopholes that allow gun purchases, purchasers, to bypass the background checks.&#8221;</p>
<p><a href="https://www.foxnews.com/politics/biden-second-amendment-no-amendment-is-absolute" target="_blank" rel="noopener"><strong>BIDEN ON THE SECOND AMENDMENT: &#8216;NO AMENDMENT IS ABSOLUTE&#8217;</strong></a></p>
<p>He also pushed for two gun control laws that would go even further than that.</p>
<p>&#8220;We should also ban assault weapons and high-capacity magazines in this country,&#8221; Biden said. He said &#8220;there&#8217;s no reason&#8221; a person would need a weapon that can hold &#8220;100 rounds.&#8221;</p>
<p>&#8220;We should also eliminate gun manufacturers from the immunity they receive from the Congress,&#8221; Biden said, referring to the Protection of Lawful Commerce in Arms Act (PLCAA), a law that prevents gunmakers from being sued for crimes committed with guns they sell legally.</p>
<p>&#8220;This is the only outfit that is exempt from being sued,&#8221; he continued. &#8220;If I get one thing on my list&#8230; give me that one because I tell you what there would be a come to the Lord moment these folks would have real quickly.&#8221;</p>

<p>Some of Biden&#8217;s claims during the press conference are regularly disputed by Republicans, including that gun manufacturers can&#8217;t be sued and that background checks aren&#8217;t required at gun shows.</p>
<p>Indeed, the PLCAA only protects against suits for &#8220;harm solely caused by the criminal or unlawful misuse of firearm products or ammunition products.&#8221; This does not count, for example, if a gun is defective or if a gun was knowingly given to a person who is banned from possessing one.</p>
<p><strong><a href="https://www.foxnews.com/politics/biden-david-chipman-atf" target="_blank" rel="noopener">BIDEN TO NOMINATE GUN CONTROL BACKER DAVID CHIPMAN TO HEAD ATF: WH OFFICIAL</a></strong></p>
<p>Further, the &#8220;gun show loophole,&#8221; as it is known, is not actually about gun shows. All federally licensed commercial dealers, at gun shows or not, must conduct background checks. But federal law permits some non-commercial sellers who don&#8217;t need to be licensed to sell guns without conducting background checks. These sales sometimes happen at gun shows.</p>
<p>Republicans, meanwhile, have expressed their suspicion of Biden&#8217;s agenda which goes <a href="https://www.foxnews.com/politics/biden-trump-comparison-second-amendment" target="_blank" rel="noopener">even further</a> than what he announced Thursday.</p>
<p>&#8220;By appointing the anti-gun Merrick Garland as attorney general and nominating David Chipman — formerly a senior staffer at the leading gun control lobby —  to head ATF, Biden has made clear his sights are set on restricting the rights of law-abiding gun owners while ignoring criminals and foregoing substantive measures that will actually keep Americans safe,&#8221; the National Rifle Association (NRA) said in a statement.</p>
<p>&#8220;Further, the proposals Biden announced tonight could require law-abiding citizens to surrender lawful property and enable states to expand gun confiscation orders. The NRA will fight this nomination and ill-conceived executive actions,&#8221; the NRA also said.</p>
<p>House Minority Leader Kevin McCarthy, R-Calif., <a href="https://twitter.com/GOPLeader/status/1379950305350127616" target="_blank" rel="noopener">added</a>: &#8220;President Biden plans to announce his attempts to trample over our constitutional 2A rights by executive fiat. He is soft on crime, but infringes on the rights of law-abiding citizens. I won’t stand for it. And neither will House Republicans. Follow the Constitution!&#8221;</p>

<p>Sen. Ted Cruz, R-Texas, said, &#8220;The answer is not to restrict the Second Amendment rights of law-abiding citizens, the answer is to go after violent criminals and come down on them like a ton of bricks.&#8221;</p>
<p>Attorney General Merrick Garland also spoke at the event. He said that gun control is needed to prevent further &#8220;tragedy&#8221; from gun violence.</p>
<p>&#8220;We stand here today not at a moment of tragedy but in the midst of an enduring tragedy,&#8221; Garland said.</p>
<p>Brady United, one of the highest-profile gun control groups in the U.S., billed Biden and Harris as &#8220;the strongest gun safety ticket in history&#8221; at an event last fall.</p>
<p>&#8220;President Biden’s actions are historic and they will have an immediate impact. These are tangible and powerful policies that will save lives,&#8221; Brown said of the president&#8217;s executive actions in a statement Wednesday.</p>

<p>University of Arizona researcher Jennifer Carlson says she and other sociologists see gun business as a telltale sign of what&#8217;s going on in the American psyche. If that is the case, Americans in 2020 were afraid.</p>
<p>In 2020, the FBI conducted 39.7 million background checks for gun purchases—a 40% increase over 2019&#8217;s record totals. January 2021 set a new monthly record, with 4.3 million firearm background checks.</p>
<p>It&#8217;s not hard to guess some of the reasons; 2020 was a year of cascading crises that continued into 2021, including the COVID-19 pandemic, racial unrest, and political instability.</p>
<p>Carlson, an associate professor in the School of Sociology in the UArizona College of Social and Behavioral Sciences, has spent over a decade examining how guns shape American life. Last spring, she received a National Science Foundation grant to chronicle the surge in gun purchases in the U.S. in 2020. From April to August, she interviewed more than 50 gun sellers in Arizona, California, Florida, and Michigan.</p>
<p>In September, Carlson&#8217;s newest book, &#8220;<a href="https://press.princeton.edu/books/hardcover/9780691183855/policing-the-second-amendment">Policing the Second Amendment: Guns, Law Enforcement and the Politics of Race</a>&#8221; was released by Princeton University Press. For the book, she interviewed more than 80 police chiefs to examine the relationship between gun politics and public law enforcement.</p>
<p>This month, Carlson is gathering gun experts across the county for a free, online &#8220;Guns in Crisis&#8221; series. In advance of the series, UArizona News spoke with Carlson about the spike in <a class="textTag" href="https://phys.org/tags/gun+sales/" rel="tag">gun sales</a> in 2020; the complicated relationship between guns, police, and race; and how we can talk about guns in nonpolitical terms.</p>
<p><b>Q. As part of your NSF grant looking at the rise of gun sales in 2020, you interviewed gun sellers across the country. What were some of your most surprising findings?</b></p>
<p>A: This was a really dramatic year in terms of gun sales. The year 2020 started off pretty slow for many gun sellers in January, and then there was a dramatic, night-and-day shift. At some point in March, gun sellers across the country woke up to lines out the door. And gun sales continue to surge.</p>
<p>In terms of timing, the sales clearly correlated with the coronavirus pandemic, and, so, the big question becomes, &#8220;How do you connect gun sales to a public health crisis?&#8221;</p>
<p>Gun sellers&#8217; reports about why people were buying guns related to uncertainty. The fact that people were going to the grocery store and there was no <a class="textTag" href="https://phys.org/tags/toilet+paper/" rel="tag">toilet paper</a>, that places were shut down, people were getting laid off—there is this sense of uncertainty and chaos.</p>
<p>The striking aspect of 2020, though, is that this becomes a moment when guns become appealing to a much broader sector of the population who either thought about getting a gun but never took that step, or were adamantly opposed to guns and gun ownership.</p>
<p>While the surveys show that conservative white men are disproportionately likely to own guns in this country, gun sellers told me they saw a surge in gun purchasing among first-time gun owners. I heard lots of reports of more women, more people of color, and more people from the LGBTQ community purchasing guns.</p>
<p>But on the flip side of that, I heard a lot of concerns from gun sellers about people who shouldn&#8217;t have guns. Not in the sense that they had a criminal record or something else legally disqualifying, but that they were worried about selling to irresponsible, panicked people. Sometimes, this reflected a concern about putting a gun in the hands of someone who didn&#8217;t understand firearms handling or safe storage. But other times, it seemed to be code for &#8220;liberals&#8221;—a fascinating expression of political partisanship that I&#8217;m unpacking in my next book, &#8220;Not a Bang but a Whimper.&#8221;</p>
<p><b>Q. There were a series of crises in 2020 in addition to COVID—from racial unrest to economic insecurity to political instability—that may have contributed to gun sales. How does that point to the various reasons people buy guns?</b></p>
<p>A: I talk about 2020 as a year of multi-layered crises, and it was definitely very interesting to me to see how guns fit into these different crises. For many people, each of these crises boiled down to an unraveling of the social safety net. … If the social safety net that people thought was there is not there, guns basically become a tool of last resort.</p>
<p>An upcoming election always drives up gun sales, especially if it looks like a Democrat is going to win. But this year, there was also fundamental uncertainty about the election itself. Talking to gun sellers, I was struck by how often they told me that no matter the outcome, this would be a contested election. And they were right.</p>
<p><b>Q. Has this past year changed gun culture in this country?</b></p>
<p>With this shift to first-time gun buyers, I think the question is: Does owning a gun make you part of gun culture?</p>
<p>You may buy a gun in the context of acute insecurity when you find that for the first time in your life you can&#8217;t go to the store and buy toilet paper, but that doesn&#8217;t necessarily mean that you&#8217;ve invested in the broader political project that&#8217;s represented by pro-gun politics. So I think that&#8217;s a question that&#8217;s still waiting to be unraveled.</p>
<p><b>Q. In your latest book, you talk about &#8220;gun militarism&#8221; and &#8220;gun populism.&#8221; What do those terms mean?</b></p>
<p>A: My book &#8220;Policing the Second Amendment&#8221; engages double standards in policing, focusing on gun law enforcement. The book is about this basic question of who is considered a &#8220;good guy with a gun&#8221; versus a &#8220;bad guy with a gun,&#8221; how race animates that, and how that shapes law enforcement.</p>
<p>I found when I talked to police chiefs that there&#8217;s two ways that they understand guns in the hands of private civilians: as objects of danger or objects of social order. I like to think of these different ways of understanding as different kinds of &#8220;gun talk.&#8221; With &#8220;gun militarism&#8221; gun talk, guns are talked about as objects of danger in the hands of private civilians, while police position themselves as needing guns to disarm the enemy. We know from existing scholarship that the &#8220;warrior&#8221; mindset is disproportionately at play in the policing of communities of color—and I found that gun militarism often arose in my own conversations with police chiefs in reference to gun violence associated with communities of color, such as gang violence. However, I also heard &#8220;gun populism&#8221; gun talk when police chiefs talked about gun carriers as (potential) fellow first responders, especially in reference to mass shootings, which are often associated with white rural and suburban communities. Here, police chiefs tended to talk about themselves not as warriors but as guardians—a stark contrast to how they saw themselves vis-à-vis urban gun violence.</p>
<p><b>Q. How can we talk about guns in nonpolitical terms?</b></p>
<p>A: This is the million-dollar question. … The more I research guns and gun politics in the U.S., the more I am convinced that when we&#8217;re talking about addressing the issue of guns, we need to talk trauma. The appeal of guns, the way we talk about guns, the harm that guns can inflict—it&#8217;s all wrapped up in trauma and, frankly, our society&#8217;s very poor way of dealing with it.</p>
<p>There are roughly 40,000 people killed by guns every year. That&#8217;s 40,000 families and communities who are devastated by that loss. That&#8217;s a lot more than 40,000 people. Then there are the roughly 80,000 to 100,000 people injured every year with guns. And then there are the innumerable people who are impacted by the fear of gun violence—even if they haven&#8217;t experienced it yet but feel &#8220;anticipatory trauma.&#8221; Indeed, many of the people who turn to gun ownership do so precisely because they are hoping to protect themselves against trauma, against existential loss, against the unknown of life-changing injury or death.</p>
<p>To move forward in the debate about guns, we have to start talking about trauma, and talking about how we address trauma in society. But that requires vulnerability—and in a context as politically divisive as the U.S. right now, that also requires a whole lot of courage.</p>

<p><a href="https://www.foxnews.com/category/person/donald-trump" target="_blank" rel="noopener noreferrer">President Trump</a> on Wednesday announced a list of 20 more people he would consider nominating to the <a href="https://www.foxnews.com/category/politics/judiciary/supreme-court" target="_blank" rel="noopener noreferrer">Supreme Court</a>, including three sitting Republican senators.</p>
<p class="speakable">Speaking from the Diplomatic Reception room of the White House, the president read off a list of names including <strong>Daniel Cameron</strong>, the Kentucky attorney general who recently spoke at the Republican Convention, as well as Sens. <strong>Ted Cruz</strong> of Texas, <strong>Tom Cotton</strong> of Arkansas and <strong>Josh Hawley </strong>of Missouri.</p>

<p>The president said the 20 new names are being added to his <a href="https://www.foxnews.com/politics/trump-adds-5-names-to-scotus-nominee-list-for-future-open-seat" target="_blank" rel="noopener noreferrer">previous list of 25 judges.</a></p>
<p>At the same time, Trump used the announcement to hit his opponent for not releasing his own list of potential nominees. He said Joe Biden had not released names because &#8220;they are so far left [they] could never withstand scrutiny.&#8221;</p>
<p>He called on the former vice president to name who he might nominate to the court, saying it is &#8220;very important that he do so.&#8221; Trump also warned of the consequences to the court if Democrats win the presidency.</p>

<p>&#8220;Unfortunately, there is a growing radical left movement that rejects the principle of equal treatment under the law,&#8221; he said. &#8220;If this extreme movement is granted a majority on the Supreme Court, it will fundamentally transform America without a single vote of Congress.&#8221;</p>
<p>&#8220;Radical justices will erase the Second Amendment, silence political speech and require taxpayers to fund extremely late-term abortion,&#8221; he said. &#8220;It will give unelected bureaucrats the power to destroy millions of American jobs. They will remove the words under God from the Pledge of Allegiance. They will unilaterally declare the death penalty unconstitutional, even for the most depraved mass murderers.&#8221;</p>
<p>After the announcement, Hawley thanked the president but tweeted that he has declined a potential nomination.</p>
<p>&#8220;I appreciate the President’s confidence in listing me as a potential Supreme Court nominee,&#8221; he wrote on Twitter. &#8220;But as I told the President, Missourians elected me to fight for them in the Senate, and I have no interest in the high court. I look forward to confirming constitutional conservatives.&#8221;</p>

<p>Cotton said he was honored to be considered. Moments before he was announced on the list, he <a href="https://twitter.com/TomCottonAR/status/1303786807692124160" target="_blank" rel="noopener noreferrer">tweeted</a>: &#8220;It&#8217;s time for Roe v. Wade to go.&#8221;</p>
<p>&#8220;The Supreme Court could use some more justices who understand the difference between applying the law and making the law, which the Court does when it invents a right to an abortion, infringes on religious freedom, and erodes the Second Amendment,&#8221; the Arkansas senator said in a statement.</p>
<p>Cruz also said it was an &#8220;immense honor&#8221; to be considered for the role.</p>
<p>&#8220;It&#8217;s humbling and an immense honor to be considered for the Supreme Court,&#8221; the Texas Republican said in a statement. &#8220;The High Court plays a unique role in defending our Constitution, and there is no greater responsibility in public service than to support and defend the Constitution of the United States.&#8221;</p>
<p><strong><a href="https://www.foxnews.com/politics/trump-unveils-list-of-11-potential-supreme-court-picks" target="_blank" rel="noopener noreferrer">TRUMP UNVEILS LIST OF 11 POTENTIAL SUPREME COURT PICKS</a></strong></p>
<p>The latest iteration of the list is the first update since November 2017 and comes less than two months before the presidential election. The list was first released in the later stages of the 2016 Republican presidential primary after then-rival Ted Cruz had dropped out of the race. It was aimed at reassuring conservatives suspicious of Trump that he would make Supreme Court picks in line with their priorities &#8212; the newest version has the same fundamental purpose.</p>
<p>According to Senate Majority Leader <a href="https://www.foxnews.com/category/person/mitch-mcconnell" target="_blank" rel="noopener noreferrer">Mitch McConnell</a>, R-Ky., it worked in 2016.</p>
<p>&#8220;Here is a guy who is about to become our nominee who was doing fundraisers for Chuck Schumer four years ago,&#8221; McConnell said at The Federalist Society&#8217;s 2019 Kentucky Chapters Conference. &#8220;So there were a lot of us saying, &#8216;What are we getting here?&#8217; And the list reassured a whole lot of Republicans, beginning with Republican U.S. senators.&#8221;</p>
<p>He added: &#8220;Fast forward a little further and by the fall, the single biggest issue that brought nine out of 10 Republican voters home to Donald Trump, just like nine out of 10 voted for Mitt Romney, was the Supreme Court.&#8221;</p>

<p>This list is the first one produced without the direct involvement of former White House Counsel Don McGahn, who was the driving force behind the confirmations of Justices Neil Gorsuch and Brett Kavanaugh. McGahn was involved with Trump&#8217;s campaign from the early stages and is seen as one of the most influential people on the Trump administration&#8217;s judicial selection process along with Federalist Society Co-Chairman Leonard Leo.</p>
<p>McGahn&#8217;s fingerprint is still on the most recent list, however, as Trump, with McGahn’s involvement, nominated dozens of judges in his first term to circuit courts of appeals, which is where most Supreme Court nominees have come from in recent decades.</p>
<p>&#8220;President Trump has a great problem to have,&#8221; McGahn said in an interview with Fox News earlier this summer. &#8220;He has nominated and appointed a slew of excellent jurists to the circuit courts. Thus, he already has a public list: the people he put on the circuit courts.&#8221;</p>
<p>The list released Wednesday was kept under wraps right up until it went public, with the group of people involved in formulating it including Leo, current White House Counsel Pat Cipollone and Judicial Crisis Network President Carrie Severino, a former clerk for Justice Clarence Thomas.</p>
<p>Severino told Fox News earlier this summer that she expects Trump&#8217;s Supreme Court list to be a major factor in the upcoming election.</p>
<p>&#8220;Twenty-one percent of voters said that the Supreme Court was their number one issue. That&#8217;s more than a fifth of the voters. So it was hugely significant,&#8221; she said.</p>
<p>There was an active vacancy after the death of late Justice Antonin Scalia in 2016, but the next presidential term could be even more significant for Supreme Court nominations.</p>

<p>But the Trump team defended including three sitting senators. Counsel to the president Jay Sekulow said &#8220;there is precedent for this.&#8221;</p>
<p>&#8220;The three senators are constitutionalists, several of them have clerked for former chief justice, tremendous constitutional experience,&#8221; Sekulow said in a call with reporters. &#8220;I think it is good to have a variety of different backgrounds represented. Not everyone on the Supreme Court needs to be a judge. By having senators, it opens up to a broader swath of opinions and views and I think that&#8217;s a healthy thing.&#8221;</p>
<p>White House Press Secretary Kayleigh McEnany said in a statement, “President Trump’s list of potential Supreme Court nominees demonstrates his commitment to appointing originalists, who will abide by the Constitution, and textualists, who will implement the plain meaning of statutes. They will uphold the rule of law and ensure that America continues to shine as a beacon of freedom and justice around the world.”</p>

<p class="speakable">The <a href="https://www.foxnews.com/category/us/personal-freedoms/second-amendment" target="_blank" rel="noopener noreferrer">National Rifle Association</a> is fighting back against a lawsuit filed Thursday by <a href="https://www.foxnews.com/category/us/us-regions/northeast/new-york">New York</a>’s attorney general by submitting its own civil suit against the state official, accusing her of defamation and violating its rights to free speech.</p>
<p class="speakable">The NRA’s lawsuit was filed in the federal court of New York and alleges Attorney General Letitia James “made the political prosecution of the NRA a central campaign theme” when she was running for the AG’s office in 2018 and has not treated the association fairly since.</p>
<p>“Despite hopes that playing by the rules would procure a just outcome, the NRA has not been treated fairly by James’s office,” the 19-page suit states. “The New York Democratic Party political machine seeks to harass, defund, and dismantle the NRA because of what it believes and what it says.”</p>
<p>The defamation allegations stem from James&#8217; public descriptions of the NRA as a &#8220;criminal enterprise&#8221; and &#8220;a terrorist organization.&#8221;</p>
<p>“James boasted that she would strike foul blows against the NRA and pound the NRA into submission. She vowed that she would use the NYAG’s investigative and enforcement powers for the precise purpose of stanching political speech (‘deadly propaganda),” the lawsuit states. “She has begun to deliver on her campaign promises to retaliate against the NRA for constitutionally protected speech on issues that James opposes. As NYAG, James has regrettably succumbed to ‘individual passions, and individual malevolence.’”</p>

<p>“I think the NRA should move to Texas and lead a very good and beautiful life. And I’ve told them that for a long time. I think they should move to Texas – Texas would be a great state or to another state of their choosing – but I would say that Texas would be a great place and an appropriate place for the NRA.”</p>
<p>James sued the NRA, which is headquartered in Fairfax, Va., in an effort to dissolve the gun-rights group “for years of self-dealing and illegal conduct,” she <a href="https://ag.ny.gov/press-release/2020/attorney-general-james-files-lawsuit-dissolve-nra">announced</a> Thursday.</p>
<p>The lawsuit, filed Thursday in the Supreme Court of the State of New York, alleges that the NRA “diverted millions of dollars away from its charitable mission for personal use by senior leadership.” She further slammed the association for what she called “years of self-dealing and illegal conduct that violate New York’s charities laws and undermine its own mission.”</p>

<p>James said the actions of the accused quartet “contributed to the loss of more than $64 million in just three years for the NRA.”</p>
<p>While the lawsuit accuses all four men of wrongdoing and seeks fines and remuneration, none of them have been charged with a crime.</p>
<p>In turn, NRA President Carolyn Meadows responded by calling the lawsuit a “baseless, premeditated attack” on the group and the Second Amendment.</p>
<p>“You could have set your watch by it: the investigation was going to reach its crescendo as we move into the 2020 election cycle,” Meadows said. “It’s a transparent attempt to score political points and attack the leading voice in opposition to the leftist agenda.”</p>
<p>She further called the suit “a desperate move that is part of a rank political vendetta.”</p>
<p>“This has been a power grab by a political opportunist,” she said. “Our members won’t be intimidated or bullied in their defense of political and constitutional freedom … we not only will not shrink from this fight – we will confront it and prevail.” ​</p>

<p>Also on Thursday, Washington D.C. District Attorney Karl Racine announced his office was suing the NRA Foundation for “misusing charitable funds.” He has been investigating the NRA Foundation for more than a year.</p>
<p>“Donors gave money to fund firearms safety, firearms education and marksmanship training,” Racine alleged. “Instead, that money was diverted to support wasteful spending by the NRA and its executives.”</p>
<p>In a statement provided to Fox News, a spokesperson for the National Shooting Sports Foundation, a guns-trade group, said the association was &#8220;troubled&#8221; by James&#8217; decision, which he called &#8220;politically-driven.&#8221;</p>
<p>In the lawsuit, spokesperson Mark Oliva said, &#8220;James seeks to punish the over five million members of the National Rifle Association based on mere allegations of possible wrongdoing by a few individuals.&#8221;</p>

<p><span class="article-header__subtitle">His attempt to enforce unpopular and unconstitutional gun-control laws is doomed to failure.</span></p>
<p><span class="small_caps"><span class="drop">R</span>alph Northam</span> is about to make the biggest tactical mistake in Virginia since Cornwallis decided to park his army at Yorktown. With his attempt to force local commonwealth’s attorneys and sheriffs in Second Amendment sanctuaries to enforce his unconstitutional gun laws, Governor Northam is setting himself up for a catastrophic failure. In fact, there’s no way for Northam to win the fight he seems intent on picking with Virginia gun owners and Second Amendment sanctuaries.</p>
<p>The governor isn’t being helped by fellow Democrats such as U.S. congressman Donald McEachin, who said the governor should call out the National Guard to enforce the law, or Attorney General Mark Herring, who blithely says he expects that the laws will be followed once they’re on the books.</p>
<p>There are also Democrats, such as Delegate David Toscano, who have been comparing the Second Amendment–sanctuary movement to the Massive Resistance movement that unfolded in Virginia in the wake of the <em>Brown v. Board of Education</em> decision in 1954. Massive Resistance came about after Democratic governor Thomas B. Stanley organized a state-level opposition movement to the integration of public schools in Virginia in the late 1950s. To compare it to today’s Second Amendment–sanctuary movement is to compare apples and oranges on a couple of different levels.</p>
<p>First of all, the Second Amendment–sanctuary movement is morally just, unlike the Massive Resistance movement of the late ’50s and early ’60s. The Second Amendment–sanctuary movement isn’t about curtailing rights, but rather about protecting their free exercise.</p>
<p>Practically speaking, Massive Resistance was a top-down movement, spearheaded by U.S. senator Harry Byrd and his fellow Democrats in the governor’s mansion and Virginia’s attorney general’s office. The Second Amendment–sanctuary movement, on the other hand, is a hyper-local grassroots movement that has no leader, though state-level Second Amendment groups are doing a good job of informing folks where meetings are taking place and even providing curious supervisors with examples of Second Amendment–sanctuary resolutions that have been approved elsewhere. Thousands of people show up at these board-of-supervisors meetings, and not because Philip Van Cleave or Cam Edwards or Nick Freitas or anyone else told them to be there. They’re showing up because their neighbor told them about the meeting, or they saw something on Facebook. They’re showing up and speaking out because they care.</p>

<p>Ultimately, it’s the people in these Second Amendment–sanctuary communities who are the last line of defense against the infringement of their rights, but thankfully we have several other defensive options at our disposal. We can even thank today’s Virginia Democrats for providing a blueprint to follow. Call it passive resistance, not Massive Resistance.</p>
<p>Anti-gun Democrats hoping to force compliance with the impending gun-control laws frequently argue that, because Virginia is a “Dillon’s Rule” state, county supervisors have no ability to decide which laws will be enforced or not. That’s true, but it doesn’t matter, because it’s not the county board of supervisors that enforces the law, any more than legislators in Richmond or Ralph Northam do. Law enforcement in these Second Amendment sanctuaries is largely the role of the county sheriff and the commonwealth’s attorney, and Democratic commonwealth’s attorneys have demonstrated in recent months that it’s possible to not enforce a state law, as long as you’ve got the judges to go along with you.</p>
<p>Norfolk and Portsmouth commonwealth’s attorneys Greg Underwood and Stephanie Morales, respectively, announced earlier this year that their offices will not prosecute low-level drug offenses. Morales has apparently persuaded judges in Portsmouth to go along, while in Norfolk, Underwood has had to deal with judges who have refused in some cases to dismiss the charges.</p>
<p>Meanwhile, although Governor Ralph Northam, Attorney General Mark Herring, and various and sundry Virginia Democrats have railed against the Second Amendment–sanctuary communities for turning the rule of law upside down, sowing chaos, and making mischief, they’ve not said a word when these fellow Democrats have decided that certain laws won’t be enforced. They seem to simply believe it’s different when Democrats do it.</p>
<p>It’s not. Democrats have taught us a thing or two about how to #Resist over the last three years, and Virginia’s Second Amendment supporters are going to put those lessons to work in the months ahead.</p>
<p><strong>*    *    *</strong></p>
<p><span class="small_caps"><span class="drop">S</span>ince</span> Virginia Democrats have given commonwealth’s attorneys the green light to ignore portions of state law they don’t agree with, why shouldn’t sheriffs have that same authority? After all, they’re usually working with limited resources and already need to prioritize which crimes they will investigate. Why shouldn’t a sheriff say he’s not going to waste time and resources on investigations that solely involve non-violent possessory offenses against Northam’s new gun-control laws? Why shouldn’t commonwealth’s attorneys say the same? And why shouldn’t the Virginia GOP encourage sheriffs and commonwealth’s attorneys to do so? They would simply be taking a page from the Democrats’ playbook.</p>
<p>Even if no official or formal policy can be established, word gets around pretty fast in these rural counties, as we’ve seen with the turnouts for the Second Amendment–sanctuary meetings. Ralph Northam and Mark Herring can’t police every decision by every officer to arrest or not, or by every prosecutor to bring a case or dismiss it, nor can they remove the discretion that must be a part of those jobs.</p>
<p>The simple truth is that the criminal justice system couldn’t handle full enforcement of every law on the books, especially if the defendants demanded their right to a speedy trial by a jury of their peers. The vast majority of criminal cases in Virginia are plea-bargained down because if they all went to trial, the system would grind to a halt.</p>
<p>I believe that in many rural counties we will see passive resistance adopted in practice, officially or unofficially. But even in those Second Amendment sanctuaries where police chiefs, sheriffs, and commonwealth’s attorneys decide that they’re going to enforce the unconstitutional gun-control laws heading our way, there’s no guarantee of conviction.</p>
<p>As I said earlier, the last line of defense in the tactic of passive resistance is the citizens. In order for Ralph Northam to secure a conviction for a violation of one of his proposed gun laws in a Second Amendment sanctuary, here’s what would have to happen.</p>
<p>First, a law enforcement officer will have to decide to charge someone for a violation of one of Northam’s proposed laws. Perhaps it’s for allowing their 17-year-old daughter to have access to a firearm while she was alone in a rural farmhouse. Sure, she used the gun in self-defense when a couple of meth-heads tried to break in, but the parents broke the law and now they have to be charged. So, the officer arrests Mom and Dad.</p>
<p>Next, the commonwealth’s attorney will have to prosecute Mom and Dad for allowing their daughter, who’s been trained in responsible gun ownership and even competes in 4H Shooting Sports, to have access to the gun that she used in self-defense. Sure, it’s a good thing she’s alive, but the law’s the law.</p>
<p>Mom and Dad were at the board-of-supervisors meeting along with a thousand of their neighbors when their local Second Amendment–sanctuary resolution was passed. They know how their neighbors feel. And they decide to fight. They don’t plead down to lesser charges. They take it to trial. And now a jury of their peers will have to decide if they should be punished for allowing the little girl they’ve watched grow up defend herself against two intruders.</p>
<p>What do you think the odds are that Mom and Dad are acquitted? Personally, I don’t think that case would ever get prosecuted to begin with, but in most Second Amendment–sanctuary counties I would put the odds of conviction right around 0 percent. Governor Northam can threaten county officials with “consequences” for not enforcing his gun-control laws, but what’s he going to do when juries in rural Virginia start returning not-guilty verdicts for any charges brought under those laws?</p>
<p>Before Ralph Northam goes too far down this dead-end road of gun control, he should look at what’s happened in a few other states that have passed state-level gun-control laws in recent years. In New York, there’s been massive noncompliance with the laws, and the vast majority of prosecutions under the state’s SAFE Act, which restricts firearm rights, are taking place in just two of New York City’s five boroughs: the Bronx and Brooklyn. A large majority of defendants are young black men without serious criminal histories, who are facing years in prison for non-violent possessory offenses. As <em>Slate</em>’s Emily Jaffe wrote, the War on Drugs is being replaced by the War on Guns, but it’s still young minority men who are disproportionately impacted.</p>
<p>That will absolutely be the case with any gun-control laws that Northam may sign. The vast majority of enforcement will be in the Richmond, Petersburg, Norfolk/Virginia Beach, and Roanoke areas, with northern Virginia coming up close behind. The vast majority of charges will be for non-violent possessory offenses, the vast majority of defendants will be young black and Hispanic men from Virginia’s inner cities, and the vast majority of those defendants will not have any serious criminal history, though they may be heading down that road.</p>
<p>Instead of offering these individuals a way out, however, Ralph Northam wants to give them a crash course in criminality by putting them in prison.</p>
<p>This strategy of passive resistance can be put in place alongside the inevitable court challenges that will come for every new gun-control bill Northam signs into law, but it’s not a perfect solution. Some counties will absolutely enforce these laws, while the Virginia State Police will do the same. Gun stores can’t passively resist any new gun laws, though many will certainly get creative in finding ways to stay within the law and still sell as robust an inventory as they can.</p>
<p>“Red flag” laws, which allow for the seizure of firearms from an individual deemed to be an “extreme risk” of using them for violence, are another issue. If, under such a law, a judge tells a county sheriff to seize someone’s firearms before that person gets his day in court, how many county sheriffs will refuse? More than a few, I would guess. But if, on the other hand, local law enforcement are the ones that bring an initial petition to the judge, many judges will refuse to issue an Extreme Risk Protection Order and will stick instead with the state’s civil-commitment laws when they have concerns that someone may be a danger to himself or others. The county sheriffs I’ve spoken to say they believe that civil commitment, under which a dangerous individual can be involuntarily confined in a mental health unit, is a better option than a “red flag” order, which may force the sheriff to seize any legally owned guns but leaves the supposedly dangerous individual to his own devices. Sheriffs can easily argue that they shouldn’t be forced to use a tool they don’t believe is as effective as another one at their disposal.</p>
<p>If, however, lawmakers expand the categories of people who can file a red-flag petition, the sheriff and commonwealth’s attorney may not have any input at all before a judge issues an order. If Governor Ralph Northam wants to avoid a fight with Second Amendment sanctuaries, he could also structure the red-flag bill in such a way as to make it the responsibility of the state attorney general’s office to handle the petitions, and of the Virginia State Police to conduct the seizure of the firearms. I suspect Northam wants this fight, unfortunately, because he naïvely believes he can win.</p>
<p>Ralph Northam can get his way, but there’s no way he can win this fight. He can put the laws on the books, but he can’t enforce them. He can threaten public officials with punishment, but he has already allowed commonwealth’s attorneys to not enforce laws they don’t agree with. In most Second Amendment sanctuaries, these unconstitutional gun laws will likely be largely ignored by law enforcement. In those cases where individuals are charged solely with non-violent possessory crimes, such as violating the state’s universal background check, a jury of their peers will likely choose to acquit them in order to send a message to Richmond. And in deep-blue Democrat-controlled parts of the state, the laws will be strictly enforced, largely against young minority males who aren’t violent criminals.</p>
<p>After all that, he can’t even be sure that the violent-crime rate will drop. It didn’t happen in Colorado when the state passed a magazine ban and universal background checks back in 2013. In fact, violent crime has increased by 25 percent since then. It didn’t happen in Maryland when the state passed the Firearms Safety Act in 2013. Beginning in 2014, Baltimore’s homicide rate began skyrocketing, and the city has had more than 300 homicides every year since (as opposed to the low 200s in the years before the act’s passage). In New York City, violent crime is down but shootings are up.</p>
<p>By focusing his efforts on Virginia’s legal gun owners, Northam is only empowering violent criminals, and he will largely be punishing only young men who may not be making the best choices, but who won’t be served by spending years behind bars for giving a gun to their friend to carry in self-defense on the streets of Petersburg.</p>
<p><strong>*    *    *</strong></p>
<p><span class="small_caps"><span class="drop">G</span>un</span> control will be Ralph Northam’s political Vietnam if he continues down this road, and calling in reinforcements in the form of the Virginia National Guard would only provoke another crisis, both within the Guard itself and in the Second Amendment–sanctuary communities where they would be dispatched. If Northam actually called out the Guard, he’d be the first governor to use military force to restrict the exercise of a constitutional right since Arkansas governor Orval Faubus called out the National Guard to block the steps of Little Rock Central High School rather than allow the school to be integrated in 1957.</p>
<p>Can you imagine Donald Trump calling out the 101st Airborne to protect the rights of Virginians, as Dwight Eisenhower did to protect the rights of Arkansans? Do Virginia Democrats really want to give that shameful episode of American history a reboot? Again, there is simply no way for the governor to win here, even if he signs every gun-control law that gets to his desk. Even if ultimately the U.S. Supreme Court were to uphold every law he signed, it would only be a Pyrrhic victory at best. He can make all the laws he wants, but he’s going to have a heck of a time trying to enforce them.</p>
<p>There is another way, though I don’t think Governor Northam is likely to take it. He should sit down with gun owners and Republican lawmakers for an honest discussion about ways to effectively promote public safety without provoking a constitutional crisis or widespread civil disobedience. Republican delegate Todd Gilbert has already come up with an excellent plan to combat violent crime in the state’s urban areas, and it doesn’t involve any new gun-control laws. Instead, it empowers cities to work with the U.S. attorneys in the area to identify and target the most violent offenders with one simple message: “You’re going to stop shooting. We’ll help you if you let us. We’ll make you if we have to.” Targeted prosecutions in the federal system put individuals who won’t change behind bars for as long as possible, while programs allow young men to actually break away from the cycle of violence and start to take control over their lives.</p>
<p>In fact, more and more academics are saying that the broad strokes of gun control are ineffective at addressing the small number of individuals who are driving violent crime in our cities. Professor Bindu Kalesan of Boston University, for example, has noted that gun-related violent crime among youths has been trending upwards in recent years, even in states such as Colorado and Maryland where gun-control laws have been put on the books. She says efforts to stem gun violence must focus on the individuals and groups who are actually committing these crimes, as well as addressing the issues that may drive the violence. What we don’t need, she says, are more “broad and blunt” gun-control laws.</p>
<p>That’s the better way to address drug-related and gang-related violence. What about suicide? Red-flag laws may take someone’s firearms from them, but it leaves them with their pills, their belts, their car keys, knives, and anything else they might use to take their own life. Supporters of red-flag laws claim that gun-related suicides have declined in Connecticut and Indiana, where these laws have been on the books for the longest amount of time, but they never mention that the overall suicide rates in both states have continued to climb, even with red-flag laws on the books. Fewer people may be killing themselves with a gun, but more people are killing themselves overall. I don’t know how anybody can call that a success story.</p>
<p>Instead of “free” community college for low-income Virginians, how about spending that $145 million a year on mental-health services instead? You could do quite a bit with that much money, including expanding access in rural areas through telemedicine and mobile clinics, in urban areas through grants to counseling programs, in communities large and small by funding drug-treatment and rehabilitation programs, and in schools by hiring more counselors and psychologists.</p>
<p>What about domestic violence? Instead of hoping that violent domestic abusers are going to be stopped by a piece of paper, why don’t we empower their victims instead? Allow individuals who’ve had to take out an order of protection to carry a firearm on an emergency basis, and help with expedited training if need be through state grants given to county sheriff’s offices to administer.</p>
<p>Also, put some teeth in the existing law. If someone violates an order of protection, don’t let them be immediately released on bond after they’ve been arrested. Allow high bonds for domestic-violence offenders who have violated orders of protection or have been arrested for abusing the victim while an order of protection was in place. We know the state can’t be present at every moment to protect these vulnerable individuals from harm, so the state has an obligation to let them protect themselves. The state also has an obligation, however, to ensure that those violating these orders should face real consequences. In addition, counseling needs to be a part of the consequences. It’s not enough to lock them up for a bit and let them stew in their own anger. Rehabilitation has to be a key component of any effort to combat domestic violence.</p>
<p>If Ralph Northam would focus on these three areas, not only would he receive backing from gun owners for his proposals, but if he effectively implemented these plans, he could see dramatic reductions in Virginia’s homicide and suicide rates, and fairly quickly. Instead of the political equivalent of Vietnam, Northam could produce the political equivalent of the first Gulf War; policies that work fast, are effective and end up enjoying a lot of popular support.</p>
<p>I have a feeling that the soundtrack to Virginia’s politics over the next few months is going to be more Country Joe &amp; The Fish’s “I-Feel-Like-I’m-Fixin’-to-Die Rag” (“And it’s 1, 2, 3, what are we fighting for?/Don’t ask me, I don’t give a damn, next stop is Vietnam”) than Bette Midler’s unofficial anthem of the Gulf War, “From a Distance,” but I’d love to be proven wrong.</p>
<p>The choice is ultimately up to Ralph Northam and Virginia’s Democrats. They can effectively address the state’s growing number of suicides and its drug- and gang-related violence, as well as domestic violence, without provoking a constitutional crisis and widespread non-enforcement of the laws, or they can go full speed ahead towards an impending political disaster and morass that will be Northam’s legacy for decades to come and the No. 1 issue for Virginia voters in the federal elections in 2020 and the state elections in 2021.</p>

										<content:encoded><![CDATA[<p class="speakable">Texas Attorney General Ken Paxton said Tuesday that most Texans do not support 2020 Democratic presidential hopeful <a href="https://video.foxnews.com/v/6085962963001/" target="_blank" rel="noopener noreferrer">Beto O&#8217;Rourke</a>&#8216;s mandatory <a href="https://www.foxnews.com/media/joey-jones-beto-orourke-take-guns" target="_blank" rel="noopener noreferrer">gun</a> buyback plan.</p>
<p class="speakable">“I don’t think most Texans want to give up their guns,” Paxton told <a href="https://www.foxnews.com/media" target="_blank" rel="noopener noreferrer">“Fox &amp; Friends,”</a> pushing back against O’Rourke’s comments that most Texans are behind his mandatory gun buyback program.</p>
<p>Paxton said O’Rourke’s comments weren’t received as well as he would have anticipated.</p>
<p>“The reality is taking away guns from law-abiding citizens is not going to stop crazy people from using weapons to kill people.”</p>

<p>At the Democratic party&#8217;s most recent 2020 presidential primary debate last week, O&#8217;Rourke declared, &#8220;hell yes,&#8221; in response to a question about mandatory AR-15 buybacks.</p>
<p>“Hell yes, we are going to take your AR-15, AK-47,” O’Rourke said on Thursday in Houston, receiving a loud round of applause from the audience.</p>
<p>“It’s certainly a comment that I think most Texans would not react well to and haven’t reacted well to,&#8221; Paxton said. &#8220;Maybe it plays nationally in states he’s trying to win, but it certainly doesn’t play well in Texas.&#8221;</p>

<p>On reducing gun violence, Paxton went on to say, “We need to do a better job securing our schools, our businesses, our churches. People need to be better prepared. We need more law enforcement involved in protecting those aspects of our society.&#8221;</p>
<p>He added: “Nothing is going to work perfectly, but there are certainly things we can do to protect our citizens better.”</p>
<p>O’Rourke was complemented by some of his rivals on the debate stage for his outspoken efforts on the issue of gun violence. However, some Democrats, including 2020 rival Pete Buttigieg, <a href="https://www.foxnews.com/politics/pete-buttigieg-beto-orourke-gun-control-ar15" target="_blank" rel="noopener noreferrer">argued that Republicans would twist the former Texas congressman&#8217;s words</a>, and his soundbite from the debate “will be played for years at Second Amendment rallies with organizations that try to scare people by saying Democrats are coming for your guns.”</p>
