WASHINGTON – Federal officials face the possibility of refunding more than $175 billion in collected tariff revenue if the Supreme Court strikes down President Trump’s emergency trade duties, according to new calculations from University of Pennsylvania researchers released Friday.

The analysis, conducted by the Penn-Wharton Budget Model at Reuters’ request, examined tariff collections made under the International Emergency Economic Powers Act (IEEPA) since Trump began implementing these measures in February 2025.

That temporary pause will give the court additional time to review the case but does not necessarily signal which way the court is leaning. The Biden administration and several immigration groups filed an emergency application with the Supreme Court hours earlier asking the justices to block enforcement of the law.

Without intervention, the law would have gone into effect on the morning of March 10. The Justice Department said that would “profoundly” alter the status quo “that has existed between the United States and the States in the context of immigration for almost 150 years.”

The case, Trump v. Anderson, arose from the Colorado Supreme Court’s 4-3 decision to remove Trump from the state’s primary ballot, citing his actions on Jan. 6, 2021, as violating the 14th Amendment. The six-page majority opinion for the Supreme Court overturned Colorado’s decision and halted similar rulings one day ahead of Super Tuesday, when Colorado and dozens of other states will vote for their preferred primary candidate ahead of the November general election.

The high court’s opinion was per curium, meaning it had no direct author, and it held that “because the Constitution makes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates, we reverse.”

The new law drew celebrations from supporters and massive protests from those who said it “seriously damaged” the “system of checks and balances in the state of Israel,” as U.S. President Joe Biden called the vote “unfortunate.”
