The future of TikTok in the US and regulatory pressure on Nvidia in China became central talking points in the ongoing negotiations between Washington and Beijing this week.

Treasury Secretary Scott Bessent said President Donald Trump’s willingness to let TikTok go dark was a decisive factor in shaping a framework agreement with China.

At the same time, China’s ruling against Nvidia over a 2020 acquisition surfaced during the Madrid round of trade discussions, underscoring how technology and national security concerns continue to dominate economic diplomacy.

Both developments are now shaping expectations ahead of Trump’s scheduled call with Chinese President Xi Jinping on Friday.

WASHINGTON (Reuters) -TikTok and its Chinese parent company ByteDance sued in U.S. federal court on Tuesday seeking to block a law signed by President Joe Biden that would force the divestiture of the short video app used by 170 million Americans or ban its use.

The companies filed their lawsuit in the U.S. Court of Appeals for the District of Columbia Circuit, arguing that the law violates the U.S. Constitution on a number of grounds including running afoul of First Amendment free speech protections. The law, signed by Biden on April 24, gives ByteDance until Jan. 19 to sell TikTok or face a ban.

“For the first time in history, Congress has enacted a law that subjects a single, named speech platform to a permanent, nationwide ban,” the companies said in the lawsuit.

The White House and U.S. Justice Department did not immediately respond to requests for comment.

The bill passed the House 352 to 65 with one member voting present, showing wide bipartisan support with backing from House Speaker Mike Johnson and former House Speaker Nancy Pelosi. It now heads to the Senate where its fate is more uncertain.

Feb. 12 (UPI) — President Joe Biden‘s campaign has joined TikTok, in an effort to gain young voters in his re-election bid, despite a Biden-signed law banning the popular video app on federal devices to protect national security.

On Sunday, Biden’s campaign posted its first video, captioned “lol hey guys.” It shows the president answering Super Bowl questions before the game between the Kansas City Chiefs and the San Francisco 49ers.

While the TikTok video post is meant to pick up young voters, it has also sparked plenty of controversy and pushback from lawmakers on both sides of the aisle over concerns about data privacy and national security concerns about the video app and its Beijing-based parent company, ByteDance.

The text of an inflammatory “letter to America” from 9/11 mastermind Osama bin Laden has gone viral on TikTok and drawn praise from young users — and US lawmakers from both sides of the aisle are blasting the China-owned app for promoting “terrorist propaganda.”

In the letter, bin Laden claimed that he orchestrated the deadly attacks on the World Trade Center that killed nearly 3,000 Americans because the US “attacked us in Palestine.”

Bin Laden called the creation of Israel a “crime which must be erased.” He also claimed that the AIDS epidemic was “a Satanic American Invention” and objected to US companies allowing women to have jobs, fuming, “You use women to serve passengers, visitors, and strangers to increase your profit margins.”

The Chinese Communist Party “maintained supreme access” to all data held by TikTok parent ByteDance, including information stored in the US, a former top executive at the company alleged in a bombshell lawsuit in California state court.

Yintao “Roger” Yu, the former head of engineering for ByteDance’s US operations, alleged he was fired from his gig after raising alarms about the company’s actions to his superiors.

He asserted that ByteDance leadership knew that a special committee within the Chinese government had a “backdoor channel” to access US user data – despite the company’s repeated denials that such a relationship existed, according to a copy of the lawsuit obtained by Bloomberg.

Yu also alleged that ByteDance has engaged in an effort to spread propaganda that backed the Chinese Communist Party’s views on TikTok, which has more than 150 million users in the US.
