West Virginia moves to block Medicaid funding for gender surgeries, abortions

BRIDGEPORT, W.Va (WDTV) – West Virginia Attorney General JB McCuskey announced the Fourth Circuit Court of Appeals reversed a lower court ruling, upholding the state’s Medicaid policy that excludes coverage for gender-affirming surgeries.

The court held that the policy does not violate the Equal Protection Clause, the Affordable Care Act, or the Medicaid Act.

West Virginia legislators have introduced Senate Bill 921 — which would permanently ban Medicaid funding for gender transition procedures and abortions and cut off state contracts with providers who offer them.

The bill was introduced by Senators Rose, Bartlett, M. Maynard, Rucker, Taylor, and Z. Maynard and has been referred to the Senate Committee on Health and Human Resources.
